SB 1070 Oral Arguments Wrap Up in Supreme Court; Some Believe Court May Uphold Part of the Controversial Law

Just as oral arguments wrapped up at the U.S. Supreme Court over SB 1070, Arizona's controversial immigration-enforcement law that essentially criminalizes an undocumented immigrant's presence in Arizona, Congressman Paul Gosar made an appearance on MSNBC.

Gosar is running for a seat in Arizona's conservative Fourth Congressional District against embattled Pinal County Sheriff Paul Babeu and state Senator Ron Gould.

During the interview, he said that SB 1070 was necessary because we have a set of laws the U.S. government is not enforcing.

The network reported the "Supreme Court appears ready to uphold part of Arizona's controversial immigration law, which would allow some of the measures currently blocked by lower courts to be enforced."

Based on comments during Wednesday's oral arguments on the case, even some of the court's liberal justices seemed to find no strong objection to the most controversial part of the law, which requires local police to check on the immigration status of anyone they detain or arrest.

The state appeared to have a tougher time defending two other provisions of the law that are now blocked: making it a state crime to have no federal immigration papers and making it a state crime for an illegal immigrant to look for work. Neither is currently a federal crime.

When Gosar was asked about whether the law would lead to racial profiling, Gosar dismissed those concerns as people "unknowledgeable about the bill," and that it "absolutely doesn't allow racial profiling."

He obviously is unaware about the way that Maricopa County Sheriff Joe Arpaio has made use of such laws -- in fact, he brags about going to specifically going after Mexicans out of spite.

On Monday, New Times' writer Ray Stern wrote:

After critics including local politicians and officials with the U.S. Justice Department "went after me, we arrested 500 more just for spite," said Arpaio. A couple of days ago, he clarified for the Associated Press that he only regretted not mentioning that he had busted "thousands," and not just 500.

Arpaio has been accused of leading the worst case of racial profiling in a law enforcement agency in U.S. history. The Justice Department, which announced the damning findings against the Sheriff's Office in December, appears ready to sue Arpaio for failing to cooperate in settling the matter.

Out of spite.

MSNBC also interviewed Illinois Congressman Luis Gutierrez who said that SB

"We can't have different immigration laws implemented across the country. We need comprehensive immigration reform," he said.

He noted that 1 million immigrants have been deported in the last three years, and that there were more resources at the border than ever before.

"What they want is to exploit a politics issue," he said.

Governor Jan Brewer spoke briefly outside of the courthouse, and she has obviously been practicing her sound bites.

Sort of.

After praising the lawyers who argued the case on behalf of Arizona, she said: "We have done the very best job we can do for the people of Arizona to supper the rule of law."

We all remember her tragically embarrassing mangling of the English language during a debate with her gubernatorial opponents ... when she said ... well, it's worth watching again.

25 years ago i bought a brand new boat,man was i happy...untill.

on the US 60 i was pulled over by two DPS cops,with guns drawn.
i asked what the problem was,they demanded proof of ownership of my new boat!

Only a parts if it?? I'm only shocked that this so called last court of appeal is not going to say the whole thing is legal as the SC is a right wing, activist court without a clue on any matter that deals with race, and, I'm a middle-aged white woman who can see that this is all this is about, if they wanted to stop these people from coming here, they would go door to door of every business in this state that HIRES them, which, will never happen as the same ones who hate them want them here for low wage jobs with no benefits.

As for Gosar, he really needs to sit down and be quiet, he can't even win a poll againstt Paul Babeu, and, I bet won't win the primary, so, he had best get is 15 seconds of TV time while he can.

It makes me laugh that they can sit there, with straight faces, and say that racial profiling wont happen when they know it already is happening. But hey, if people are too stupid and want to pony up for an enormous amount of money for all the future profiling lawsuits that will most definitely occur, then I say ENJOY! Maybe after it continually happens they will wake up...or in a twist of irony, it will happen to them or someone they know. Shit, ive been profiled numerous times and IM WHITE! You honestly think it wont happen? good luck with that delusional thought.

lol cant have them going after business owners now can we...good point.  Also, people forget about the private prison lobby running our Governor, and how many of those prisons have been built to house illegals.  Its all about the money, like it always has been here.  Just like it took losing a super bowl for the state to finally honor MLK.

SB 1070 hasn't been enforced. There are zero instances where sb1070 has led to even one person to be racially profiled.

your link is broken.  I am making the point that there are no "facts" to bolster your position.  You argue subjectively rather than objectively.
You are suggesting that because there is a large concentration of a certain group of people in the area that automatically the same large concentration of people are plagued by racial profiling yet you provide no evidence to support your claim and expect those with a dissenting opinion to disprove your argument.  You are making the claim, therefore the burden of proof lies on your shoulders.
I am telling you that racial profiling does not occur within the Sheriff's Office.  No one who makes the claim of racial profiling against the Office has been able to cite even one credible example of it happening.  Your statement that you know "people" who have been discriminated against because of their race is meaningless.  Cite examples.

I guess you won't be convinced until we get the results of the class action against Arpiehole. Has there been a racial profiling case?  Who was the victim and who was found guilty of profiling them?  All I have seen and heard is rhetoric and political posturing.

What case are you referring to?

Please use the statements made by DoJ attorneys as the catalyst for your argument.  Yesterday's events in DC has shown how illegitimate their arguments are.

I am simply stating facts. I have been witness to racial profiling,people in my family have been racially profiled,friends of mine,both brown & black have been racially profiled. This has been happening long before SB1070 was even a twisted little thought in that bigot RuSSell Pearce's pea brain........I can understand that if someone has never been the target of racial profiling,they would tend to believe that it doesn't happen.One needs only to take a look at the cases being brought against your boss,as proof that it does happen.

The racial profiling argument against sv1070 has always been a red herring. This issue has been and was argued as a states rights issue. Can states create laws to protect their borders? That was the pressing question.

You're right David.racial profiling has been happening for years without SB1070 being enforced. Arpiehole isn't under investigation by the DOJ because he is not profiling. There will be a flood of lawsuits if this law is allowed to stand. I know many people that have already been racially profiled.
