Man, 30, Rushed to Hospital After Serious Accident at Skypark Trampoline Park in Phoenix; UPDATE: Man Dies From Injuries

A 30-year-old man was rushed to a hospital Thursday evening after a serious accident while jumping at the newly opened Skypark Indoor Trampoline Park in Phoenix's Arcadia neighborhood.

"He was not breathing and had no pulse," says Captain Scott Walker of the Phoenix Fire Department.

Walker expects to get an update on the man's condition in a few hours.

The victim had reportedly jumped into the facility's foam pit before receiving the injury, he says.

Phoenix police had no information as of yet.

Mark Svejda, a Phoenix attorney and one of the founders of Skypark, located at 3921 East Indian School, tells New Times he wasn't there last night and had no comment on the incident.

The 26,000-square-foot facility celebrated its grand opening on January 20, and has already become "one of the hottest new hangouts in Arcadia," according to an article published Thursday in the Arcadia News.

We'll update this story as soon as we learn more.

UPDATE: 12 p.m. --

The victim is alive but in "very grave condition" with a spinal cord injury and possible brain damage, Walker says.

Also, we couldn't help but notice the long comment on this blog post by local businesswoman Gia Heller, who says her two daughters were at Skypark last night. Heller writes about her concerns of the way the incident was handled by the facility.

When someone actually comes forth with an alert to other parents based on her trusted teens words who were there, why are some people attacking the messenger? Meanwhile a young man is dead, and who knows how many kids were traumatized as a result of witnessing it. Anyone who attacks the messenger is usually on the side of wrong.

Terrible what happened to such a young person. I will meet the family one day and give my condolences. If you are reading, I say that I am sorry for your loss. I too know a thing or two about loss. That being said. People, it's not about you and "topping" each other with silly comments during such a tragic time. It's about the victim, family, friends and the public who care about the loss of such a young man who they loved and cared about.

Wow, the vitriol here is amazing. It was sad to hear of this man's passing today.  Having been to a few of these places locally recently, chances are we're done in our family. Gia has shared her opinion and then some. Probably weakening any street cred she had prior to Friday last week. Now her husband and friends are in here having defending her.  How about waiting to see what the official investigation turns up before tossing everyone under the bus? No doubt there will be substantial witness testimony, video surveillance, first responder testimony, etc.

for the love of all things decent - New Times can you please review/rethink the parameter by which your policies are structured in regards to which stories allow comments?  And if you are unwilling to make changes under the guise of free speech can you please just be human and make the decision to disable comments when a death has occurred?!

Traggic accident for sure but being an Arcadian Business Owner I'm excited to see SkyPark open and think it is a great addition to the community so I wouldn't want to see this turn into a witch hunt.  Reality is people have to use common sense when performing this type of entertainment and it could happen anywhere.  Big Surf seems to have a death every few years but I still take my kids there.  Kids die at school and in sports but I still allow them to participate, etc.  Not really fair to hold an organization accountable for an individuals actions or poor decision so you may want to curb your eagerness to make someone pay for this accident as it was an accident.

These facilities are dangerous just think about it you have tons of people jumping around in trampolines ranging from kids to adults...arms and legs flaring through the air ....someone was bound to get hurt. I attended a birthday party at the one in glendale and there was 5 yr olds in the same area as 13 yr olds. Just think about it... a 40# child with a 100# child next to each other doing summer saults .... not a good image. (BRoken NOses anyone??) I don't plan to take my child there ever again and after reading this story I don't feel like an overprotective parent. Just a cautious parent. My prayer to the victim and his family.

LISTEN I have talked to both of these girls because I am EXTREMELY close to them, they feel HORRIBLE for what happened to this man. Her mom is going way over-board I must say seeing as how Jenna or Jessica aren't looking for fame or anything at all, this is there mothers handy work not the daughters. AND speaking of the news report, the girls had NO IDEA they were being brought to the house there mother surprised them by coming home saying they were going to be on the news and before they could even ask her what she was talking about they were already knocking at there front door waiting for them to do the interview. These girls were just wanting to go to a friends party and forget EVERYTHING. They did speak "the truth" in there interview and they also said some REALLY NICE things about the emplyees there and about how they plan on going back there because accidents happen all the time and they know to listen to the rules. HOWEVER the news is still the news and of course CUT-OUT anything good whatsover from there interview and only put the bad because the reporters just want a "juicy story" you guys are blaming the DAUGHTERS when it is only the mother saying and posting these crazy things without them even knowing. It's not there fault other people are deciding to do there own thing, I know that they have both been VERY worried, they were thinking about him all the time sending his body messages to be okay and to get through this... You have no idea how MAD this blog makes the girls to see this. This is not there doing.

i remember these coming out in the early 60's and every place that opened had a paralyzed kid within weeks.  did everybody forget trampolining is actually a sport requiring strength and training.  our gymnastic team only had a few even willing to get into it.

I am a worker at Skypark, I was not there the night all of this happened but let me tell you everyone that work's for Skypark is grieving over this. We never intended for something like this and how most of you guy's are saying it was the workers fault makes me wonder...how would you have delt with something as scary as this? We do train our employees as best as we can, but to train them with something like this there's no way unless you've gone to school for it. I know our employees did the best they could and im sorry it wasn't good enough for some of you, but we feel teroble that something like this could ever happen. I want you guy's to know just because we work for Skypark doesn't mean it our fault. So please stop coming to Skypark and saying rude things or even the people that call and say inappropriate thing's, come on grow up! I wish the best for this man and his family. If it is true that the owner of this place is a lawyer, he should own up to his character fitness evaluation given to him before he became barred. He should not fight this, and he should own the responsibilities and outcomes of his actions.

However, I DOUBT THIS WILL BE THE CASE... 

So I'll throw out some legal terms for you...
1.) STRICT LIABILITY
2.) FORESEEABLE DAMAGES
3.) NEGLIGENCE
4.) ATTRACTIVE NUISANCE 

Now a story:

A man was about to rob a house, as he walked around on the roof of the house looking for an entry point he fell through the roof. In falling, he fell onto the kitchen counter, where the family had left a sharp kitchen knife, and cut himself very badly. The man then turned around and sued the family, stating that it was NEGLIGENT to leave the knife on the kitchen counter because there were FORESEEABLE DAMAGES. The family was held responsible under STRICT LIABILITY, and the man robbing them won a bunch of money in court.

Another story:

There was a construction site next to a school, and on this construction site were a bunch of dirt piles. After school one day, a few of the kids decided to break the lock on the gate, ride their bikes past the no trespassing signs, and start jumping the dirt piles on their bikes... NORMAL KID FUN (aside the breaking & entering and the trespassing). One of the kids fell off his bike, and was hurt very badly in this accident. The kid's family then turned around and sued the owner of the site, and the construction company that was doing the work. The kid's family won a bunch of money, as this was deemed an ATTRACTIVE NUISANCE (did not matter about the trespassing or the breaking & entering). This was a FORESEEABLE DAMAGE, as most kids who ride bikes for fun usually jump things and try new tricks. The site was right down the street from the school, on a known bike path that most kids take to get to the school. 

The moral of the two stories is that EVERYBODY KNOWS it is dangerous to jump on a trampoline, and that FORESEEABLE DAMAGES are present here. Meria Heller is right; waivers or not, the owner is responsible for any/all damages under STRICT LIABILITY.

All of you people claiming these girls to be liars need to take things into perspective. Its sort of like the telephone game we have ALL played. Nobody is lying, nor do they have any malicious intent with the stories they tell. EVERYBODY'S experiences are different. How dare you call people liars when they are telling a story based on their personal experience. 

Furthermore, if ANY you think you would like to leave some more HATEFUL, DISRESPECTFUL, HURTFUL, MALICIOUS, MEAN comments I would URGE you to meet up with me in person and say some of these things to my FACE rather than tough typing behind a computer screen. Just let me know, and we can meet up at skypark... Otherwise, stop being cowards and start showing some EMPATHY.

I am sorry to hear of such tragedy happening as a result of somebody wanting to have some honest fun. My condolences go out to anybody who personally knew this gentleman, and to his family. Stay strong for each other and help each other through this. Hold on tight to the memories you share with this gentleman, NOBODY can take those from you!

Mrs. Gia Heller, who owns a marketing company and thrives on getting her name out, started this blog. Of course, she started it only because she was "concerned" all while she claims she has taken her kids to Skypark 12 times previous to the accident. even worst, it appears she was never at the park in the Phoenix area. I mean the only truly important thing here is that the Arcadia community remains a thriving community for derek's business and nothing must compromise that, not even an accidental death at a neighboring establishment, right derek? God forbid, how could you maintain your "big man business-owner" social status in front of your little friends when this nagging bad publicity regarding accidents in businesses in area is still lingering. I could only imagine the incovienence. The bottom line is here derek that this man was a great friend to me, my wife and children, but you have made it blatantly obvious that his life, including his family, friends as well as people he has touched; essentially the entire ordeal has proved to nothing more than an inconvenience and potential threat to derek, derek's business and derek's community. hey, idk why you said this but my mom let me know that the news wanted to interview me about 30-40 minutes before they arrived and they contacted her about my interview only one minute before she called me. I am not mad about what my mother has written in fact I haven't even ready any of this blog. And I was shocked to read this. take this down please, as it is not true.

Ridiculous is right here, this man was a WONDERFUL, FUN, JOYOUS individual who had an enthusiasm for life that is so rare.  He passed earlier today and will be missed by so many friends and family that he touched in his short time in this world.  RIP to a great friend, loving son, brother and cousin.  He will forever be in our hearts.

Tramp places can be great fun, no one can stop the accidents that happen period.  Its like trying to stop accidents on a ski slope.  However, in places where extreme danger/risk are involved there are HEAVY policies/systems/structures/processes for when a man/woman goes down.  People are taken AWAY from the area IMMEDIATELY, not left running around playing around the area.  Small children should be shielded from watching such graphic horrors.  The community has forgotten this because violence is so prevalent in the media.  

There are many eyewitnesses that do not feel comfortable with the way the situation was handled.  This is coming from a mother that LOVES the concept of Skypark, especially in the Arcadia area and has spent a LOT of money there in the past 30 days.  So this is NOT a Skypark "Hater" contrary to some people that are trying to character assassinate me in some of these posts.  This is someone that LOVES the facility and LOVES that my daughters have somewhere FUN to play.  I do realize the risk that my gymnast daughter can snap her neck if she lands wrong from a flip.  What I feel good about is knowing she is buddied up with my other daughter, and if an accident DID occur, there would be no more than 1 min or less before someone notified a medic.  She wouldnt go unnoticed for several crucial minutes.  Because I am confident my oldest teen would be watchful and react in a timely manner.

What I am suggesting (and many other eyewitnesses) is that the situation was handled sloppily and there were DEFINITELY staff members running around asking for waivers while he was down.  (That was cut from the news, they should be glad that didnt go out on News 3).

Most of these posts are created by staff to try to mar my character or say I seek fame.  I am already a public figure with an over 20m reach.  I am in the spotlight daily on a platform for business.  I do not need a new times blog to make me "famous".

And for anyone writing here "anonymously"…..  I would offer to be publicly interviewed and debate you in real life, since you are so "brave" on the internet.  I reserve my right to FREE SPEECH as an American.

First off your comments mean nothing to me as you are engaged to Gia Heller. People who think like you are exactly what is wrong with our country. It is a HORRIBLE ACCIDENT!! But you and your fiancé seek to gain your ten minutes of fame and confuse the situation. Luckily this establishment has tapes to show how this situation truly played out, whatever that may be. As a small business owner myself, I feel for this establishment and I hope, hope that this unfortunate situation does not shut them down. I don't understand why you think big surf s so much better, I my self was injured right in front of an employee who did nothing. My family took me home and later to the hospital. Did I seek to sue and get my tem minutes of fame because a teenager acted like a teenager? No, because I am responsible for what I do, and if I hurt myself, then it is MY FAULT! I am soooooo sick of people who are sue happy and don't want to acknowledge their part in a given situation.

The teenager interviewed on the news last night is my daughter Jenna Heller-McKenna and she is not only a superior student at Arcadia High School, but was elected head of the peace council out of approximately 4,500 students at Poston Junior High in Mesa.  She is a CPR trained Lifeguard for Big Surf corporation and has the wherewithal professionally to provide eyewitness testimony from that perspective.    A stand up citizen and leader in her school, Jenna is not a "liar" as this man called her.  She is actually brave enough to say what needs to be said.

Trampolines are not professional athletic equipment. They may be used for training professional athletes, but that doesn't mean they are relegated just to the professional athlete world, no more so than a stationary bike might be.

Would you say the same about swimming pools? Would you say that the only ones who should have a swimming pool are those individuals like Michael Phelps? The rest of us common (non-athletic) folks should not have swimming pools?

I'm sorry to burst your bubble, pal, but there are risks with everything in life. Even walking outside your front door, or crossing the street.

Remember the reason for Shannon's law? It was an unfortunate accident. What is your solution to have prevented that? Have a curfew? All people need to stay inside their homes, and maybe be let outside for 1 hour a day? That wouldn't work either, because even being inside your own house can subject you to bullets (or cars, or even airplanes) penetrating your home.

Besides, haven't you ever jumped on a trampoline? I used to have one in my back yard (without a foam pit). It's fun.

Gia, im a longtime resident in this area with 3 children that have been to Skypark 6 times in the last 3 weeks. One of your blogs state you had your children their a total of 12 times. Accidents happen with anything if it contains more than sitting on the couch and playing with your play station all day.   Your constant blame towards Skypark which is probably the best venue that has opened for many of us in Arcadia and surrounding neighborhood is clearly wrong. Your initial slash towards the wonderful kids that they have employed to work their is disgusting. Parents and many kids in Arcadia are very upset with you and your company. It was the head topic this morning while we were at breakfast (and yes, we dropped our kids off at Skypark)

So here is the real truth about you! The people that are in the business of PR read right between the lines in that you started this blog and contacted Channel 3 for an interview at "your house" simply to promote yourself and your business. It interesting how you directed people from this blog to your Facebook page. You did a great job attempting to promote yourself through peoples misery. For 2 years we were driving our children to other cities so they can jump for a couple hours. Now you are working on destroying the very great venue that "chose" to invest in our neighborhood all for your own personal gain. This is the biggest failure of a PR stint I have seen in the many years I have been a resident and a businessman in the area. Skypark has been a blessing to us parents with children. We take our kids their all the time and will continue to take them to the Park. Perhaps you can purchase a "Gia Heller" bus and charter our kids 50 miles to other Jump Parks in Arizona. Eyewitness reports are not always entirely accurate. I've pretty much read through this entire blog.

Quite frankly, Gia, my perception of you is that you and your daughter are self serving individuals who want their 5 seconds of fame.

This is particularly sad given the gravity of the situation.

While tragic, this really was a freak accident that was handled appropriately based on what has been presented thus far.

Thanks for the update/clarification Guest2.Sorry to hear he passed away.

It may be of no comfort for those still alive who knew him, but I am quite certain his passing was painless. I was in the same situation 12 years ago (almost passing away myself), just under different circumstances.

His family and friends will go through a grieving period, for sure, but this will be a time to reflect on positives, and not negatives.

I am actually ashamed my last comment directed to Gia.

I also saw a post from you earlier, where you mention your daughter (by name), the school she goes to, and her accomplishments.

If that isn't a "plug" for both of you, and your 5 seconds of fame, I don't know what is.

It seems you are not making many friends here, so I would be cautious about what you post.

I even saw a post where you referred to a person or two as an "internet moron". Before you call someone an "internet moron", take heed to what I just mentioned above.

Your meager accolades mean NOTHING!!! I was a lifeguard too, in Florida... You talk about how you are a lifeguard and a swim instructor, blah blah blah (IN THE MIDDLE OF THE DESERT... I AM SURE YOU HAVE SEEN SOME PRETTY BAD THINGS, RIGHT?!?!) You are a young, and VERY UNDER EDUCATED individual. Did the city of scottsdale train you to react so uncouth and selfish to serious incidents such as this?

I hold a Law degree, a PhD in Engineering, I was a junior lifeguard AND a lifeguard for 7 years in the city of Daytona Beach. I  too am certified in CPR/AED, First Aid, and Lifeguarding. I am also trained in REAL LIFE EXPERIENCES, which you are FAR too young to appreciate.

This is not the first person who has been hurt in that foam pit, but hopefully it will be the LAST!!! Can we say PUNITIVE DAMAGES?!?!?!

I can think of 50+ reasons this man is not at fault, and the OWNER IS.

The biggest liability is that the owner hires under educated people, such as yourself... Under strict liability, that owner is responsible for YOUR actions as HIS EMPLOYEE... He should have trained, educated, and implemented a procedure to follow when something like this happens... Did this happen?

How far away is this foam pit from the phone? IN OTHER WORDS... IF I FELL DOWN AND BROKE MY LEG, HOW LONG WOULD I HAVE TO GO UNASSISTED (being that the one person watching this station would have to leave to tell somebody something happened before they could move me out of the foam pit) BEFORE HELP IS CALLED?!?! 

It seems to me that it would be REASONABLE to have a phone/intercom system set up for each station so when something bad happens these employees do not have to LEAVE the area to go tell somebody is hurt...

Sure once the guy was face down in the foam pit nothing could be done until removed, but before this occurred many PROACTIVE measures could have been taking to mitigate the risk. How was your training at Skypark, compared to your training by the city? Did they train you how to react in a situation like this, should one occur? I'm willing to bet NOT! Negligence if you ask me!

2. Her kids are angels. One of them is a trauma surgeon/lifeguard at big surf

3. Even thought the jump place is dangerous, she brings her kids there 12 times so she can go to glamor shots and get more photos for her website.
