Peter Spaw, Deputy County Attorney, Focus of New State Supreme Court Probe Stemming From Andrew Thomas Case

Peter Spaw, a deputy county prosecutor with the Maricopa County Attorney's Office, is under investigation in the same case that resulted in the disbarment of former County Attorney Andrew Thomas.

County prosecutor Peter Spaw is the subject of a new ethics probe related to the same case that resulted in the disbarment of former Maricopa County Attorney Andrew Thomas.

The state Supreme Court's Attorney Discipline Probable Cause Committee has found probable cause to investigate allegations of misconduct against Spaw, the court announced today. John Gleason, the Colorado attorney who investigated the unethical actions of Thomas and his former underlings, Lisa Aubuchon and Rachel Alexander, will work the new case.

Aubuchon was also disbarred, while Alexander was suspended for six months and a day. Both women are appealing the decisions; Alexander is allowed to continue practicing law during her appeal.


The probable cause order doesn't get into specifics. But during lengthy hearings last year before a three-member panel, Spaw was alleged to have supervised Alexander during her work on the now-discredited federal racketeering lawsuit launched by Thomas and his then-ally, Sheriff Joe Arpaio, against judges, county officials and others.

Following the conclusion of those hearings, a State Bar spokesman told New Times that Spaw was the subject of a "pre-screening inquiry" because of the allegations. That screening has now led to a full-blown investigation that could result in disciplinary action against Spaw.

Spaw's also named as a defendant in a civil lawsuit by deputy county manager Sandi Wilson and former judge Gary Donahoe, who were among the targets of Thomas and Arpaio.

Considering what happened to his co-workers, Spaw might want to start planning for a suspension of his own law license.

Spaw is a stand up guy with great ethics and a darn good attorney. I challenge any of you to disobey direct orders from your chain of command (boss) and see where that gets you. Spaw isn't an "appointed" figure at the County and it's unfortante his name got messed up in bad politics.

No I am not an ex-boyfriend of Rachel's (thank God.) I'm not a fan of Rachel because I think she could've stopped the runaway abuses of power emanating from the MCAO and MCSO and she didn't. She followed her orders like a good Nazi and as a result, Maricopa County taxpayers are paying hand over fist for lawsuit settlements and jury awards. During the ethics hearings, Rachel looked disheveled. Her hair in particular was really oily and greasy. I saw a video of her on her blog site and immediately disagreed with her positions and views. Personally, I think Rachel can be a good lawyer if she gets her head out of the clouds, doesn't abuse her power and focuses on her clients. I've never met the Supervisors but I think they have legitimate complaints. I mean, Lisa personally told me she knew the statute of limitations expired on the Stapley cases. But that is just my opinion.

Masked Magician, you commented on Rachel Alexander's physical appearance so I thought maybe you were a disgruntled ex-boyfriend or someone who knew more about her. I talked to Rachel once about the RICO case and she seemed innocent to me, so I thought maybe you had some inside info I didn't know about. I have a real problem with the Maricopa County Supervisors, they screwed over a business partner of mine, so I have never bought into their complaints against her and Andrew Thomas and Lisa Aubuchon. I think they are vindictive greedy bastards!

What would you like to know? Everything I know comes from Rachel's other partner in crime, Lisa Aubuchon. Lisa Aubuchon is the who told me all about how she, Thomas and Alexander knew the RICO lawsuit was bullshit. Spaw told Alexander that the RICO lawsuit did not contain one allegation of racketeering. Aubuchon filed it the first time, while Alexander filed it a second time after changes were made. The U.S. Attorney's Office reviewed it and rejected it only after it was dismissed from federal court. Personally, I wouldn't retain Rachel Alexander to fight a speeding ticket.

Hmmm....let's see. Thomas and Aubuchon have already been stripped of their law licenses and Alexander will get a suspension.  But Alexander claims she got direction from Spaw since he was the "RICO expert".  Now Spaw is being investigated for misconduct. Any bets as to whether Spaw spills any more beans about other misconduct in the MCAO?  You think he'll go down alone?  Me thinks not.

Peter Spaw had an ethical responsibility to act when it came to filings like the ridiculous RICO lawsuit.  Instead, he complained to Andrew Thomas, who dismissed his concerns with the wave of a hand.  Spaw, as a licensed attorney, should have contacted the Attorney General on a matter like this. At least he would have been protecting himself.  He could have FLAT REFUSED to mentor Alexander in this witch hunt. I say that he'd better bone up on his research skills - because I smell a demotion to law clerk.

Why is Spaw facing an investigation? I recall Spaw telling Rachel Alexander that the RICO lawsuit had absolutely no merit and should be abandoned. Hell, even Barnett Lotstein said the same thing. I wonder if Spaw will get the county to pay for his lawyer if he is found to have violated his ethics? If so, we're on the hook for yet another expensive trial. Get ready to open your wallets Maricopa County taxpayers...

I met Rachel Alexander at Pachyderm Coalition meetings and she was always well-groomed and her hair looked perfect. Perhaps the lighting was bad in the video of her trial. She does not have greasy hair. You might want to attend a Pachyderm Coalition meeting and meet her so you can see for yourself. It might change your mind about saying those things about her physical appearance. It makes you appear rude and mean and like you have a vendetta against her, which is odd considering you have never even met her.

Everytime I ever saw Rachel, she looked like a hungover college student who was late for her morning classes - just-rolled-out-of-bed-no-time-for-a-shower-pulled-her-clothes-off-the-top-of-the-laundry-heap. Is that really the way one wants to present themselves professionally? Sloppy appearance,sloppy work product. Just sayin'.... @alicia.gegner
