Would Bill Montgomery and Company Actually Prosecute Porn Actors for Prostitution?

Maricopa County Attorney Bill Montgomery sent out a gentle reminder yesterday that anyone paid to appear in a porno flick "may be guilty" of prostitution.

He's not saying the County Attorney's Office is going after the porno industry -- or that it isn't -- but with rumors of California-based porno companies coming over to the desert after Los Angeles' new law requiring porn actors to wear condoms, he's just sayin'.

Montgomery's office also issued the warning that soliciting someone to make a porno appearance, collecting money as a porn star's agent, bringing actors from California to Arizona to do porn, making a place available for shooting, and producing porn may all be felonies in Arizona. Again, he's just sayin'.

As you may know, pornography companies have been operating in Arizona -- or, as local talent Taryn Thomas calls it, "like a mini Porn Valley" -- for years.

To that, County Attorney's Office spokesman Jerry Cobb tells New Times, "There have been people doing all kinds of things are illegal, but not everyone's caught and prosecuted."

And nobody in the county's faced prostitution charges for porno appearances since Montgomery took over, Cobb says.

Our question this morning: Would the County Attorney's Office actually prosecute porn actors and others for prostitution?

Yeah.  Small problem with this.  The Supreme Court has already held that pornography is protected first amendment speech.  Not sure how a County Attorney could not know that?

Before he can prosecute someone must be arrested.    They'd never get anyone inside as an undercover officer or informant.     The industry is close knit.    Besides, it's not big in Arizona.     The bigger money people stay in California or Florida to make movies because it's legal and that's where the industry people live.    There's no benefit in filming in Arizona.   All you're going to get here is amateur porn.

Please excuse the pun, but it seems that the county attorney is a classic example of the Peter Principle.   This bunch of "Social Conservative" do-gooders and potential social engineers don't believe in either Constitutional rights or freedom UNLESS their church is in control.  One of the great ironies of the current group calling themselves Republicans is that they don't believe in the very concepts that they continuously whine and howl about--individual liberty.  Did a male porn star injure or diminish the rights of the county attorney OR is this just a case of penis envy?   Bill needs to quit watching so much porn.  The answers should be obvious.

Montgomery will NOT prosecute the porn industry unless or until:

1.    His buddy the Shurf has 40 "undercover" deputies investigate.
2.    The head of his investigative team writes a book about it and starts selling it on the Shurf website.  
3.    The Shurf stops giving him stupid reasons to avoid prosecuting the Shurf himself.
