Medical-Marijuana Destruction Bill Likely Dead, Says Lobbying Firm; Amendments Possible on Pot-Packaging Bill

State Senator Kimberly Yee's plan to let cops seize and destroy medical-marijuana at their whim appears dead, a political consultant for the dispensary industry says.

Jason Rose, previously a PR guy for the likes of Sheriff Joe Arpaio and Andrew Thomas, now counts among his clients the Regulated Dispensaries of Arizona Association. The burgeoning industry has been concerned about two of the Republican politician's proposals -- the seizure bill, SB 1441, and a bill that deals with the packaging and advertising of medical marijuana, SB 1440.

As we noted when Yee first floated the bills last month, the seizure bill allowed police to destroy seized medical-marijuana even when the patient had a legal right to possess it. For example, an officer who takes custody of a couple of ounces of pot during an investigation could learn that the patient's registration card was valid, yet would be legally able to destroy the pricey produce.

Rose says he believes that bill has died due to concerns that it might violate Arizona's 1998 Voter Protection Act.

That voter-approved law requires that any law enacted by citizens' initiative, (like Prop. 203), cannot be altered by the State Legislature unless it furthers the intent of the law. Even then, a change requires a two-thirds majority vote.

The seizure bill hasn't been scheduled for any more committee hearings, Rose adds.

Yee's worried the same thing could happen to the packaging and advertising bill, Rose says.

"Late yesterday, Senator Yee called our lobbyist and said, 'I think this bill could die -- let's get together and talk amendments,'" he says.

If the talks don't pan out, the Regulated Dispensaries of Arizona Association will "have no choice but to oppose the bill and try to kill it," Rose says.

The bill requires the state Department of Health Services, which oversees the medical-marijuana program, to "immediately revoke" a dispensary's license to operate if it packages or advertises its products in a way that "misbrands" or states that its use is for something "other than allowable medicinal purposes."

Amendments already adopted for the bill include: Requiring labeling of medical marijuana to use only black text on a white background; and requiring any medical-marijuana package to be white and opaque.

"The whole thing is about protecting children," attorney Kim McEachern of the Arizona Prosecuting Attorneys' Advisory Council told us yesterday. The council, a state government agency made up of prosecutors like Maricopa County Attorney Bill Montgomery and State Attorney General Tom Horne, is supporting the bill.

We  the people voted for it 2 years ago. Its so stupid, AZ could be making money off of it. Maybe they are making more money with citations DUI  possession, classes, interlock devices,.And of course you still allow people to Text and Drive. A person is not stoned if they smoked the day before.There are people that find this benefits to there health , instead of taking excess medication use. We do not have any say on what goes on in AZ. Politicization,s get away with DUI domestic abuse, hit and run, police get away with having sex with children. Who State is this anyway ?

Fact: the "medical" marijuana program is a SHAM -- everyone in the industry knows that the VAST MAJORITY of "patients" are merely recreational stoners using and abusing the "medical" initiative just to get high.

Yee's tenure will be done the next election cycle. Going against the will of the people is a death sentence in this state.

I am all for medical marijuana for the purpose of helping those with legit medical issues that marijuana can legitimately ease. The biggest problem I have with the entire issue is the flocks of fakers. Medical marijuana to be used for its intended purpose would have been passed many many years ago with little arguement if it werent for the presence of so many fakers backing the issue for their own personal gain. I know many who use pot casually somehow make the mistake of thinking their brains are enlightened and far superior to others around them. That is what makes you guys so obvious. The reality..and when I say reality I mean here in the REAL world, is you're fake concerns about sick people are entirely and completely transparent. You are hardly the brain childs your baked brain has convinced you you are. I'll admit I think Yee's bills are put together poorly and seem ametuerish. I do understand the concerns though. Her bills need to be scrapped and rewritten by someone who understands the issue. As far as Newtimes goes, I enjoy your articles because they make me laugh. Your "reporting" is slanted. Your agendas are obvious. Your skills as reporters are that of a child. "Journalism" is not to be found at your garbage paper. Why on earth would you have the nerve to be agased that Yee doesn't want to speak with you? Do you not READ your own articles? Perhaps if you came across as a real news organization she would give a rats ass to give you 1 minute of her time. Until then, NOBODY should feel 1 ounce of obligation to speak to you.

" Rose says he believes that bill has died due to concerns that it might violate Arizona's 1998 Voter Protection Act."  Since when has a political operative ever, EVER, been concerned with following the will of the voters or protecting the voice of the voters.  Oh, I know, when he's being paid to do so.  Now that he's being paid by the beneficiaries of Prop 203 he's all about comply with and protecting the law and protecting those voters who voted for it.

Seems to me that prostitute has more integrity than a political operative - at least a prostitute is honest about what she's selling and why.  A political operative - not so much.

Let's not forget that that act came about the first time Medical MJ was approved by voters, and the AZ 90 Dwarfs killed it from being inacted!

@pedro.dalion That's ONLY if we all have the BALLS to vote out even our OWN Representatives if they OPPOSE our Medical Marijuana program.  We've got to be willing to do the SAME thing we ask others to do in districts in which a Representative NEEDS to go!  But I can only HOPE that you're right.  This state is really weird.
