Tempe PD: Man Shot, Killed After Argument Over Playing Loud Music at Apartment Pool

A 20-year-old man was shot and killed this morning after an argument over loud music at a pool inside a Tempe apartment complex, police say.

Two people are currently being held for questioning in the shooting death.

Tempe Police Sergeant Jeffrey Glover tells New Times police got a call about a noise complaint at an apartment complex -- the Haven Luxury Apartments near Broadway Road and McClintock Drive -- around 2 a.m. today, which turned into a call about shots fired as officers were responding.

Glover says officers close to the scene actually heard the gunshots.

"Apparently there was a resident there that had confronted the subjects in the pool area that were playing some music, and a fight ensured," Glover says.

That fight ended with one of the people shooting the 20-year-old man who was among the people with the loud music at the pool, Glover says.

The man was treated at the scene, then transferred to the hospital, where he was pronounced dead.

The man police believe fired the shots is currently being detained for questioning, as is another person, Glover says.

Witnesses are still being interviewed as well.

The identity of the 20-year-old man has not yet been released, as his family has not been notified, and Glover says the man was not a student at Arizona State University, which is nearby.

I harbour no sympathy for idiots who have no respect for it's neighbors. Especially the dude who was shot at the pool. If I lived at that apt complex and my unit was near the pool, I too would feel irritated by loud music blasting at 2am in the morning.

But it seems the law turn their heads went a young black man was killed turn it around and Gab would talked about like dirt.  He did not kill anyone for loud music, he killed someone because they attacked him and he had a reasonable fear for his life.

He went out to ask a bunch of inconsiderate thugs who were trespassing in the pool area to turn down the music at 2 AM on Monday morning.  They obviously took offense and attacked him.  He had every legal right to carry a gun and it turns out his fears were valid.  More importantly, the people who attacked him were obviously assholes and thugs otherwise the situation would have never occurred in the first place.

As far as GOD is concerned: I have news for you, I don't think god looks too kindly on drunk thugs who disrespect their neighbors with profane music in the middle of the night and who gang up and attack innocent people who ask them to turn it down.  Seems to me that god was on the side of Leavitt that night, otherwise the situation would be reversed.

 The loud music is only part of the problem.  What really caused this issue is when "Gabe Nikey Knuckles Batten" and his "boys" chose to attack an innocent neighbor when he asked them to turn the music off.  If they had a shred of human decency none of this would have happened.

He only shot when he was attacked.  The music is only part of the problem.  What really caused this issue is when "Gabe Nikey Knuckles Batten" and his "boys" chose to attack an innocent neighbor when he asked them to turn the music off.  If they had a shred of human decency none of this would have happened.

They had no right to self-defense because they were unlawfully occupying the pool after hours.  In other words they were trespassing (in addition to whatever other minor crimes they were committing in disturbing the peace).  The Arizona justified force laws are very clear on this point (look up ARS 13-404 if you want proof).

Secondly, you have no evidence to prove that he had intent to cause harm, he wanted to be able to defend himself in case the thugs at the pool took offense to his simple request to turn off the music.  This is a basic right that is protected by state laws and the 2nd amendment.

Lastly, Batten and his boys are completely and utterly responsible for the outcome here.  If they had a shred of human decency they wouldn't have turned up the music a 2 AM on a Monday morning while trespassing in the community pool.  They were assholes no matter what way you spin it.  The fact that they attacked Leavitt when he asked him to stop just proves this point even further.

Read the paper that young guy went over there with the intent to caused harm. They had a right to protect them selves this fool came with a gun a d brought his friend that need to be charge also with the murder. People like you need to be put in a special like you never made too much noise before.
