Phoenix Police Still Responding to Craigslist Ads for Medical Marijuana "Donations"

Despite New Times' discovery last month that Phoenix police are routinely using Craigslist to bust people offering to sell "medical marijuana" for the price of a "donation," the busts continue.

Even though some people post lengthy disclaimers in their ads, claiming that there's no pot sale going on, it's just a transfer of medical-marijuana between patients -- with a donation involved -- it's not preventing the busts.

Most of these posts even mention what the, um, suggested donation is -- like $90 for a quarter-ounce and $150 for a half-ounce. Now, why would police ever believe that marijuana is being sold?

In a recent bust of an alleged marijuana salesman, 31-year-old Andre Johnson, police note right in the probable-cause statement:
[State law] prohibits the exchange of anything of monetary value for marijuana. Anyone selling marijuana or receiving anything of monetary value is in violation of the Medical Marijuana Act
Many of these people police meet through Craigslist posts are operating outside the medical-marijuana laws in other ways, too.

When police caught up with Johnson -- who tried to run when he found out he had set up a sale with a cop -- they found out that he had more than a half-pound of weed in his apartment, near 25th Avenue and Cactus Road.

In addition to having more than the legal amount, Johnson also had a plant in his apartment, according to court documents.

In addition to these pot dealers making busts so easy that cops can do most of the work while sitting at a computer in their underwear, it also allows for another felony charge: Using electronic communication in a drug transaction. In Johnson's case, that was the third felony charge he was booked on, in addition to marijuana possession and marijuana production.

He has prior arrests for both marijuana and narcotic-drug offenses, according to court documents.

No matter how thorough your disclaimer is on Craigslist (example), you're really not going to win an argument with the cops that you're just transferring marijuana between patients, and there happens to be a donation involved.

Some of these ads don't even claim it's for a donation; they just list prices at the bottom of the post without dollar signs. Despite our previous warning that these busts were taking place, we have a feeling that people won't stop doing it, and cops won't stop busting them.

This is the very enabling behavior that will perpetuate the asinine classification and criminalization of herb.  It's all about the money and how it is used.  The whole cycle is so mutually beneficial to dealers, law enforcement, prisons and lawyers that make change so difficult as to seem impossible.

There is a petition circulating to Legalize Marijuana in Arizona.  Facebook 'Safer Arizona' for more information...

There is nothing stopping us from doing this now and getting it on the ballot in 2014.

The reason why people are selling on craigslist is because there is a market. Dispensary prices for Medical marijuana are more expensive than black market/street prices. A lot of Medical Marijuana patients are people who can't afford insurance and  constant doctor visits/prescription refills. It is so much cheaper to grow your own. But Arizona law states that you can not grow if you live within 25 miles of a dispensary. Which doesn't make sense, that law was written to make dispensaries money. Imagine if they made that law for everything, you can't change your car oil because your within 25 miles of a jiffy lube or you cant have an orange tree in your yard because you live within 25 miles of a grocery store. There are a lot of us who live on limited incomes, veterans,homeless, disabled etc. The dispensaries are all about the money, just as most business's at least on craigslist you can barter or trade and haggle. Everyone should have equal rights to grow, not just the business's.

 In one way, the War on Drugs is a good thing - its gets the dumbasses out of the way of us trying to conduct real businesses.  Ya got to be REALLY STOOPID to get busted for drugs.  Been selling since I was 12 years old - NEVER even got close to getting sniffed at by the cops.  No. 1 reason - I never sell to anyone on the first meeting - NEVER!  I always get a phone number and address and I deliver the product AFTER I check them out on the Assessor's office web page and do a little back ground on them.  If they've been busted before - they got police cooties and can not be trusted - plus, they're STOOPID to have got busted in the first place!

The biggest crime concerning marijuana in Arizona is the fact that a person can carry a "convicted felon" label for life for possession of a joint.

More "waste of time" arrests by Phoenix PD. Think about how much money will be wasted by the city and the county by the time this case is finished.

Good.  These morons deserve to be arrested for not following the law.  Hopefully, we can get the state legislature to repeal the law.  Yes, Marijuana should be decriminalized under both state and federal law.  Marijuana should also be free, it is a plant.  The transfer of Marijuana for US currency needs to be illegal under state law, as it is under federal law.  The lobbyists want the legalization of Marijuana for profit, not for the people.

@azmedicalbud its actually quite common in medical states that have had the laws on the books for a while.  Washington state Colorado and Cali have "donation" ads on craigslist everyday

@GratefulGrower The reason these morons advertise on Craigslist is that they are new at this and don't know where to move the merchandise. They have not yet grasped a central reality of dealing in pot: your stash is only as valuable as the amount of cash that can be had from your established clientele. You can be sitting on a boat load, but if you have no way to move it, it's just a white (or in this case green) elephant. A dealer's most valuable asset is not his pot: it's his distribution network.

Didn't the Pro Pot Activists and the Clueless Stoners themselves help write and support that?

Exactly what happened in Colorado, the Greedy Big $$ Dispensary Cartels and their high priced Marijuana McLawyer lobbyists -- like NORML -- manipulated and played the bong-baked stoners into supporting a COMMERCIALIZATION Model ... which stripped INDIVIDUAL Patients/Caregivers of any ability to Grow/Dispense a sustainable private supply of marijuana ... maintaining FELONY penalties against anyone who dared to infringe upon Dispensary Cartel profits.

The same IDIOCY is repeating itself in Arizona and other States, with naive ignorant stoners actually supporting dispensary cartel propaganda, which in reality runs AGAINST their own best interests.

@ExpertShotGood points except for the last one.  Way I was taught was just not to deal with people who had cases pending or are on active probation or parole. They're the ones who can be extorted most easily into becoming rats.

@DonkeyHotay The law wasn't originally written that way. It was changed the second year. Why or by who I don't know. I have lived in a few medical states, hawaii and oregon and they were both grow your own. I know a dispensary is good to have for those who cannot grow or those who can afford to pay the high prices. But for the rest of us living paycheck to paycheck, it's a struggle.  There is a No 25 Mile Rule petition which I hope will be able to reverse it back to it's original way. But for now, it's a struggle. We gotta make do and play by the rules.

I'm sure you didn't invite your customer's over to your house to sell them pot, so you must have possessed pot outsider of your home.  And if you did sell it only from your house then every one of your customers was stupid.

@marcy @Swoosh If you grow citrus trees, I am positive YOU are not selling the fruit, because that would be illegal. YOU are allowed to give the fruit away for free but you do not have the proper paperwork and business licenses to sell the fruit from YOUR tree as well as FDA approval.  

You seem to be THE poster child for the dangers of over using drugs.
