Jan Brewer's Anti-DACA Driver's License Policy Halted by Appeals Court

A federal appeals court has temporarily halted the state from enforcing rules that prevent participants in the Obama Administration's Deferred Action for Childhood Arrivals (DACA) program from receiving driver's licenses.

Governor Jan Brewer had implemented that policy by executive order in 2012, and it wasn't long before it drew a lawsuit from civil-rights groups.

Brewer explained the move was to prevent "illegal people" from getting driver's licenses, but her ban didn't include other non-citizens who are allowed to get Arizona driver's licenses.

The lower court didn't grant an injunction against the policy, however, the federal judge noted that the plaintiffs did have a good likelihood of succeeding in their claim that the policy violates the constitutional right of equal protection.

Faced with this, Brewer's administration then revised the policy, extending the ban to more non-citizens, although they'd previously been able to obtain a license without any such trouble from Brewer.

The appeals court panel still issued a preliminary injunction against Brewer's policy "prohibiting Defendants from enforcing any policy by which the Arizona Department of Transportation refuses to accept Plaintiffs' Employment Authorization Documents, issued to Plaintiffs under DACA, as proof that Plaintiffs are authorized under federal law to be present in the United States."

The injunction against Brewer's order will remain in place until further judgment is made in the case.

Once again, the federal judges have to educate a Governor and state who frequently violates the U.S. Constitution, taking the state backwards. Taxpayers' dollars wasted that could be used to solve Arizona's crises.

I'm thrilled by this. No more sitting in the dirt at the drive in. I qualify for this. The reason I sympathize is because I was brought here as a child from a different country (not Latin America) so I was never really thought of as an immigrant. Just a kid who had a funny accent. I probably should have left years ago but I didn't feel like being conscripted into the military or something else the insane government my parents left might have cooked up. My parents left after I started college so interrupting my education wasn't really an option. I'm sure the guys who hate immigrants in this thread wouldn't think I was one. They'd probably try to convince me to join them or vote for their cause. I'm tall, white, only have a very slight accent now ( thank you television). Even my neighbors never knew I was here illegally until I told them. They didn't care. I was just the guy who rode his bike everywhere and grew tomatoes. The point is this is a big step to help me out. Now I can have a legitimate means of transportation. I work thanks to DACA and I was very happy to be able to work legally. It seemed kind of funny to have a college degree but absolutely no useful application for it. Eventually I hope to get a green card and start the process of becoming a citizen. I would like to vote but I don't mind waiting for that. Apparently people don't see that as a big deal but I have wanted to. The people on here who say mean things have had it easy. They grew up speaking the language and they have incredible freedom. I am proud that I've done everything I'm supposed to and am on the right path to becoming recognized. I admit I don't know many others in my situation but the ones I know cannot wait for that day when they can pay taxes and vote and be treated as equals. It won't happen overnight but it will eventually, not because of the president or politics but because we put in the work and showed we belong here as much as anybody else.

I appreciate the difference, and actually support a path for them and really for anybody who's been here a long time, has learned English and obeyed the law, but the fact that they pay taxes does not change their legal status or automatically make them eligible for services provided to citizens.

@valleynative @Cozz VN, like the entire state of AZ takes more than it gives to the feds?  AZ get's back over $1.30 for every dollar paid to the feds in taxes.  Seems you should leave this state and more to a state that pays more than it gets - Many Blue states will do that for you!

There's nothing wrong with some taking more than they pay.


However, as I've explained before, Arizona takes more than we give because we have so much federal land, military bases, and destitute citizens whose parents were allowed to cross the border.

The same is true of several "red" states.  Try not to think in such simple terms.  Not everything can be divided into "us" vs "them".

We're discussing whether or not the fact that they pay taxes gives them access to all privileges offered by the State.  How they got his has no bearing.  Neither does debtor's prison.  Thanks for bringing meaningless emotional images into the debate though.  That's always entertaining.

If you want the benefits of society, you have an obligation to follow its rules, even if you pay.

States don't have "rights", States have POWERS. Individuals have RIGHTS.


And the States are supposed to use their POWERS over Individuals with discretion, and only when necessary -- not out of hatred, bigotry, racism or malice.
