An army veteran was shot and killed by a Maricopa County Sheriff's deputy yesterday in Fountain Hills, the Sheriff's Office says.

David Brandstetter, 26, was walking naked in traffic at around 12:45 a.m. Sunday, prompting two calls to 911 as drivers swerved to avoid striking him, MCSO reports.

Lieutenant Markley Johnson responded to the calls and found Brandstetter walking on a residential Fountain Hills street "acting erratically," an MCSO press release says.

Brandstetter allegedly opened the door of Johnson's patrol car, jumped on the officer, punched him, and demanded his gun, according to MCSO. When Brandstetter then tried to force the weapon away from Johnson, the deputy shot him, according to MCSO's account. Paramedics pronounced Brandstetter dead at the scene, MCSO reports.

The incident occurred just a mile from Brandstetter's residence.

"Something may have caused this young man to take leave of his senses," Sheriff Joe Arpaio says in a statement. "It's a sad situation all around. But regardless of the reason, the suspect's actions left no alternative for my deputy."

Johnson has been employed with the MCSO for 29 years.

Brandstetter was released from the army slightly over a year ago, MCSO reports. He was married with three children and worked as an air conditioning technician, according to the agency.

A request for additional information was not immediately returned.

I knew David and he was a good hearted man, a loving husband and father. I could NEVER imagine him trying to harm anyone!! He needed HELP, not to be shot and killed!! Completely heart breaking for the Brandstetter's. His wife literally just gave birth to their third child 4 weeks ago. Not only that, David was the main provider for his family which they are now left with nothing...

If there was any time to pay it forward, now would be it. For those looking to donate to the Brandstetter family in their time of need, please select the link below. Much love ♥

dude...the guy was naked, jumped into the car, the cop was alone, the guy was punching and assaulting the cop and trying to get at his gun. WTF you expect the cop to do? If this case involved a civilian and he had a gun as well, you wouldn't say a word with that person shooting the guy.

Good? I wouldn't say GOOD to having to kill anyone, esp when they are stark raving mad out of their mind and not knowing what caused it. First of all, anyone being attacked like that has to kill the person as it is pretty much impossible to get them off them unless there is someone else immediately present who can help to do so. But pinning down someone who is naked is very difficult w/o texture from clothing to help. So you do what you have to do, as these ppl are out to kill who they attack. Second, when I refer to saying, "these people", and I referring to this small group, yet ever growing of naked, attacking people in society. If you haven't read about it, Google it. It started with what ppl thought were the bath salt case back east...I can't remember if it was FL, GA or NC, but it was in one of those areas several years ago. But since, there have been several of these incidents each year across the country. When they autopsy their bodies, generally no sign of alcohol or illegal drugs in the body. Sometimes low level of MJ, but that will not account for this behavior. They often cannot find things under toxicology. So what in the world is causing this behavior? They are being called "zombie attacks" because of this 'phenomena".

Is the solution. Always shooting? Use other means.

That is so true Anita, just because the officer works for Maricopa County , that makes him a bad person, never mind he was getting the crap beat out oh by an unknown assailant, just because the officer identified himself does not mean the assailant complied. The officer has a right to defend himself the best way possible, even with deadly force.

I have to agree with Scott! Kinda hard to negotiate with a lunatic when he's assaulting you. The officer did what needed to be done. This is just news because you all hate Arpaio and because the word veteran was used!

ACLU? WTH are you talking about? When has the ACLU ever been against body armor?

Mary Shoff

How do you know he is a veteran if he had no clothes on.

Gary Deyoung

Really, WTF does the ACLU want our cops to die? Cops needs more and better body armor and weapons to protect themselves from criminals that use military weapons. I am so sick and tired of cops dying needlessly. And criminal lovers that want to reduce protections for cops. You idiots, if your ideals were implemented. More cops would die.

Nick Ren, I am a veteran and go to the VA. They're changing a lot after the scandal, but they're far from providing top notch care for the veterans.

Well, how did everyone found out the guy was an Army vet afterwards? He didn't have to fatally shoot him unless he was in danger, which I assume he was. I'm not condoning the veteran but he's not among us to defend himself. Still not a good look for both agencies.

GOOD! Too bad for that idiot. But, after reading many of these posts We're supposed to believe that the officer should have called the DOD to check his veterans status, offered him clothing, provide him with counseling, suggest anger management, then let him go. Never mind the raving jackass attacked him after jumping in the patrol car. I wonder what you whiners and sympathizers would do if some lunatic naked freak jumped in your car and started pounding in you. Tell him to stop? Ask him to get dressed? If you have no law enforcement background (I do, retired!) or have no clue on procedure then keep whining. Uh, never mind. We'll still come when you call 911. DUH!!!!!!!

I find it hard to believe a police officer could not control a naked man, so he killed him!!! I call BS! Shoot him in the foot or calf.....come on!!!!!!

Just wondering, do officers typically leave their doors unlocked so anyone can just open them while they are inside? Or do they just leave them open when a naked and deranged man is approaching them? Not sure what the proper protocol is for making horrible decisions.

Nick Ren

Kind of hard to reason with someone who is actively seeking to take away your firearm. Btw phoenix va sound like it provides loads of help for it's veterens.

Angie Rivera

Didn't occur to the officer that the veteran really needed help and could've tried to calm him and take him to the VA hospital?? Bad publicity for both the VA and MCSO, like they need any.

Well this story is truly disturbing, a naked unarmed, mentally deranged man killed for what disturbing traffic? This officer is unfit to carry a gun let alone be a law enforcement officer, sadly under the sadist regime of Arpiao he will likely be given a medal of honor!

Condolences to the family of the deceased.

Not sure if this is justified. Hopefully a professional police agency will thoroughly investigate.

What military weapons did the naked man have?  That's a penis, not a cannon.

MaskedMagician1967

Scott, the deputy couldn't have known the victim was/is a military veteran at that time.

That said, it's entirely possible the victim had a PTSD diagnosis from his doctor (not the VA) and may have been off his medication.

There are still too many unanswered questions.

@rh19541954 Officer was justified in his action's.Just another sad reminder why we need to listen to people asking for help instead of assuming.Sad situation all around for family and children to grow up without a father as well as the Officer's involved.

@rh19541954

That's a ridiculously and dishonestly inaccurate description of what happened.

He wasn't killed for disturbing traffic.  The officer clearly approached him with the intention of simply speaking to him. He was killed for attacking the officer and trying to take his sidearm.

Please try to be more honest.

@arizonanewtimes.com yeah twit it does matter. being a vet, he fought the battles you were to cowardly to fight. being a vet he fought for the country you seem to think is yours only. being a vet he was also the one damaged mentally and YOU should have been one of the ones getting him the help he needed.....................after all he fought the wars and battles you couldnt muster the balls to do yourself. him being a vet is very important. if loud mouthed jackasses like yourself would have been as vocal about the care of those of us who defended your freedom as you are about defending people like Horne and Arpaio............he wouldnt have ended up in a situation that made shooting him an option for the officer. i am not saying the officer was in the right or the wrong (i wasnt there)..........................but i am emphatically declaring YOU to be wrong

@valleynative @rh19541954 And I guess you were there! " The officer clearly approached him with the intention of simply speaking to him" ? That statement gives the reader the impression that you witnessed this event. Your request for honesty was the one disturbing traffic, you asked for it so I gave it to you.

@valleynative Try to be more honest, good luck with that one ,the cop was a 29 yr seasoned veteran in his field  and the low informed commenting here want him crucified last week we had a rookie cop from ASU and the same dipshits here wanted him crucified.  You just cant make this shit up

Zigs, I can't imagine what horrors the deceased witnessed.

That said, in boot camp the drill instructors made us soldiers recite the soldiers creed, which stated that the soldier is physically and mentally tough.

And with the VA controversy, he likely was on a year-long waiting list to see a VA doctor and needed medical help, which he likely didn't get.

He allowed the man to approach the vehicle closely enough that he was able to open the door.  That tells a person with common sense that he didn't see the man as a threat.

See how that works?

degovia2002
degovia2002

@DonkeyHotay @Ponder Yes That is right, that soldier more than likely was having a PTSD episode and wanted to die anyways. He has a wife and kids and family that love him but he could not live this way.  However, it's funny there was no witnesses to this, at least I did'nt read anything about witnesses.
