Mark Goudeau Goes Off in Court, Blasts "Corrupt" Prosecutors, Cops -- and His Own Attorneys

Unexpected fireworks this morning at the county courthouse as the newly convicted "Baseline Killer" Mark Goudeau told the judge in no uncertain terms that he doesn't want to be in court for the sentencing phase of his high-profile case.

We weren't there for the outburst (we are holed up writing a cover story on the case), but have spoken to several people who were there and whose accounts are consistent. No media apparently was present.

 

Dressed in his jail black-and-whites, Goudeau told Superior Court Judge Warren Granville that he has no interest in being present for the "aggravation phase" of his trial, during which prosecutors will begin their push toward a potential death sentence. 

 

Yesterday, the jury convicted the 47-year-old Phoenix man of 67 felonies, including the murders of nine people during a violent crime spree in 2005-06 that ended with his September 2006 arrest.

Answering questions posed to him by the judge, Goudeau said he was sick of listening to deputy county attorneys Suzanne Cohen and Patricia Stevens, whom he described as part of a "corrupt" cabal of cops and prosecutors who long have had designs on framing him. (Former Maricopa County Attorney Andy Thomas may have found a kindred spirit in Goudeau, what with their incessant conspiracy theories involving The Man.) 

 

If we were Goudeau, we, too, would be repulsed by the two veteran women prosecutors--women, for God's sakes!--who were relentless in their organization and presentation of a case against a twisted and vicious man who was apt to pull the trigger, literally, from close range when he didn't get his way sexually or otherwise.

 

We don't even want to imagine what Goudeau would like to do with the two prosecutors who are hellbent on convincing the jury to send him to death row.

Goudeau also blasted his court-appointed attorneys, Randall Craig and Roderick Carter, saying  they hadn't heeded his advice to attack the police investigation that led to his arrest. 

 

In fact, Goudeau's lawyers presented no case, called no witnesses, relying instead on a "reasonable doubt" defense by raising questions during closing arguments about the sufficiency of the prosecution's evidence.

 

From where we sit, Craig and Carter did an admirable job winning those not-guilty verdicts on four counts in a case where the overall evidence of evildoing by their client obviously was compelling. Note to the future Goudeau appeals team: An "ineffective assistance of counsel" argument ain't likely to fly after a verdict in which 12 people did agree that the defendant murdered nine people but still acquitted him of a few charges.

 

Goudeau also strongly suggested that no one from his side, namely his apparently still-loyal wife Wendy Carr, will be testifying on his behalf if, as expected, the jury finds the aggravating factors and moves the case along to the final penalty phase.

 

That would be a bummer, journalistically speaking.

 

Judge Granville is said to have listened politely and intently to Goudeau before allowing  detention officers to escort him out of the downtown Phoenix courtroom and back to his jail cell.

 

The aggravation phase is scheduled to start tomorrow morning, and we'll see if Goudeau changes his mind about being present.


Somehow, we doubt that this little coward of a killer will be there.

oh yeah i  think the man is innocent and no i dont know him or his family but i have been following this story since before they arrested him and guess what peeps the murders did not stop there were three or four more after his arrest And that sketch has been changed three times during the investigation by the same girls and the police fucked up the DNA samples so know your facts and yeah baby THE MAN I BELIEVE IS INNOCENT  God help him!. but no one will ever even know for sure because of the media what if this was you?

I think the writer did what he intended to do he wanted us all to get involved voice our views but I don't think he wanted us to slander a poor woman who used bad judgement based on her heart and for us to attack each other

Where his stupid wife, the one who swears he innocent.  She is as clueless as they come.  then again look at who she married. those two cukoos should both in jail, he for commiting the crime, and she for doing nothing but in some cases she encouraged hinm to do it, by ignoring him. they both should get death sentences

I've always thought he was picked to be the one found guilty.  Sometimes the man takes whoever will best fit the profile they decide to create in order to "solve" the crime.   And crimes like these could not go unpunished so they found a guilty man.  It happens all the time.  This was a show trial and since he was already in for life, it was an easy fit.  This wasn't solved but he was made to be the solution.   There's no justice here.   Just a convenient inmate who got tagged for some crimes they couldn't solve. "Nobody really cares about him anyway, let's make him the killer".   Any of us can be made to be guilty if they want us to be.

If you knew how the justice system is "supposed" to work than you would know that Goudeau and his attorney had every opportunity to bring about evidence to support what you and others claim as his innocence.  He didn't. Anything else you want to support who I might be.

If you understood the legal system you would know that it is the prosecutor's job to prove guilt, not the defendant's to prove innocence. We do this because proving the negative, as it is called, is virtually impossible.

I trust the jury did its job and rendered a fair verdict based on what was presented, but I find it distasteful when people allow their bias - there desire to ensure a guilty verdict - to affect our legal system, especially when that bias runs in direct contradiction to the rights provided in our Constitution.

The saying in the legal profession is "easy cases make bad law." That means a case where we know a person is guilty (for whatever reason we "know" that) provides an opportunity to be slack with the rules of evidence and due process. As a consequence, a precedent is established wherein in a close case, suddenly slack is the new normal, and the equities are lost.

That's his complaint - his defense lawyers didn't put up a defense for him.  They did not do what he requested. In your speed to defend the PNT you seem to have failed to read the PNT.

Being placed on the hazard list regarding all LE in Arizona is one of the many, many things that have been done to be because I have chosen to speak out against the Tempe Police Chief, Tom Ryff and others in the City of Tempe corrupt city hall. 

For the record the "hazard' status was removed from my home after many months of me bringing forward more bullshit regarding the police chief.  Tom Ryff told the media he never had anything to do with the placement on my home.  I have a recording that says otherwise.

How little evidence there is against Mark???  Haha.  That's comical. Did you attend any of the trial?  Have you spoken to the judge?  Have you studied the applicable law?  Have you read the jury instructions?  I have done all of those things.  I am a law student and know the judge personally.  I have sat in his chambers discussing this very case (within the confines of which it is acceptable for him to discuss a current case).  I was there and heard a ballistics expert testify in methodical detail that every bullet was tied to the same low quality gun.  Comments like you just made are ignorant.  You read one article that offers no court admissible proof, only hearsay and opinions, and you are an expert?
