Bill Montgomery Declares War on Medical-Marijuana Law; Craves Arrests of Patients, Caregivers and Dispensary Operators

Bill Montgomery can't wait to prosecute medical-marijuana patients and caregivers.

Maricopa County Attorney Bill Montgomery understands that voters passed a law legalizing medical marijuana in Arizona, but he still wants to bust patients, caregivers and dispensary operators.

Montgomery said this week that his interpretation of the Arizona Medical Marijuana Act is that anyone growing marijuana, whether or not they are registered with the state, can be prosecuted. Likewise with people selling marijuana, such as the operators of a dispensary. The Republican county attorney also believes the Arizona Legislature can legally ban all abortions, despite Roe. V. Wade.

In an interview on KFYI (550 AM) this morning, Montgomery said "federal law" so often, it sounded like a mantra. He can't simply squash the rights of state voters like he wants, though -- a state court has to agree with his interpretation.

Bill Montgomery was taught as a cadet at West Point that the "rule of law matters." He used that point this morning to explain why he wants to ignore state law.
As we mentioned on Monday, after state Attorney General Tom Horne issued an opinion that much of the voter-approved law conflicts with federal law, Montgomery is hoping the case of a would-be Sun City dispensary will be the "dam" that blocks up the pot program.

"I'm drawing a line," Montgomery said. "If people don't want me to draw that line, they need to choose somebody else."

But choices are limited. The Democratic Party didn't put up an opponent this year against Montgomery, a staunch, yet hypocritical, supporter of Sheriff Joe Arpaio and the Tea Party. He'll be facing only Libertarian Michael Kielsky in the general election.

Let me shoot a few holes in Bill Montgomery’s legal OPINION against Medical Marijuana patient’s ability under prop 203 to grow their own Medication.  First off Mr. Montgomery is about to cost the state a considerable amount of revenue loss due to the suits that will arise out of his selective enforcement campaign against prop 203 AUTHORIZED medical patient growers.

First I will point out that he states it isn’t for political reasons, the same as the Governors suit brought to the Federal Government wasn’t political,, yeaaa, riiight.

 

Mr. Montgomery states that possession and uses has been effectively decriminalized by prop 203 for a narrow few that have cards, and that they will not be targeting patients who possess or consume medical marijuana.  Ok I’m good with that so far.

 

He states he will shut down dispensaries, that’s a grey area for me, that’s the feds job, not his.  With that said the Feds have warned dispensaries, and are not OK with them as they have warned in Federal memos.  On the other hand in those memos have spelled out that caregivers and patients cultivating under the strict state guidelines will not be targeted. Here’s where it all comes together, Bill states Federal law prevents cultivation by patients, well Bill check the federal laws (which I’m sure he already knows) simple possession of one joint is against federal law. 

 

How is it that he has unbridled discretion to state prop 203 decriminalized possession but not cultivation for a narrow few who are in compliance with state law.  Perhaps the Feds know current marijuana laws are archaic.  Yes we still have plenty of archaic laws on the books. Bill was asked by a reporter if he is trying to make patients obtain their meds from the black market ( Mexican drug cartel) he said the drafters of  prop 203 failed to address that issue, well not they didn’t , patients were allowed to grow their own. If it isn’t politics, is he getting greased from the Mexican cartel?

If Montgomery were more than hot air, he'd have busted a few of us and be working on test cases already. He can't be so ignorant that he or his narc associates haven't seen the open advertisement of MMJ. Many of our people are right out there in public. More are a bit more discrete. Montgomery figures he'll get his ass handed to him in court, though. He doesn't have the balls to risk setting an unfavorable precedent. Typical prosecutorial discretion I'd say. So keep blowing that hot air, Bill. Hardly anyone gives a rat's ass.

 @tromulus interesting, I have had conservatives applaud my plans for having a sin tax on pot and selling it. IT would create revenue for a broke state, and allow sick people to get their medicine. I am sure the extra little bit the tax cost added to the price the people would be willing to pay. Hell I might even buy some just to get some money into this state....

The Feds have given warning to dispensaries in all states at the same time reassuring caregivers and patients they won't target them so long as they are in strict state compliance.  I'ts illegal under federal law for one joint, so how can Bill say possession has been decriminalized by prop 203 but cultivation isn't?  Thats unconstitutionalleave the federal job to the feds, he needs to argue state law and he has already publicly stated that possession is now legal for cardholders, so to then should be cultivation by patients.  @dmclain7 No one said that I'd like for PPD to run sting operations on patients.  I think that's DEAD WRONG!  BTW... look around for a lawyer...  There's NUMEROUS lawyers that would take your case just to set a PRECEDENT if it's a strong case.  If the ARRESTEE did something outside of the Prop 203 language, they SHOULD get their pecker smacked!  But NO, I want them ALL out of OUR lives!

 @ptcgaz If you would like to add a "sin tax" on marijuana then DON'T call it "Medical".  I'm ALL for a 'Sin tax" on marijuana just like Alcohol, as long as it's TREATED like Alcohol and Tobacco.  That means it MUST be totally LEGAL for anyone over the age of 18 to be consumed just like Alcohol and Tobacco.  You can't just put a TAX on something and label it a "Sin Tax" if it's NOT totally legal to begin with!
