Rapper Earl Simmons, better known as DMX, is housed in a mental-health unit at an Arizona State Prison Complex facility called Alhambra near 25th street and Van Buren.

DMX was sentenced to a year in jail (minus 113 days served) on December 16, after he pleaded guilty to violating the terms of his probation. At his sentencing, Judge Christine Mulleneaux told him she believes he has "an undiagnosed mental condition," possibly bi-polar disorder.

Rapper DMX: Back to jail.

Rapper DMX pleaded guilty this morning to a felony probation violation, and Judge Christine Mulleneaux sentenced him to a year in jail.

DMX (real name: Earl Simmons) had been on probation since July, after serving four months in Maricopa County jails for a previous probation violation. On November 18, he was arrested at his home in Cave Creek and charged with violating his probation by failing court-mandated drug tests and refusing to undergo treatment and counseling.

DMX Granted Continuance at Hearing; New Court Date Set for December 16

Embattled rapper DMX was granted a continuance at his probation revocation hearing this morning at Maricopa County Superior Court.

DMX, whose real name is Earl Simmons, was on probation following his release from jail this past July. He was arrested at his home in Cave Creek on November 18 and is accused of violating the terms of his probation. According to the arresting officer, the alleged probation violation is "ongoing use of cocaine, use of Oxycontin without a prescription, failing to submit to drug testing, failing to participate in counseling programs, failing to make payments, and driving on a suspended license."

At today's hearing, DMX's attorney, Glen Allen, asked Commissioner Jeffrey Rueter for a continuance to appear before Commissioner Mulleneaux. DMX's new court date is Thursday, December 16. In the meantime, he'll continue to be held without bond at the Lower Buckeye Jail.

Simmons was arrested Thursday night at his home in Cave Creek. He's charged with violating his probation by failing to submit to drug tests, driving with a suspended license, and possession of cocaine and Oxycontin without a prescription. He appeared in Maricopa County Superior Court this morning, where he denied the charges.

DMX Blames Probation Violation on a "Sip" of Booze. Court Records Claim it Was a Little More Than That

As we reported last week, legally challenged rapper DMX is back behind bars in Maricopa County, this time for violating the terms of his probation. He's now saying the reason for his violation was a sip of alcohol at a performance earlier this month.

What DMX claims was just a sip of alcohol is just the tip of the iceberg, though -- if you believe court documents obtained by New Times.

This is the sixth time "X," a.k.a. Earl Simmons, has been arrested in Maricopa County, and he's currently enrolled in an 18-month drug and alcohol treatment program he was scheduled to complete in about three weeks. Part of the program requires him to not drink or do drugs.

At a performance in Scottsdale earlier this month, "X" says he slipped up.

DMX Probation Violation: Compliments of Cocaine and Oxycontin

Since our earlier post about the arrest of DMX -- a.k.a. Earl Simmons -- we obtained some court documents that tell the real story of what the rapper allegedly did to violate his probation.

Initial reports -- ours included -- were that X violated his probation by not checking in with his probation officer. Court docs tell a different tale that includes an ongoing cocaine problem and his refusal to get treatment.

According to the arresting officer, "Mr. Simmons was arrested for probation violation for ongoing use of cocaine, use of Oxycontin without a prescription, failing to submit to drug testing, failing to participate in counseling programs, failing to make payments, and driving on a suspended license."
