Bill Montgomery Says Pima County Attorney is Stealing His Time in Abortion Hearing at Ninth Circuit Court

Testy, testy!

"I think there's a 'Deputy' in front of your title," Maricopa County Attorney Bill Montgomery tells one of the Pima County Attorney's underlings in an October 31 e-mail.

Montgomery makes the smarty-pants comment in a series of recent, heated e-mails released today in court records from a lawsuit against Arizona's new ban on late-term abortions.

The records were released because Montgomery's trying to deny Pima County Attorney Barbara LaWall, time to speak as a defendant in the lawsuit before the U.S. Ninth Circuit Court on Monday -- even though she is a defendant.

Montgomery filed an emergency motion on Thursday, asking LaWall to be kicked over the plaintiffs' side if she wants to speak.

His problem is that LaWall doesn't support the Arizona law.

The U.S. Ninth Circuit Court of Appeals delayed the implementation of Arizona's law banning abortions after 20 weeks of pregnancy, which was set to go into effect Thursday.

A federal district court judge ruled Monday that the law would be allowed to go into effect, but the ACLU and Center of Reproductive Rights filed an emergency to appeal to delay the implementation following the decision.

Bill Montgomery Wants Lawyer for Unborn in Suit Challenging AZ's 20-Week Abortion Ban; Judge Denies His Request

Bill Montgomery has been denied in his request to have a lawyer appointed to defend the unborn in a lawsuit that challenges a new state law banning most abortions after 20 weeks.

Bill Montgomery, Maricopa County Attorney, wants a lawyer for the unborn in a lawsuit targeting a state law that bans most late-term abortions.

The Republican politician filed a motion in federal court yesterday in which he asked that a lawyer be appointed in the case "to protect the rights of unborn children to their right to life and to be protected from unnecessary pain, etc."

U.S. District Judge James Teilborg wasted no time in turning down Montgomery's request, filing an order today that says the county attorney should have proposed the name of a pro-bono lawyer to undertake the representation of the unborn.

ACLU Trying to Stop 20-Week Abortion Ban; Says "No Court Has Ever Upheld" Such a Law

The American Civil Liberties Union and the Center for Reproductive Rights filed a complaint in Arizona Federal District Court Thursday to knock down the Arizona law that will make it illegal for women to receive an abortion after 20 weeks of pregnancy.

The threshold was set as the point at which fetuses start to feel pain, and while actual doctors haven't pinpointed the exact time at which this happens, the chief scientists at the Legislature declared that it's 20 weeks.

The abortion restriction is slated to go into effect in early August, and the ACLU would like it to go into effect the day after never.

An abortion clinic worker in Tucson agrees with an undercover activist to help perform a sex-based abortion in a video released today.
An undercover video by pro-life activists released today shows clinic workers in Phoenix and Tucson agreeing to violate a year-old state law that prohibits gender-based abortions.

 

In the video (below), an activist explains to "Barb" at the Camelback Family Planning clinic in Phoenix that she wants to terminate her pregnancy because of the fetus' gender.

"Um, don't tell us that," says Barb. "We don't want to know."
