Bill Montgomery Entertains "Birther" Over Joe Arpaio's Probe of Obama's Birth Certificate

As evidenced by Secretary of State Ken Bennett's dabbling in the "birther" theories, elected officials around the state have probably received a decent amount of phone calls and emails asking them to help further the embarrassment of Sheriff Joe Arpaio's "investigation" into President Obama.

One such recipient of that attention is Maricopa County Attorney Bill Montgomery, who's actually taken the time to respond to at least one of the conspiracy theorists.

The Maricopa County Attorney's Office provided some of Montgomery's e-mails in response to a New Times records request, including a conversation with Brian Reilly, a "tea party leader" from Surprise.

In response to Reilly begging Montgomery to assemble a grand jury to review Arpaio's findings, Mongtomery lets him know that's probably not going to happen, since he doesn't think he has jurisdiction.

"From the Sheriff's Office investigation into suspect documents produced by the White House to date, that investigation has not revealed any evidence that conduct occurred in Maricopa County," Montgomery writes. "I have discussed this with the Sheriff."

Montgomery continues, "As for any issues regarding qualifications or information provided regarding the Presidential Election itself, that is a statewide election. Under Arizona law, the Secretary of State and the Attorney General have jurisdiction over statewide elections. I do not."

Montgomery also wrote a delicately worded response to Reilly's request that the county attorney charge nobody in particular with "fraudulent schemes and practices," a charge similar to forgery or fraud.

"Specifically, we would need evidence to affirmatively prove that Mr. Obama is not a US citizen," Montgomery writes. "To date there has been evidence presented leading to speculation that documents have been forged and other documents do not exist. That alone, though, is not sufficient evidence to present to a grand jury and actually have a reasonable likelihood of conviction."

Additionally, even though Arpaio's continued to insist that there's "probable cause to believe forgery and fraud occurred" with Obama's birth certificate, Montgomery appears to dispute that.

"I will share with you, as well, that the criminal statute you cited in your message requires additional evidence that the MCSO investigation to date has not uncovered," Montgomery writes.

Reilly continued to write back to Montgomery about the definition of a "natural-born citizen," although Montgomery's responses were mostly, I'll take a look.

Montgomery did assure Reilly that he'll prosecute a case submitted to him if there evidence is there -- "regardless of who the suspect/defendant may be."

Since the President is a federal employee, any bullshit birther claims should be made to the FBI and the Justice Department.

 

I'm actually surprised that MontyPug did his job and told the birther to piss off. That's one of the smarter things MontyPug has done (lucky us, he's out in 2 months!)

 

Now that the MCSO shurf and his bullshit birther 'investigation' has been shut down, can we resume business as usual in NaziCopa County?

Definitely a step up from his predecessor.  An incremental improvement, if you will.  Still not the best person for the job and still many issues to be addressed, but better than the person in the seat before him.

So, all this time I've been saying that NO COUNTY SHERIFF in Arizona has jurisdiction in this matter. Mr. Montgomery has confirmed it with his letter.

 

NOW, why won't the Maricopa County Board of Supervisors issue a directive to the MCSO sheriff, an elected official, to STOP spending taxpayer money on ANY AND ALL INVESTIGATIONS where he has no authority or jurisdiction?

 

Instead, perhaps the MCSO shurf could spend some taxpayer money on providing the services HERE in Maricopa County, that we expect and deserve.

 

Now that it's public, from the county attorney, perhaps the Board of Supervisors will show some intestinal fortitude. This way they can blame the county attorney and he will be the one who is next intimidated and harassed, instead of the Three Weenies...

 Because the Board of Supervisors can't (and shouldn't) dictate enforcement priorities to a fellow elected official - the Sheriff.  In a normal world that would be fine and actually give us comfort.  Unfortunately, Maricopa County is not a normal world.

 @Susurro_Perforado Monty isn't an idiot and he knows who butters his bread, witness his Fiesta Bowl "investigation" and his lame slap to Horne's wrists.  I wouldn't call him the "best, smartest politician in Arizona" though I'd say he's probably one of the smarter Republican politicians in Arizona.

 The BOS DOES have the authority to tell the elected sheriff he is NOT allowed to spend his budget on items outside his authority and jurisdiction, which the whole birth certification issue is. This is a financial edict, not an enforcement priority issue. If MCSO had jurisdiction in this matter, which it doesn't, then the BOS could not tell the shurf what to do. Much like they can't tell him to stop all the bogus employer sanction raids. Yes, Maricopa County is anything but normal.

I think YPS is right on this one. The BOS gives the Flaccid Fraud his budget of $270M, and they have no authority to direct him on how to spend the money.

 

I did not find any Arizona Revised Statute that gives the BOS the authority to direct the MCSO shurf how to spend the money.
