No Charges Filed (For Now) Against Thomas Weaver, Phoenix Teacher Accused of Feelin' Up Students

No charges will be filed against Thomas Weaver, a teacher accused of molesting two 12-year-old girls.
A teacher accused of feeling up two female students will not be charged with any crimes, the Maricopa County Superior Court announced this morning.

However, the County Attorney's Office can still file charges against Thomas Weaver -- evidence permitting, that is.

Jerry Cobb, a spokesman for the MCAO, says his office is waiting for additional information from the Phoenix Police Department before making a final "charging decision on this matter."

However, as we reported when Weaver was first arrested, the incident seems like a classic case of he said, she said -- with little evidence against Weaver other than the word of his two 12-year-old accusers.

According to court documents obtained by New Times, on October 31, the two girls claim Weaver, a teacher with the Scottsdale Unified School District, approached them in the library at the Arcadia Learning Center and told one of them he liked her necklace. He then grabbed it -- before copping a quick (five-second) feel.

He then told the other girl he liked her necklace, too. Weaver then grabbed her breast, also -- this alleged boob-grab lasted about 30 seconds, according to the girl, that is.

Both girls say a similar incident happened at the beginning of the school year.

The girls also told police that Weaver grabbed a cell phone out of one of the girls' back pocket. She says it seemed at the time like he was feeling her up and that it took him "longer than necessary" to remove the phone.

The girls say they always feel uncomfortable around Weaver because he's "always asking for hugs," and that he looks at them "in a way that a teacher shouldn't look at a student."

Weaver was booked into jail on two counts of sexual abuse, and one count of aggravated assault on a minor -- charges, as we mentioned, will not be filed at this time.

Despite the girls' claims, Weaver received an outpouring of support from former students and friends in the comment section of our initial article about his arrest, which you can see here.

One commenter says the following:

"There's no way. He's been my teacher and mentor for years, I've known him my entire life. And as a teenage girl, he has never even come close to doing anything remotely inappropriate--ever. I just hope those lying girls come clean, and realize the effect their lie has on his life. It doesn't surprise me that the girls would lie, but this still makes me sick."

Below is another comment in defense of Weaver's character.

"My wife and I have been aquainted with the Weavers for years. Our daughters attended school together, EL thru HI. My daughter has had "sleep overs" at the Weavers many times in the past with absolutely ZERO issues. I don't know the girls who are making the allegations, and I in no way are accusing them of lying. If they are in fact victims, then that is very sad indeed. We ALL want to protect our children, but it is unfortunate that in alleged child molestation cases that the mere accusatiuon of impropriety is enough to put any adult into a "guilty until proven innocent" situation. A sad but true fact."

The Scottsdale Unified School District says Weaver will remain on a paid leave of absence until the school conducts its own investigation.

Jeff Thomas, assistant superintendent for human resources at the SUSD, tells New Times that after the investigation the superintendent will make a decision about whether Weaver will get to keep his job.

Thank God! Whilw we need to protect our children from preditors...Mr. Weaver is NOT one! He's anything but...he has helped SO many students, including my autistic son. He's an amazing teacher, man and mentor. He cares about his students & would NEVER do anything to hurt a child...let alone make them uncomfortable. I'm so happy the many prayers being said for him are helping and just hope he's back in the classroom soon!

hmmmmm . . . . been lookin' 'round.  Maybe I'm not good at lookin' and maybe I'm missing something but no other local media has issued any kind of retraction/update on Thomas Weaver situation so PNT excels in this case.  Thanks.

News like this is always "newsworthy". The public--particulary those with school aged children, need to be aware of what's happening in their communities. Especially, at what's going on at their schools--both in the public and private sectors.

I'd like to post here what I posted on another site. I totally support Weaver and my very RELIABLE child is one of  his student at anlc. No one could be any more protective over our kid than us and we have reason to believe Weaver was purposely framed by her two vengeful classmates!

As I shared before,

,My child is in library  too and was present in the so-called library incident. She was watching and was near Weaver the whole time and says NOTHING like groping or ANYthing occured. The teacher needs to constantly reprimand them for talking, texting and other disruptions. Apparently, they have talked in private messages on facebook of a plot to get rid of him. NO other girls had this issues. My daughter is a witness of at least one of their lies. Girls who are so-called assaulted by a teacher during the school year don't sit and giggle and tell other kids to "talk louder" when the teacher talks! My daughter is reliable source. She constantly pays attention to the teacher and was near him throughout the library session and even when he took away their cell phones. These girls are spiteful and planned this. Their behavior is not indicitive of some little victims. NONE of their girlfriends have ever witnessed these things

To add to my previous comment, Weaver is an intelligent guy, If he were a molester, why the heck would he pick the ONLY two girls who he made angry to molest? No, you would pick some quiet shy kid, not the ones with big mouths! Add, if these kids and their parents claim it happened earlier as well, do you REALLY believe these type of girls would wait so long and their parents? Really! My daughter has NEVER witnessed him "asking for hugs" and there are reasons none of this adds up If the detectives would call us back it would be appreciated. IF THERE ARE ANY OTHER PARENTS WHO FEEL IT IS IMPORTANT TO SAY SOMETHING TO THE ADMINISTRATION AND TO INVESTIGATORS ON HIS BEHALF, PLEASE SAY SO AND MAYBE WE CAN LINK UP!Mr Weaver is going to have the further investigation that he deserves. There are too many red flags and a LOT of classmates that know something is not right with these allegations. It is terrifying to know that a man's life- a man who spent all of life as a great teacher with no incidents, no previous records and no other allegations at ANLC- can be ruined because of the power of immature child ren can wield through spitfulness, and without truely realizing the damage done. We need to be careful when we as adults continue to advocate for children WHILE at the same time not allowing so much power in the hands of [some] of these kids. On campus, in spite of all of this, these kids do not appear to be thinking twice about what supposedly just happened to them or what impact this has had on an innocent man. Support Weaver and thank God for the skills he has as an educator.

Doesn't matter if he still has a job or not - between those girls and your complicity he is ruined and whatever he did to become a target - the true perps behind the scenes will not give up.  His goose is cooked.  Sadly he and his family will need to start somewhere else anew with even new names and perhaps PNT and the school district have ethical responsibility help that to happen equitably plus a huge bonus for pain and suffering inflicted - to lose a lifetime of friendships and goodwill based on somebody's questionable say-so.  I've seen alot of kids come up with alot of bogus stuff just to see if they can and normally I would think these girls did it on their own but when it got so blown up and even this article about it I have to believe that somehow someway he was ethically challenged on some issue, challenged the PTB, and they are now out to destroy him.  Since when was the say-so of anybody sufficient to prosecute?  Yes we do see it, when there is ulterior motive, another objective as well, or simply that they have to pin the crime on someone, but we know it is wrong and in this case we cannot see that a crime truly occurred.   Creating a hostile work environment with harassment is wrong too but it cannot be proven in this case. Why did the allegations ever even reach the press?  Many of us have suffered horrendous harassment based on sex or race and nobody ever dared even witness for us and our unions did nothing - nobody dared say boo - so despite people saying settlements are common place even if nothing occurred (recent Herman Cain allegations) there are many many many more of us that never had any opportunity for redress other than to just go find another job or go to another school.  In light of our experiences this whole thing seems very fishy.

I have written the principle at ANLC as well about the same issue. My daughter is in his class and says she witnessed the girls plotting against him it's a very sad situation and I hope the truth is revealed and everything gets straightened out soon!

As I mentioned above, I happen to think allegations that a teacher sexually abused students is newsworthy. And I gave Weaver the benefit of the doubt in my initial post. Now that the charges have been dropped, would you prefer I just ignore it?

And now that the charges have been dropped, I've given that story the same amount of publicity as when he was arrested. Take a look at most of the other news outlets in town that reported on his arrest -- most of which have essentially ignored the fact that the charges were dropped. I'm sorry if you don't think allegations that a teacher sexually abused his students is newsworthy. I do.

No I am glad that you followed up, but what about the damage done to Weaver and, can we all come to you with our allegations?  Plenty of us had real suffering, career-changing, illness creating, suffering with nobody to go to.  Meanwhile I have brought other real crimes to the attention of this PNT, I have brought real crimes happening to many people, also causing death and extreme suffering and you (as in collective you) have never touched a single solitary one of these truly newsworthy topics.  Never investigated.  Never helped the victims with any sort of expose; and then you jump on this stupid little thing and ruin a man's life?  What you "happen to think" is an extremely weak defense.  I have a legitimate grievance against PNT and so do many others.  Once in a while you all do an article that redeems your existence - this was not one of them.

Initially no other media had anything about these "allegations."  I know because I searched.  Other media followed your lead, I presume due to the competitve nature of your business the other media that subsequently found the Thomas Weaver allegations newsworthy ASSumed that you, James King, and Phoenix New Times, did due diligence to make these particular "allegations" newsworthy.  These type of "allegations" are levied daily.  Usually even when there is wrongdoing school district employees have a block wall of defense protecting everybody and as a parent I have seen this many times.  So when a district breaks rank and offers up a Thomas Weaver to be destroyed my imagination goes wild and I have to ASSume(?) or consider that this is a much bigger problem than the "allegations."  Look, we are so corrupt societally that anytime I see anything about child porn on a computer or molestation allegations I instantly believe somebody is trying to tarnish a potential whistleblower - the last thing I believe is that truly they had porn or truly molested.   So exactly who brought the Thomas Weaver allegations to your attention did you say?

I don't care how fair you think you were in the original article - this was NEVER newsworthy until AFTER proven in a court of law imho.  You smear yourself with this type of journalism.  I smear myself bothering to read it.
