Jan Brewer's Not Changing Her Tune on Driver's Licenses for DREAMers

After three weeks of thinkin', Governor Jan Brewer's finally figured out what she's going to do about her order denying driver's licenses for deferred action beneficiaries -- nothin'.

Brewer's August order says that participants in the Deferred Action for Childhood Arrivals (DACA) program do not have "any lawful or authorized status and does not entitle them to any additional public benefit," which includes driver's licenses -- a thought the ACLU and others have said is false.

Media outlets including New Times have been checking in with the governor's office every so often to see if there's an update, and the Associated Press got it yesterday.

"Brewer says that didn't clear it up for her and she's standing behind her August executive order barring them from getting licenses," according to the AP report.

It was more than three weeks ago that the ACLU pointed to an updated guide for the deferred action program on the U.S. Citizenship and Immigration Services website, which gets into terminology related to immigration law, but seems to contradict Brewer's order.

It's not clear whether the ACLU -- which is involved in a lawsuit against Brewer over this very order -- is correct on its interpretation, but it does at least bring up what seems to be a good point that will likely be raised in its court challenge.

In Brewer's order, she states that the people in the deferred-action program do not have "any lawful or authorized status and does not entitle them to any additional public benefit," which includes driver's licenses.

According to the USCIS website:

"An individual who has received deferred action is authorized by the Department of Homeland Security (DHS) to be present in the United States, and is therefore considered by DHS to be lawfully present during the period deferred action is in effect. However, deferred action does not confer lawful status upon an individual, nor does it excuse any previous or subsequent periods of unlawful presence."

This is a point the ACLU has been arguing all along, as the lawsuit claims that Brewer's order essentially declares that people who are granted "authorized" presence are actually "unauthorized."

Only a handful of states have pulled a move similar to Brewer's, and only one of those states, Michigan, has reversed its policy in recent weeks.

Read my lips: NO DRIVERS LICENSES FOR DREAMERS.... period!  There's nothing more to discuss. File all the lawsuits you wish but when you bitch and moan about tax dollars being wasted, blame yourself because any lawsuits to get a drivers license would be a waste of time and taxpayer money.

Obama never promised his DREAMERs a drivers license same as he did not promise them the right to vote or citizenship.  He just gave them a work permit and a work permit is not an automatic ticket to a drivers license.  

But because there is nothing stopping any DREAMER from going back to the country where they were born to get a green card, do that and you can have a drivers license.  Or of course you can move to California where they are voluntarily giving DREAMERs drivers licenses.  But don't ever expect Arizona to give drivers licenses to those low class of people. This decision flies in the face of good fiscal management. As someone who purports to be a fiscal conservative this just doesn't make sense.

By allowing those with work permits to attain driver licenses it means that those folks can then LEGALLY drive themselves and others to and from work, where they will be LEGALLY having income taxes, social security and other fees withheld from their income. They will also be able to get at least liability insurance coverage (per Arizona law) and if they are in a crash that is their fault the other people involved won't suffer a loss, thus allowing them to spend their money on something other than vehicle repairs if they don't uninsured motorist coverages.

She's being a jerk, bottom line, trying to show everyone how tough she is. I suppose the next evil nickname from the state with be the world's toughest 'finger wagging, tongue lashing, immigrant hating' governor. It's just good that she doesn't feel this way about criminally insane rapists.

We have less than two years of putting up with her mush. It's going to be a very long less than two years, I'm afraid.

In the mean time she will be keeping state and private law firms employed.

She seems blind (or drunk) to the fact that AZ has issued about 40k DLs to people with deferred actions.

It's down to AZ and NE that are preventing the same for dreamers on deferred action.

A federal work permit is the only proof needed that the person isn't in the country illegally per AZ LAW.


Once again, Arizona will have to be dragged, kicking and screaming into doing the right thing by a federal judges order. Between Stinky Finger, Arpaio, Horne, and Montgomery, I wonder what the total is on how much has been spent defending their stupidity in the Court System?
