Is There ANY Reason MCSO Detention Officers Needed to Use a Taser On Marty Atencio?

By now, most of you have seen the video of Maricopa County Sheriff's Office detention officers using a Taser on Marty Atencio, an assault suspect who died after getting zapped while already in jail (see our story on Atencio's death here).

However, some of you might have missed it -- you see, the MCSO strategically waited until late in the day on the Friday before Christmas to release the video, when many people were traveling, or not paying attention to the news while preparing for the big day.

They could have released it Thursday, but that would have stolen headlines from a story Sheriff Joe Arpaio actually wanted you to hear about -- a story (described in an MCSO press release issued Thursday) about how Immigration and Customs Enforcement agents refused to pick up some illegal immigrants Arpaio's boys in beige arrested Wednesday night.

But we haven't forgotten about Marty.

The video, as an MCSO deputy explained to us last week, speaks for itself. We happen to agree -- the video speaks for itself in that it shows an unarmed man who's already in jail -- and isn't putting up much of a fight -- getting manhandled by nearly a dozen cops before a detention officer Tased him repeatedly.

I just found out from a friend of mine that in 2008 he was thrown to the ground by MCSO officers and that the broke both of his arms and after he was handcuffed, they bent his finger backwards and broke it. He made a complaint of excessive force but nothing became of it. The officers then followed him and harassed him. My question is whether or not one of those two MCSO officers was part of this group?  Does anyone recognize any of the officers in the video. I think that I recognize 3 maybe 4 but I don't know their names.  I have a list of "dirty" MCSO officers and if anyone wants to add to that just let me know.

Also, their use of the word "compliance" is puzzling. Compliance with what?  There is a big difference between having "control of the situation" vs. "controlling a person's behavior". They always had control of the situation.  These low life fuckers are so out-of-control  in their own lives that they want to contol "someone else". You can encourage someone's behavior or request a behavior you want, but you can't control whether that is 'given" to you. That cop that attacked Marty obviously couldn't handle Marty's passive resistance and he had a big audience watching him so he went after Marty. Good for Marty. He was and will always be 100,000 times the person any one of those sorry POS will ever hope to be.

I know first hand about the booking process at 4th Ave. The people there is disgusting, narly beasts. Everything is an order. If a response isn't given in time or isn't the one that they want they threaten you with more charges. These people are the biggest "losers" in life. The want to "rule and reign" over someone. Nasty, skenky is that woman in the video. Nasty!!!!. Someone needs to require them to say "please" and "thank you" at the beginning and end of every request. Right from the start the officers were "pushing" Marty onto the bench. So what if he was standing. If that was a problem, that's when they could have escourted him to a cell to quiet down. These sorry Pieces of Shit don't know how to interact with people. They want respect by trying to "order" you to give it to them. They need to "give" respect first. The MCSO officers everywhere is sick people. They are the sickest of the sick. They have to get very healthy to approach even the level of bi-polar. These are sick egomanics with inferiority complexes just like Coward  Joe.

Does anyone know if MSCO's adopted the taser use guidelines outlined by the Police Executive Research Forum, or PERF? And if not, why not? They are all common sense guidelines, most reputable departments have adopted them.

Click on related articles to this one and you will find an article "Dead End" I coun't 9 deaths in the MCSO since asshole Joe became sheriff, most of the names sound anglo and many appear to be caucasian. Three names sound latino. 1996 2 dead, 2001 1 dead 2003 1 dead, 2005 3 dead 2008 1 dead ans 2011 1 dead and ther are a few I couldn't get enopugh information on to count but here are more. These human beings are dead and they shouldn't be. And Sheriff Joe Arpaio, "I'm the Shurff and no one tells me how to do my job" needs to answer for this and he needs to go to jail for his corruption and abuse of power and his disregard for basic human rightsand mostly because Joe Arpaio is a complete asshole

I don't know the booking process at MCSO so I can only question as to why the group of 'officers' insisted on going after this guy if he wasn't cooperating. Normally it's not that important to 'book' a detainee if you already know who he is and if he is being criminally charged.

The jail isn't going anyplace, so put him in that cold padded holding room and watch him via video until he decides he is ready to cooperate.

But why confront him and take him down when there is nothing to be gained?

I would have thought the PPD officers would have been glad to turn him over and get back to work.

I'm almost sure all the MCSO officers could have found something else to do.

As a retired professional law enforcement officer it pains me to criticize others who are doing a similar job today.

Tommy no offense to you but we need to make sure that the police are not allowed to be above the laws that they swear to uphold. They need to be held responsible when they have incidence like this one. I truly think in this case they showed up looking for a fight and wanted to punish Marty. Whether it had to do with the recent court cases or whether they were just pissed off doesn't really matter. If I were to need help and call the police I wouldn't want to have 10 bullies with tasers show up and taz me to death.. since it appears you can do nothing wrong in Maricopa County (anyways) and still get the death penalty for breathing.

Are you suggesting Marty shouldn't have been booked into jail because they knew who he was and it was their intent to prosecute him anyway? I don't know if that was the angle you were going at.

Of course jail was the perfect temporary solution to a problem occurring in te neighborhoods of Phoenix. Imagine the public outcry if this guy was allowed to remain out of custody and he continued his erratic behavior to the point he hurt himself or worse yet, someone else. His behavior had to be curtailed and jail was really the only option. This outcry is prevelent from the numerous CPS cases where they do exactly that and people continue to be victimized. If the family really cared and were involved, prior to the deep county pockets opening up, they could have had him involuntarily committed for a mental evaluation...that is, if they really cared.

Could he have been left alone to calm down? Sure, that was probably an option that everyone involved wished would have happened. I seriously doubt that any one of the individuals dealing with the suspect wanted the guy to die. Those who think that are irresponsible and obviously have ulterior motives, none of which are concerning the descendent or his family.

It remains to be seen whether or not the Marty's death was avoidable. Hopefully there will be concrete answers from the medical examiners report telling us whether it was avoidable or not. If it was avoidable then certainly there needs to be focus on whether policy regarding dealing with inmates needs to be altered in order to avoid future incidents. If avoidable, the family certainly deserves monetary compensation, although no amount of money will alleviate the loss of any human life.

Those screaming bloody murder are part of the problem, not the solution. Those that would sweep this under the rug are part of the problem, not the solution.

Noone meant for this guy to die.

YPS, normally I prefer to not respond to some of the things that you say even though I seriously disagree with them.

Perhaps no one meant for this guy to die but some meant for this guy to be seriously injured judging from their actions. 

This is a sad situation for the family and for the community and for you to suggest that the only reason people are outraged is because they have an agenda is highly offensive.

No amount of outrage or agendas will change the fact that this man was severely injured in the custody of PPD and MCSO and then died.  Whether it was on the floor there in the jail or at the hospital the same people are responsible for the injuries leading to his death.

While I don't understand why you continue to want to vehemently defend Arpaio's men I think that you do understand that he needs to go and some of the people under his watch are of ill repute.

The only thing we know for sure is that in the beginning of the video he was standing and at the end of it, 8.5 hours later, he was being wheeled off to the ER.

I know this seems complicated but he was standing and alive at the beginning of the video and at the end the officers were spending a few minutes staring at him on the floor. Unless there is video that shows him conscious again, the cause seems pretty clear. Something the officers did caused him to die.

What was the cause of death Eleanor?  Do you know or are you jumping to conclusions like everyone else?  If you know then why don't you share with the rest of us?  What serious injury was inflicted? Can you tell me? 

You can't.  You don't know. No one at this point knows.  You may be right that he died as a result of injury he received while in custody, but that has yet to be determined. HE also could have died from a pre-existing issue.   This issue could have been accelerated due to the physical interaction in the jails, and then again, it may not have had anything to do with what happened in the jail.  He was amped up for some unknown amount of time before PPD even took custody of him.

I am not vehemently defending anyone.  I am also not falling into the frenzy of ignorant mob mentality i see exhibited from many on this forum.

The video alone is not enough evidence to convict anyone of murder.  It's not even enough to accuse anyone of murder.

Like I've said before, I worked with patients who were psychotic and could be assaultive and, without Tasers, batons, or pepperball guns, controlled them every single time without injuring them. This was murder by the culture of brutality and abuse which has flourished in the MCSO under Joe's rule.

This is murder, plain and simple. First degree murder and the thugs need to be arrested and tried by a jury of their peers which is more than they gave Mr. Atencio. MCSO is totally out of control. Arpaio needs to be ousted and MCSO should be in receivership sooner than later. Januray 4 is fast approaching and we all know the predictable Arpaio won't cooperate because he thinks he's too big and powerful. Now is the time for the feds to kick his butt right out of office and take over.

How in the world did it get to the point that we disregard the veteran status of an individual and the fact that PTSD could be playing a part and just murder him because he's being a little defiant? I want Arpaio in his own jail eating his own pig slop along with any deputy who had any part in killing Mr. Atencio!

If he was as combative as MCSO says, then WHY REMOVE HIS HANDCUFFS??? He appears to be just standing there against the wall with his arms around his chest when one particular officer just goes after him for no apparent reason.He's surrounded by 8 officers and yet they have to use the taser to restrain him?? They looked like they were just itching for a fight and used any excuse to start one.
