Jack Hegarty, Demoted Former No. 2 Guy at DPS, Retires as Probe Continues Into His Alleged Ethical Violations

This is the picture that got Jack Hegarty in trouble. (DPS officer Tim Mason is at his right). Hegarty's retirement was made effective today.

Jack Hegarty, the former No. 2 man at the Arizona Department of Public Safety until his demotion in October, has left the agency while still under internal investigation.

His retirement was made effective today, DPS spokesman Bart Graves tells New Times, confirming a tip we received today about the former executive staff member.

Hegarty, a friend of DPS Director Bobby Halliday and 18-year veteran of the agency, was under fire for much of last year following an employee survey by the Fraternal Order of Police that blamed him for widespread morale problems.

In October, Halliday demoted Hegarty from his leadership position and reduced his rank from lieutenant colonel to captain.

But Hegarty's problems apparently went from bad to worse after New Times published a picture of him and another officer sitting at a baseball game. (We hear the game was in San Diego, but a reader points out that it may have been in Phoenix.)


As we reported last month, DPS launched an internal investigation into whether Hegarty violated ethical rules after an allegation surfaced that he was at the game because he accepted tickets from a trucking association.

New Times
had received the picture -- which had appeared in the overhead screen at the game -- from a reader.

Graves says that investigation, which was farmed out to the Phoenix Police Department, is still pending. Graves did not know whether the outcome of the investigation could affect Hegarty's retirement benefits.

Other than that, Graves says DPS has no comment on Hegarty's sudden retirement.

Lieutenant Colonel Jack Hegarty began his law enforcement career 18 years ago as a Highway Patrolmen assigned to Yuma. He saw service in various assignments including patrol, SWAT, Agency Support Division staff, Training, Commercial Vehicle Enforcement, and a fellowship in Washington DC at the National Highway Traffic Safety Administration.

After completing US Navy Officer Candidate School and Naval Intelligence School, he served as a Naval Intelligence Officer and completed tours at various commands in the continental United States and abroad. He holds a Bachelor of Science degree in Aerospace Engineering from the University of Arizona.


If Hegarty's looking for a new job -- well, we hear he's pretty tight with the trucking industry.

What everyone needs to understand is that this is not about a single baseball game. The issue is that former lieutenant, former colonel, then disgraced captain, now disgraced former employee, Jack Hegarty, took "gratuities" from private entities to whom the DPS was supposed to be regulating and enforcing state and federal law. This accepting of gifts is a violation of felony state law. Cops are not allowed to take anything for free. It erodes the public trust and places them in a position of being indebted to the giver of the gifts. In this case, it happened to be multiple free tickets to sit in the Arizona Trucking Association luxury skybox. But what you are seeing is just the tip of the iceberg; don't be deceived, there's more coming.

Hegarty and Halliday had flaunted their relationship to the ATA from the very beginning and ordered several revisions to DPS policy that were favorable to the trucking industry, the ultimate “quid-pro-quo". As the investigation progresses, it will reveal he lied to investigators on several points and will be accused of and convicted of dishonesty. Does any citizen not expect  their leaders tro be truthful and honest?

With all this aside, Hegarty was arrogant, incompetent, unprofessional, vile, abusive, and universally hated because of the way he treated people. It DOES matter how you treat people in life. If your leaders can't follow rules and place themselves above rules it has a terrible effect on employees that are held to the strictest standards of conduct. Halliday unapologetically defended Hegarty's contemptable behavior at every opportunity
 
A day of reckoning is at hand for DPS Director Halliday and eventually, Hegarty's toadies. Those long time law enforcement professionals will remember Halliday as a mediocre officer, sergeant, lieutenant and commander when he left DPS. He has returned as an abysmal DPS Director. His appointment of two below average lieutenants, one of which was Hegarty, demonstrates raw incompetency. Is anyone surprised at Hegarty's professional and moral failure???? Interestingly enough everyone saw this coming but Director Halliday.

Halliday needs to go and the Governor held accountable for allowing this to happen from the first place in spite of hundreds of complaints concerning Hegarty and Halliday conduct over the past two years. There are many law enforcement professionals out there who would and could lead DPS into the future rather than tie it down to 1972.
 
Follow the money! Here’s the equation: the ATA owns the Governor (campaign money) – the ATA wanted control at DPS – Jack Hegarty was a willing dupe – Hegarty was too junior to take over DPS when Vanderpool retired – so, the Governor needed a patsy to play the role of director – She finds a willing malcontent in retired commander Halliday – Halliday returns from the dead with orders that Hegarty will yield the REAL power at DPS – Hegarty repays the ATA several times over – as absolute power corrupts, Hegarty finally got caught – Halliday and the Governor knew what was going on and never condemned it because it suited their needs – now they’ll act all surprised and apologetic and promise reform. The problem? The dedicated employees at DPS have paid the price with their blood and the citizens have paid with milliioms of dollars in wasted taxpayer money.

Who cares if some cop got free tickets to a baseball game?    It isn't like that's a prized possession or something of value.   Hell, there's too many baseball teams and they all play 162 games a year.    Wow, such graft was commited that it prevented me from not going to a game I never cared about.   Stupid reason to demote someone.    Find a better reason.

One down and a few more to go! Now why does Robert Halliday, Director of DPS still have a job? Is Phoenix PD doing an ethics investigation on him as well? He has closer ties to the trucking companies then Hagarty ever did. Halliday is corrupt, uses his position of power for his own personal gain, and his hot headed, short fuse, little man attitude that he can’t control has been used on former and current employees of this department.  Hopefully someday someone will probe into him and bring this all to the surface. The New Times does but no one listens! WHY???

Hegarty is a cowardly snake. Who leaves their job after 18-years unless they have plenty to hide. Halliday is a useless has-been who nothing more than a political shill. The Governor, the worst excuse for a head of state, who knew what was happening and allowed hundreds of good state employees to suffer needlessly. No leadership anywhere!!!

I truly appreciate this in depth account of the deterioration at the Department of Public Safety after our "Governor" made sure that her handlers in the trucking industry got the special treatment they requested by putting in a zero-sum "Commander" like Halliday!
