CBS 5 Reporter Claims Chronic Pain and Gets a Medical-Pot Card, Then Implies Wrongdoing

Reporter Morgan Loew, telling it like it isn't.
Hopefully you missed CBS 5's "investigation" into the state's medical-marijuana program, in which they claim that "young, healthy" people are getting medical-marijuana cards.

To prove it, reporter Morgan Loew, acting undercover, tells a doctor he's had back pain for months -- pain he said was "distracting." He couldn't tell the doctor whether the pain made it difficult for him to concentrate on things but admitted that it limits his ability to run.

Only select lines are included in the CBS 5 segment, but he later interviews the doctor, acting as a reporter this time, to question her recommendation.

"I mean, does that really qualify," he asks. "A sore back?"

Well, consider the fact that he started at a chiropractor's office, complaining about pain he's been having for months. He then complained about this pain to a doctor -- this "distracting" pain that's lasted for months.

Welcome to the 21st century, CBS 5, where complaining to multiple medical professionals about back pain that's been lasting for months -- apparently enough of a problem for you to consult these medical professionals -- doesn't get a prescription for "walk it off and rub some dirt in it twice a day."

After the doctor clarifies to Loew that, yeah, having back pain for months fits the definition of "chronic," he claims he "never said 'severe,'" as "severe and chronic pain" is a qualifying ailment for a medical-marijuana card.

The doctor explained that Loew's description was of severe pain, as she interpreted it.

Then, in order to get this card, Loew must have submitted the physician's certification, which the segment shows, zoomed in, has the "severe and chronic pain" box checked, then Loew must have signed and submitted a form attesting "that the information provided in the application is true and correct." So, in effect, Loew told the Arizona Department of Health Services that he had "severe and chronic pain."

Throw in an interview with Maricopa County Attorney Bill Montgomery talking about the evils of marijuana, get DHS Director Will Humble to fill in the gaps, and -- boom -- you have an "investigation" proving that people who are "young [and] healthy" (words that don't describe Loew) are getting medical-marijuana cards.

From reading these comments it's obvious they are mostly if not all from users of marijuana to stupid to realize the point of the article is to show how anyone that wants a card can get a card because the doctors submitting the form are unethical, don't know the "patient" they submit the certification at all, and are only interested in the money they make off them instead of the persons true medical condition. I for one hope this reporter gets a medal instead of charged with a crime, that the doctor has hi/her license taken away, and that all cards he/she signed off on are revoked. No one should get a card until they have known a doctor for more than 10 minutes, been properly examined with supporting tests results, and other alternatives have been tried first.

Unless it's significantly different there in AZ., lieing to a medical professional in order to fraudulently secure a prescription is a felony. This reporter is a criminal, and should be prosecuted.

So this "reporter" committed fraud and then cries foul??? I don't see how this is even news. If this guy lied about his condition how is a doctor to know? People do this all the time to innocent doctors to get dangerous narcotics. If anyone is at fault here it is the "reporter" and he should be charged with a crime if one has been committed.

As a non-US resident I am often a bit envious of MM legality in the States that allow it, but what really bothers me about this video/story is the way Loew downplays the level of suffering that can go along with "just a sore back".  There are people like me with chronic, longterm and severe back pain - it cripples, it takes away lives and it can lead to loss of mobility, severe depression and even suicide.  My back pain turned into Complex Regional Pain Syndrome, which is the most painful condition there is, according to the McGill pain scale - more painful than amputation of a digit without pain relief, more painful than childbirth without pain relief.  For him to sabotage the system that sufferers in other countries can only dream of makes me very angry indeed.

Rumor in the local scene is that many of our local narcs have obtained cards as well for use in their investigations of the MMJ scene. I wonder whether they will ever be held to account for that, too?

Marijuana does have medical benefits. Actually, so does alcohol. And heroin (opiates). Cocaine (ever wonder why novacaine has that caine at the end? They're the same drug class.) It's hard to be outraged when someone is being this incredibly stupid. Lying to doctors is not the same as finding a loophole or "proving" that people are exploiting the medical industry. But they are. You don't need to mince words on this. People that don't need marijuana are finding ways to get it through the MMJ system, probably because it's less shady, doesn't employ drug cartels and the product is much safer. So. Fucking. What. 

Let's drop the euphemism, shall we? During the days of Prohibition, there was medical alcohol. [1] That's laughable now. Marijuana on the other hand, is non-addictive and helpful for all sorts of ills. More power to the plant for use as a recreational lubricant. It's safer than alcohol and many, many prescription drugs, especially those in the opiate class. Oxycodone, hydrocodone and others are highly addictive and dangerous if abused and guess what -- people lie, including about back problems, to get them. This isn't even news!

Prescription overdose deaths have more than tripled since the 1990's.[1] How many people have died from marijuana misuse? Nada.

CBS 5 hasn't proven anything except that people lie, including their own stupid reporters. I see no harm here whatsoever.

What does it say about the need to lie or misinform to obtain access to legal means that are law abiding? Maybe laws have too difficult of steps to follow? Might we suggest no doctors note? Making decriminal all drug use might alleviate the need to lie about it? Maybe less paperwork is better?

I called him out on KPHO's fb page already. At the end of his report he stated he didn't misrepresent himself and I said if that is a fact post your 12month history with your PCP that you were seen for a back injury. He has yet to do it.

This is soooo dumb. Just because some people lie about ailments to get medication doesn't mean that medical marijuana is a sham. People lie ALL THE TIME to get oxycodone and hydrocodone (way worse than pot, and I don't see those drugs going away any time (anytime?) soon). Legitimate patients shouldn't be precluded from getting the meds they need because other illegitimate patients are willing to lie to doctors or on their medical forms.

Come on, people.  Lets be honest.  Just about anyone with a pulse can find a doctor to write an MMJ prescription which is why this whole thing is a sham.  If we want to legalize marijuana just legalize it already.  If not, lets stop playing this game that it's for "medicinal" purposes.  Yes there are those that benefit from it medicinally - I understand that.  But the reality is that the vast majority of MMJ users are recreational users who said what they needed to say to get the prescription.  Anyone who thinks I'm wrong is just deluding themselves.

When Marijuana does even 10% of the personal and social damage that Alcohol, a substance that requires none of what you mention yet is MUCH MUCH more dangerous and is legal.. then you might have a point

No one should have to hop through this many hoops for something as non-dangerous as MJ.

@squash I'm not saying that MMJ is a sham - I understand that it is very helpful and important to the patients that truly need it, such as cancer patients undergoing chemo. I'm saying that the system that we've set up is a sham.

And seeing as how we are talking about something that has never killed anyone in the entire history of the planet since the first humans started walking it and is safer than any other legal/OTC/prescription drug this matters why???? 

I agree we need to stop playing the game, the game of the failed drug war brought on by corporate masters and money for the legislatures, police forces, private prisons, big pharma, big oil and the religious zealots (read: Catholic/Christian hypocrites) so get in touch with every law maker you know and tell them to stop the game, since they are only ones playing it.

Hahaha... Sounds like the pot calling the kettle black. I have no clue how you can compare marijuana to alcohol but I guess that proves my point about most people posting here.

P.s. I am not against marijuana being used for medical reasons. I am against those getting it just because they WANT to get high rather than because they medically need it. And btw I'm not a drinker so don't think that's why I am saying there is no comparison.

The fact you have no clue about the comparisons, factual comparisons between MJ and Alcohol is laughable, since you are leaving posts about a subject you yourself state you have no clue about. 

Do some research next time before commenting, it will save you from proving to people how much of a fool you are.

People drink to get high, that is it's ONLY purpose and you support that yet rag on people wanting to smoke even though even smoked MJ is less harmful than Alcohol - that is a proven fact.

What a laugh riot you are... you don't smoke, you don't drink and you obviously don't know how to do research yet you rag on the people who are using it rather than the people who are using something much much more dangerous.

The only one being a hypocrite here is you.
