Pastor/ex-gang member Michael Salman's trying everything in the book to get out of Tent City after his 67 misdemeanor convictions -- and possible probation violation -- and he's down to his last straws.

Salman's trying to get work release to work at his restaurants, Might Mikes Burgers, both of which are located in Phoenix.

On the plus side, Salman actually has work to do, especially after the health inspectors continue to note that they need Salman to take care of some violations and certifications.

"He wishes to be released for the maximum permitted hours and days each week to perform his job duties at his family -owned and -operated restaurant, where his duties consist of managing the business, cooking, and serving as a cashier or waiter as needed," Salman's attorney wrote in the motion. "Defendant Salman is the sole manager of the business, which relies on him completely for its operation. Suzanne Salman is not able to take his place in this regard, as she is fully occupied in caring for their small children."

On the other hand Salman's rap sheet isn't exactly pristine.

Salman once served a six-year prison sentence for a drive-by shooting, during which he was caught with LSD. He was also once booked into jail for impersonating a police officer, and he likely violated his probation for his most recent convictions, in which he wasn't allowed to have huge gatherings of people in his "church."

He probably could've escaped a jail sentence had he not continued to refuse complying with the City of Phoenix's zoning ordinances, but here he is, a couple weeks into a 60-day sentence.

That said, should Salman be granted work release?

Hey at least he wasn't praying to some dumb-ass statue of a Mary propped up in some field with the wording PROTECT US or whatever it says like you'll find on Central about a half mile from Baseline.  But if he were holding Mexican Bile studies instead you would all demand his release hasty pronto and riot if he wasn't let go..

If Salman should not be granted work release, why should illegals be released at all?  Seems everybody is moaning and groaning about letting illegals go but yet they don't want a man jailed for holding Bible Studies released?  So tell me who's racist now. LET HIM OUT GOD DAMN YOU!

Trying to figure our your obsession with this guy.  As annoying as his antics might be, is this guy really worth the time and effort that you've put into tracking his case and his attorney's pleadings?  Surely there must be more urgent issues in the Valley that are worth your attention and wrath than this piece of sand in the gears of the machine.  Don't get me wrong, I'm no fan of this peice of work, but surely there must be something more urgent important that you can spend your time on.

What a load of bullsh*t.  One guy does not cook, cashier &/or wait tables at 2 different locations at the same time.  I have been by the Indian School Mighty Mikes and it seems to be fine without him there.  If the business can't survive without him then his wife should hire someone.  (preferably with a food service card)

Unfortunately, you have no idea what you’re talking about from either a legal or constitutional perspective.  Let me spell it out for you and I’ll try to use small words so you can understand.  Section 1 of the 14th Amendment states,

 

“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

 

This Section contains 3 directives.  The first is that no state shall make any law which abridges the privileges or immunities of CITIZENS of the United States.  The second is that no state shall deprive any PERSON of life, liberty or property without due process of law.  The third is that no state shall deny to any PERSON within its jurisdiction equal protection of the laws.

 

I’ve capitalized the terms CITIZENS and PERSON because they create a meaningful distinction.  Where the drafters intended certain rights to apply to just the citizens of the United States, they specifically said so.  By applying the second and third directive to “any person,”  the drafters clearly intended that these rights had broader application and applied much more broadly than to just citizens.

 

The United States Supreme Court has held for 150 years that the second and third directives apply to all persons that are subject to the jurisdiction of the state in which they are located.  Clearly an illegal alien is a “person” regardless of how you define the term and regardless of their immigration status.

 

There are some on this site that are in favor of open immigration.  There are others, like me, who are opposed to open immigration and agree that illegal is illegal – however, I feel even more strongly that it is a much greater wrong for a law enforcement officer that is imbued by the state with police powers to violate the plain language of the Constitution of the United States.

 

When MCSO deputies and your hero Arpaio blatantly thumb their nose at the Constitution and the Bill of Rights by violating, among others, the 14th amendment through depriving of liberty without due process and denial of equal protection based on skin color and national origin.

 

You may feel that the ends – violating the rule of law – justifies the means - removing illegal aliens - but so did many dictators throughout the ages.  The hard truth, though, for those of us that love our liberty, is that illegal is illegal – especially when it comes to violating the Constitution of our fine country
