Raul Grijalva Has a Word or Two for Jan Brewer Over Executive Order on Driver's Licenses

Democratic Congressman Raul Grijalva says it's pretty clear that deferred action beneficiaries should be allowed to apply for driver's licenses.

Grijalva, and previously, the ACLU, have disagreed with the executive order issued by Governor Jan Brewer, in which she stated that Deferred Action for Childhood Arrivals (DACA) program do not have "any lawful or authorized status and does not entitle them to any additional public benefit," which includes driver's licenses.

The ACLU and Grijalva are pointing to a guide on the U.S. Citizenship and Immigration Services website, which gets into terminology related to immigration law, but seems to contradict Brewer's order.

"An individual who has received deferred action is authorized by the Department of Homeland Security (DHS) to be present in the United States, and is therefore considered by DHS to be lawfully present during the period deferred action is in effect," the website says. "However, deferred action does not confer lawful status upon an individual, nor does it excuse any previous or subsequent periods of unlawful presence."

That said, let Grijalva's smack-down-via-press-release of Governor Jan Brewer commence.

"Governor Brewer's executive order was callous pandering, and DHS is right to put social progress and our economy ahead of the tired politics of division," Grijalva's statement says. "The new guidelines confirm that young immigrant students brought to the country as children are authorized to be here. That debate is over. State lawmakers and agencies should immediately take note.

"This is not the first time Governor Brewer has been on the wrong side of a ruling," Grijalva continues. "Arizona cannot continue to invent its own immigration policies every time she reads a poll. It's cost this state too much. When the federal government, the business community, and neighborhood activists agree on the need for a new approach, maybe it's time for the governor to listen."

To further increase the burn factor on Brewer, Grijalva's office points out an Arizona Republic report, in which Brewer's office says it's "too early to say how the governor will respond" to the guidelines.

Brewer's office didn't answer New Times' request for comment, and 12 News' Brahm Resnik says the governor's office told him Brewer's "still deciding" how to respond.

If Brewer doesn't change her mind, a decision on the matter probably will come out of the lawsuit filed by the ACLU and other groups, which claims that Brewer's order essentially declares that people who are granted "authorized" presence are actually "unauthorized," which would seem like an unfair thing to do.

"As stated by Defendant Brewer, the Executive Order makes clear that there will be 'no drivers licenses for illegal people,' and in her opinion, '[t]he Obama amnesty plan doesn't make them [legal] here,'" the lawsuit states. "Defendant Brewer's Executive Order reflects her apparent disagreement with the federal government's decision to allow young immigrants who qualify under the DACA program to remain in the United States."

Giving valid breeder documents such as driver’s licenses to invaders is insane. Breeder docs open the door to all sorts of nefarious activities these law-breaking parasites can engage in..... credit fraud, mortgage fraud, etc…… after all, these despicable leeches have no respect for US laws to begin with. It’s also a threat to national security. These arrogant miscreants need to be rounded up and deported, not rewarded with privileges.

Raul Grijalva is probably the worst person to criticize another for pandering.

It wasn't long ago when this newspaper, it's writers and most of its readership were critical of Brewer for this excutive order simply because it was redundant and unnecessary.  There were already laws in place that prohibited this "special" group of people from receiving licenses.

It won't matter, however.  In a few short months, the 2 year window will be closed and those who willingly admitted they were here illegally will be deported by the same agency they revealed themselves to in order to benefit.

This woman should not be making decisions based on her ignorant "opinions". Part of her job is to make decisions based on the LAW & to ensure its being followed wether she agrees with it or not. I disagree with the lawsuit stating that Brewer's EO "reflects her apparent disagreement with the federal government's decision..."

It should state that Brewer's IQ reflects that she in "incapable of understanding the federal government's decision..."

There has been 10's of THOUSANDS of AZ DL's issued to people with a federal work permit, with deferred actions.  Like people busted by Joke, who request a deportation hearing, which can take 3 years.

The ONLY ones with deferred action being denied an AZ DL, are the Dreamers.  Brewer KNOWS they are better educated than she is, and is mad!

I mean seriously.  A kid that was brought here at 5 years old, and is now in in college, and knows no other county, is a risk?  To WHO??

No doubt, this issue will be decided by the courts. When does Arizona make any meaningful progress when it isn't ordered to do so by a Federal Court?

@WhoKnows Deferred action must and will stop.  Either those people return to Mexico voluntarily or they should be removed from the country in a pine box.  No, AZ licenses have not been issued to those people legally.  Becuase illegal aliens are famous for ID theft, any licenses issued were done so fraudulently.

AZ law clearly says that illegal aliens cannot have drivers licenses and DREAMER's are still illegal aliens in the eyes of the law because the Deferred Action program does not lead to a path to citizenship. Obama already said the decision is up to the states and not the Government.

You may not like it but it is what it is & if you were so intent on making sure the state laws were followed you'd just accept the fact that there is a new law and move on. I don't think so. Republican Senator Marco Rubio has already begun proposing an immigration overhaul bill that's very similar to the DREAM Act.

It will pass or Republicans will never hold political office again.

BTW, Ronald Reagan, a Republican, provided amnesty in 1986.

Everything I've read states quite the opposite & I've checked over 9 different sources. Also I'd like to see the source that states the statistics on illegal aliens and ID theft please.
