Joe Arpaio's Monitor in Melendres Appointed by Judge G. Murray Snow

U.S. District Court Judge G. Murray Snow today appointed veteran cop-watcher Robert Warshaw of the North Carolina-based Warshaw and Associates to serve as independent monitor in the ACLU's big racial-profiling case Melendres v. Arpaio.

Warshaw, a former chief of the Rochester (New York) Police Department and onetime associate director of drug policy in the Clinton administration, beat out five other contenders for the job, including controversial former New York Police Department Commissioner Howard Safir, who was the top pick of Sheriff Joe Arpaio and the MCSO.

Warshaw's résumé notes that he currently serves as independent monitor in a number of court orders involving local law enforcement agencies, including the police departments of Detroit, Oakland, and Niagara Falls, New York, among others.

Each side in Melendres submitted three nominees for the position to Snow. Warshaw was one of the three nominated by the ACLU and the plaintiffs in Melendres.

In his new role, Warshaw will serve as Snow's "eyes and ears," reporting back to the judge on the progress that the Sheriff's Office has made in complying with the court's final order in Melendres, which prescribed a laundry list of reforms for the agency so that it ceases its discriminatory treatment of Latinos.

In May, Snow found the MCSO guilty of racial profiling and enjoined it from further prejudiced policing.

When the plaintiffs and the defendants could not agree on a comprehensive plan to enforce Snow's order, Snow issued an injunction, outlining what Arpaio's agency must do to comply.

Snow ordered new training for all MCSO deputies, regular community meetings, and cameras for all MCSO vehicles, and it asked the parties in Melendres to agree on a monitor to oversee the implementation of these and other requirements.

The parties could not agree on a monitor, so each side gave Snow a list of names to choose from.

The MCSO recently asked for and received from county supervisors, an additional $21.9 million for the costs of implementing Melendres in fiscal years 2014 and 2015.

That cost will increase, as the MCSO must be considered "in compliance" of the court's order for three years running before it can be asked to be released from its dictates.

Thursday, Arpaio's office announced that it had sent a letter to U.S. Attorney General Eric Holder blaming the verdict in Melendres on the training MCSO officers received from U.S. Immigration and Customs Enforcement back when ICE was keen to grant limited immigration authority under the federal government's 287(g) program.

The press release said Arpaio was demanding $39 million in reimbursement from the feds. This is pretty amusing on several fronts, as ICE jerked Arpaio's 287(g) street authority in 2009, though Arpaio continued using the same tactics without it.

"Arpaio correctly contends," the release states, "in his letter to Attorney General Holder that it was the training and instruction given to his deputies by ICE officials during a five week long course led by ICE officials on how to enforce immigration laws that provided
the basis for which deputies were later accused of racially bias policing."

Which sounds like an admission of guilt to me. Sort of like blaming a gun shop for selling you a gun, after you go out, rob a bank, and get arrested for it. You still robbed the bank, or in this case, used racial profiling, right?

And if Arpaio agrees that he "robbed the bank" (i.e., illegally profiled Latinos), why appeal his "conviction," as he is doing in Melendres, an act that costs the public even more money?

There is a kernel of truth in Arpaio's media stunt, however. With the MCSO's known pattern of human rights abuses, it should never have been given immigration authority under 287(g).

Indeed, the 287(g) program was and is inherently flawed, and the federal government does deserve some of the blame for allowing a bad actor like Arpaio to acquire additional police authority, which he promptly used to discriminate against Latinos.

But if we want to play the blame game, who put Arpaio in power, kept him in power for 20 years, and applauded him when he did wrong? The majority of Maricopa County voters.

Which is why I recently proposed, tongue firmly in cheek, an Arpaio sin tax for those who voted for Arpaio in the last election.

Sadly, that has about as much chance of happening as the feds giving Arpaio $39 million for his agency's bigoted and illegal behavior.

Arpaio is like Hitler. Here's why:

Hitler blamed the Jews for his failures. Arpaio blames the Feds and everyone else for his failures.

Hitler corrupted an entire country into believing his bullshit. Arpaio corrupted an entire county into believing his bullshit.

Hitler bankrupted his country during WWII (Germany finished paying for WWII in 2010). Arpaio bankrupted Maricopa County during his tenure.

Hitler loved to draw up sympathy with assassination attempts (Operation Valkyrie). Arpaio loves to draw up sympathy with fake assassination attempts.

Hitler sent the Gestapo to round up and execute those who defied or even disagreed with him. Arpaio sends his deputies to round up those who defy him or disagree with him.

Hitler ordered the starvation and killings of Jews and other people who are different and unique through his gas chambers and concentration camps. Arpaio uses his jails like concentration camps and orders the starvation and killing of inmates not even sentenced.

Kris Kobach's training that almost 1,000 deputies took after 287G was suspended, is even worse than ICE's training. Maricopa County Tax payers paid for that training.  ICE had nothing to do with it. ICE had nothing to do with the fake law Sgt Bret Palmer found on the internet, sent to Brian Sands and Arpaio spoke publically of as "justification." Perhaps, its because no cases heard in the Melendrez trial happened after 287G was pulled? Sweeps did with no changes though. Also, Snow called a stop to new witnesses/victims most likely because there was plenty of evidence and we would still be in court today hearing all of the cases.  


I do agree that ICE has benefited from Arpaio's racial profiling and assistance though. ICE needs to be reformed from the top down. The Border patrol also needs to be held accountable.http://acluaz.org/issues/search-and-seizure/2014-01/4418

The fact the ACLU and the plaintiffs nominated Warshaw for moniter and U.S District Judge Snow appointed him  is a victory in a long,long , battle with perhaps Arizona's most diabolical politician and lawman to ever be elected .And  now JOE wants to blame ICE for 287g training ,like that made him profile LATINOS....AND  I could be wrong , but I think over 1 BILLION dollars has been wasted by this Sheriff, crazy, and the them voters just keep electing him....

never heard of the guy before. his resume seems pretty impressive though. i gotta be honest though, a lot of people from both sides might be disappointed with him.. he sounds like a straight shooter, and by the book kind of guy. if people are waiting for him to pick apart MCSO, they may be in for a letdown. i think this guy WILL find problems, just not as many as we all would like to see him uncover. only time will tell and i am just waiting to see how things turn out. i think there WILL be many problems that are brought up by Warshaw, but in the end it will turn out to be a failure of leadership and not a corrupt agency, and that is something that can be easily remedied (after all, how long can a 80 some year old man lead...........................................or fail to lead in this case)

Well I cant see how the Hispanics along with their illegal brethren would be satisfied with this selection anything short of not having the Mexican Consulate overseeing M.C.S.O has got to be a big let down for them. Anyway in a few months when business resumes as usual and the illegals are being captured all the cheerleading for Warshaw will be turned into demanding his head on a plate.

Arpaio has strong ties to Racist Hate Groups like his former best pal J.T. Ready that do dirty work for Arpaio.

lmao ol joe apparently forgets he brought in Kobach to train his deputies..so, in reality the tab is ALL on him! NOT ICE. Had he hired a professional, instead of a racist from FAIR, then this could have been avoided. Had he had the communities best interest in mind, rather than his ego and political career, this could have been avoided as well.

@danzigsdaddy Good points. People forget that Melendrez only covered part of what is wrong with MCSO and Arpaio. It focused on racial profiling and driving mostly. The DOJ's lawsuit covers more but we will all be dead or retired by the time they do anything. UGH.

@robert_graham a biased monitor? please point out where you come up with that one Robert. i read the guys proposal and read his history. he seems to be biased in only one aspect and that is in restoring the image and integrity of agencies that have been damaged by people like Arpaio. he isnt even on the job yet here and you just assume he is biased. if you read up on the guy, he seems to have been quite effective in his job. why do you not want respectability and confidence restored to MCSO? why dont you take a minute to read up on the guy, you might be surprised. are you just assuming he is going to come in and say Joe is a worse criminal than Al Capone? are you just assuming he is going to come in and burn MCSO down to the ground? Joe has just been handed a golden opportunity to have a straight shooter come in and evaluate policy and procedure and the implementation of them. if there is nothing wrong, this guy will be right up there showing everyone that. but if there are problems, be assured he isnt going to lie or sugarcoat it. deep down inside you KNOW there is something wrong or you wouldnt be so opposed to a man coming who has proven himself to be more honest and respectable than Joe ever has or ever will be. you go right ahead and start your little web sites railing against Warshaw, you will be going against the only man left who can actually help Joe at this point

In other words, it's a really bad idea to have law enforcement agencies run by politicians.  When you elect a person to a job, you usually get ego and politics.

Most voters don't consider the Sheriff to be an important position, so they apply even less thought to it than to most other offices, giving a tremendous advantage to the candidate who's the best showman, and there are few people better at blowing their own horn than Joe.
