No Charges for Arpaio: U.S. Closes Criminal Investigation of Maricopa Sheriff and Former County Attorney Andrew Thomas

The U.S. Attorney's Office in Arizona announced today it won't pursue criminal charges against Maricopa County Sheriff Joe Arpaio, his employees, or former County Attorney Andrew Thomas.

The U.S. Attorney's Office announced today that it has closed its investigation into criminal conduct by Maricopa County Sheriff Joe Arpaio and former County Attorney Andrew Thomas with no charges against either man.

The announcement came after 5 p.m. on the Friday afternoon before the Labor Day weekend -- apparently to avoid as much blowback as possible.

Former employees of Arpaio and Thomas, like fired Chief Deputy Dave Hendershott and prosecutor Lisa Aubuchon, also will escape criminal charges..

Here's what we received moments ago:

PHOENIX - Ann Birmingham Scheel, acting on behalf of the United States due to the recusal of U.S. Attorney John S. Leonardo, announced today that her office is closing its investigation into allegations of criminal conduct by current and former members of the Maricopa County Sheriff's Office and the Maricopa County Attorney's Office.

The U.S. Attorney's Office has advised Maricopa County Attorney Bill Montgomery of its decision not to pursue state criminal charges related to the investigation.

Ms. Scheel commended the joint investigative efforts of the prosecutors and the FBI special agents who conducted the investigation.

Game over. No more wondering if the feds are going to haul Arpaio off for whatever crimes he may have committed.

Do we think a criminal case could have been made? You know it.

From arresting New Times executives at night under bogus pretenses to entering into an "unholy collaboration" with Andrew Thomas (who was disbarred for his unethical actions) to blatantly 

 targeting of political enemies to his "I was duped" remark about his former chief deputy's alleged crimes, Arpaio hasn't been held accountable by anyone.

Especially voters, who appear poised to re-elect him to a sixth term.

The investigation had never been officially acknowledged by the Department of Justice or the U.S. Attorney's Office -- though it is believed to have been going on for more than three years. In January 2010, the probe was widely reported when witnesses were summoned to a grand jury to talk about Arpaio's alleged abuse of power.

But now it's over, with November's election looming.

With Arpaio's long list of serious moral and potentially illegal lapses of judgment, this absolvement of the sheriff no doubt will assure the rest of the country that this really is the Wild West, where anything goes.

Andrew Kunasek, one of five members of the county Board of Supervisors and a victim of Arpaio and Thomas' vendettas, is furious about the decision, which he calls "an assault on our system of justice."

A State Bar of Arizona investigation against Thomas, plus an internal investigation of Arpaio's office by the Pinal County Sheriff's Office, proved that Arpaio and Thomas' offices cooked up phony charges against Kunasek for approving a $14,000 sweep of county offices for listening devices.

One of the more riveting pieces of testimony during the Thomas proceeding last year was when Kunasek recalled a phone call from prosecutor Tom Liddy, who warned that Hendershott was targeting him in a plot to neuter the Board of Supervisors, which had been trying to rein in Arpaio's reckless spending habits.

"That Hendershott and Aubuchon are walking away from this -- I think it's a scourge on the Department of Justice," he fumes. "I am pissed at [U.S. Attorney General] Eric Holder. His inaction here is a terrible abuse."

I guess this is the big difference between PROFESSIONAL law enforcement and prosecutors like the DOJ and FBI and hacks like the MCSO and MCAO.  The FBI and the DOJ, as professionals, refused to capitulate to calls for politically motivated charges and announced that they will not bring charges because they don't feel that they have sufficient evidence to assure a conviction.  Hacks like the MCSO and MCAO (led the whole time by Arpaio) were more than happy to bring politically motivated charges that had no basis in fact or reality that would never have earned a conviction. 

 

While I am saddened by the decision by the DOJ, I understand their obligations as professional prosecutors and appreciate that they are not cow-towing to the political desire to charge Arpaio without the likelihood of conviction.  I understand that they are obliged to comply with federal charging standards that require there to be sufficient evidence to obtain and sustain a conviction prior to the filing of any criminal charges.  Unfortunately, Arpaio demonstrated that he felt no similar ethical or moral contraints in the way that he abused the power of his office to pursue his political enemies.

 

For all of you Arpaio worshippers out there - the FBI and DOJ just demonstrated the way that professionals do their jobs.  Take a lesson because the failure that is in charge of the MCSO is so far from being a professional that it defies belief.  Also note that these are not charges that were dismissed with prejudice - this is an investigation that was closed and can easily be re-opened if newly discovered evidence warrants it.

 

Again, this decision by the DOJ and FBI simply highlights the differences between the professionals that they are and the hacks that currently run the MCSO and MCAO.

Arpaio via his attorneys used an expert witness that engaged in felony impersonation of an attorney when he testified in another police misconduct case in federal court.  With the vast county funds paying for his defense, you would think Arpaio could dig up an expert witness to lie with a bit more style.  A felon scrapes the bottom of the litigation barrel.

Where is the retraction from Phoenix New Times for articles they have published on both Sheriff Joe and Sheriff Paul?   They have BOTH been CLEARED by experts, which everyone knew they would be as they did NOTHING wrong. The grand jury very likely would not have issued a TRUE bill: meaning that the Old Fool and Candy Andy Thomas would not have been indicted.

 

Speaking of: I wonder if Candy Andy ever got his chance to speak to the federal grand jury about the abuses of power? I heard he e-mailed Scheel and asked her for an opportunity to speak to them about this issue?

 @MaskedMagician1967 I hate to disappoint you but the fed's ongoing investigation of Arpaio will suddenly come to a halt too in about a week or sooner.  Arpaio's office is not guilty of what you call "racial profiling" simply because he cannot pick and choose who to stop and question about immigration status.  It seems that in Maricopa County the only suspected illegals are Hispanics.  The problem is that Hispanics want that free pass to violate the law and think they should not be stopped simply because they are Hispanic.  Well it doesn't work that way.  Hispanics are not entitled to a free pass.  Even if an officer pulls Hispanics over just because they are Hispanic, the stop happens because a law was broken, so be it!  And if you think that Penzone will win you are going to be disappointed.  Arpaio is going to win re-election especially now that charges against him have been dropped.

 @wrangler they havent been cleared, the investigaters just said they didnt have enough to prosecute with. there is a BIG difference. it doesnt clear anybody of anything and it also doesnt convict them either. the case can easily be brought back up if more evidence is found to support the charges.

Plenty of prostituting attorneys drop charges or table investigations because of insufficient evidence. Ever hear of Al Capone? Took them years to build a case and then it wasn't for any of the murders or bootlegging: it was for tax charges. I figure Arpaio is about as innocent as Capone was.
