Dropping the Blood-Alcohol Level for DUIs From .08 to .05: Yay or Nay?

Yesterday, the National Transportation Safety Board recommended that a blood-alcohol level of .05 should be the new threshold for DUIs, instead of the .08 level in current state laws.

It's just a recommendation, but you'll note that thanks to grant money, all 50 since have implemented limits of .08 for drunk-driving, which was the previous NTSB recommendation.

"The NTSB concludes that BAC levels higher than 0.05 are viewed by respected traffic safety and public health organizations around the world as posing unacceptable risk for driving, and more than 100 countries have already established per se BAC limits at or below 0.05," the report says.

However, the board also notes that "levels as low as 0.01 have been associated with driving-related performance impairment," and "levels as low as 0.05 have been associated with significantly increased risk of fatal crashes."

Those statements don't make .05 sound like a huge improvement over .08, even though the board says the studies show there are fewer fatal crashes with the lower level on the books in other countries.

Given Arizona's harsh, harsh penalties for DUI, would you support Arizona moving to a new DUI threshold of .05?

Hell, just make it illegal to have ANY ETOH in your blood system while driving.  Shit you libs just love big gov'ment.  You get what you pay for --elections have consequences---this is not about public safety--if it were then ANY  among of detectable ETOH in your system while driving would be illegal.  This is about getting in your and my pockets as deeply as can be managed without utter rebellion.  PS:  I hope they, as well, make it illegal to drive with ANY amount of THC in your system.  Maybe then we will see how much you libs. love Big Government when the Po-Po be snappin you off for DUI-MJ.

Legalize marijuana and there wouldn't be such an alcohol problem here

Instead of running your mouth...what are these facts?? Tell me im incorrect!! Tell me the so called impaired people below.10 are the ones killing people...Go ahead and post those statistics that you DONT have right here for everyone to see!! Aww, thats cute Larry. I happen to know a shit ton about DUI stuff. Because you are so quick to judge, I will tell you this, I carry 24/7, so you can can your ignorance. Do read anything? Cops don't care if you have guns, if you have them legally. But, back to the DUI, learn a bit more about impairment and then talk to me. Because at the moment, your thought process is flawed and you are ignorant.

Your probably for gun control too nicole....right? Because that will fix it? The cops and goverment dont care...this is a financial windfall for them and a way to get more control over the population!! The drunk drivers that are getting into accidents and killing people do not have blood alcohol content readings anywhere near even .10 let alone lower! Your thought process is flawed and you are ignorant!! Brilliant comment Nicole!!

You are so right Albert, the dastardly CDC, the basis for all misinformation in the US. (Really?) I agree re. distracted driving...

First and foremost before asking if people are really that stupid please learn how to spell "apparantly" (sic). Second I understand that you believe everything and anything that the government says. Third all distracted driving should have the same consequences. Does it matter that you kill someone while texting behind the wheel versus while driving drunk?

I sure wonder what the alcohol level was for Sheriff Babeu's Drunken Deputy that punched a patron at the Fire House Tavern, then right in front of wonderful Sheriff Babeu, and Arizona's Skank Governor attempted to Flee in his vehicle to elude Tempe Police only to be stopped in the parking lot while trying to back out by Fire House Security?!!

A Hispanic would have been shot, and Killed in his vehicle, but Tempe Police didn't even test this Drunken Hot Headed Brawling "Fellow Officer's Alcohol Level?!!

This is just another way for out of Control Government to further Bust Down the Hard Workers in America, and Fleece more of our Hard Earned money.

If this was about safety don't you think Drunken Brawling, and Driving Police should be tested too?!!

Might as well repeal the 21th Amendment and allow the 18th Amendment to come back into force.  After all this seems to be the end point.

Considering the rate of alcoholism among LEOs, they might become their own best customers.

@Troy..we disagree as to the definition of "funny".

You know what's funny tho? 75% of those fatalities involved other drunk drivers. Seems like they're killing each other off.

To the mentally impaired that think that DUI's are just about $$ "In 2010, 10,228 people were killed in alcohol-impaired driving crashes, accounting for nearly one-third (31%) of all traffic-related deaths in the United States.1" (Really that stupid? Apparently so) http://goo.gl/nydtm

Yeah, because killing someone while DUI doesn't destroy lives, brilliant comment Darren. I'm in favor lowering it.

There is such a small difference between someone at .05 and .08. Such a narrow margin and still doesn't accurately tell the level of the driver's impairment. This is just a way to rack up more money while destroying people's lives.

If it's zero tolerance for operating a vehicle with marijuana in your system, the same should go with alcohol.

The NTSB is a complete and utter joke! They want everyone to think they are so interested in safety but yet do nothing about all the other distracted driving which has been proven to be as dangerous as drunk driving. This is just a play for more money and will great affect small businesses as people won't patronize their establishments out of fear. Our government is out of control!!!!
