Bloody Black-Friday Arrest at Buckeye Walmart to be Investigated by AZ Department of Public Safety

The Arizona Department of Public Safety will conduct an independent investigation of the bloody Black-Friday arrest of a Walmart shopper.

Jerald Newman, 54, was knocked unconscious after a Buckeye police officer performed a "leg sweep" on him while arresting him on suspicion of shoplifting. (UPDATE: The officer's name has been released: Kevin Rorke.)

The story of the Black Friday arrest (which actually occurred late Thursday night) went viral, boosted by a graphic video shot just after the take-down of the limp and bloody suspect.

Newman's family contends the suspect, who was later booked into jail on suspicion of shoplifting and resisting arrest, had merely tucked a video game in his waistband to either help his grandson or prevent an unruly mob from taking the game from him.

Whether or not Newman was resisting arrest has become a major question in the case. A CNN reporter who happened to be at the store on Thursday says Newman wasn't resisting as a cop led him away.

Buckeye police, as we reported on Friday, insist that Newman had tried to conceal the game under his shirt and had yelled "I'm not going to jail!" during a "tug-of-war" with the officer.

Buckeye Assistant Police Chief Larry Hall told us on Friday that the store surveillance tape should provide good evidence.

We agree -- and that's why we're suspicious that the tape hasn't been released yet. The public would likely have seen that tape by now, if Buckeye PD had it, and if it showed that the officer was justified in using force. We sent a message this morning to Hall asking about that, but he didn't answer the question.

Hall did say, however, that Buckeye PD asked DPS to conduct an independent review of the incident.

DPS spokesman Bart Graves then confirmed that DPS will investigate the criminal aspects of the case, including whether the officer was justified in knocking Newman to the ground, but that Buckeye PD will conduct its own internal investigation to determine whether the officer violated any department policies.

A Walmart representative said someone from the company might call us back today. We're curious whether the store security guard who suspected Newman of shoplifting saw what preceded the violent leg-sweep maneuver. We also asked whether the surveillance video has been released to police.

I hope that this victim will win and win big in a law suite against Buckeye pd & walmart.My hope is that Buckeye city council will take notice and fire this Buckeye chief of police that's where the responsibility starts and ends because it is the chief of police that sets the unspoken policy that condones this type of excessive use of force.This Buckeye police officer could of used a more civil & humane tone with this alleged shoplifter he was not brandishing a gun or a knife according to store eyewitnesses he was Cooperating with the buckeye police officer.In this case there were a store full of eyewitness.Imagine what if this same Buckeye police officer pulls you over by the side of a dark road and in front of your family and with out warning proceed to use excessive force to affect an arrest on you just a thought not a very pretty one is it ? what i am saying is that excessive use of force is the issue here. All police officer need to know that we will not be victimized we are the tax payers they work for us what ever happened to serve and protect they need to start to change the way they treat us and instead of we fearing them they need to respect and fear us for a change.God bless America & our bill of rights.

...won't be shopping, staying or even driving through Buckeye, AZ. There was never a threat to that officer. If there had been, the store surveillance tape would be all over the media. This is starting to look as if Walmart's lawyers have the tape and are hanging on to them until some sort of settlement can be reached with the Newmans. Without a subpoena I wonder if they are even required to turn them over to the Buckeye PD.

A video game is not worth almost killing a man for.   Cops these days have no common sense.   If the cop can't handle a guy like this without using his Bruce Lee moves then he shouldn't be a cop.   Handling the situation outside and away from others who might have been hurt would have been the best call.   That would also have helped their extremely important shoplifting case which is apparently now punishable by the death penalty in Buckeye.   I wonder why people hate cops?  Because they display shit like this, disrespect people and know they'll get away with it.  But we sure better line up and show respect when the next officer dies in the line of duty, right?

Unless you were there and actually saw what happened, to form an opinion is as asinine as your comments! I personally was there and witnessed what happened. Everyone is questioning the PD's actions, but who's questioning the "grandpa's"? He shouldn't have acted that way in front of his grandchild and put himself in that situation and more-over, what idiot places items under the shirt, in their purse, etc in a store that they haven't yet paid for, regardless of the reason?!?! Think about that for a bit. Lastly, he wasn't "leg-swept" for shoplifting, he was taken down for resisting arrest....

I saw the video. The video that was show was after the beating had already occurred and the man could file a lawsuit from the PD's lack of knowledge on what to do with an unconscious person. Turning him was a no-no. Forcing his hand behind his back to cuff him when he could have had a serious neck/spinal injury was stupid. He was unconscious, so it's not like he was gonna get up and walk away or fight the police or something.

And he was taken down by thug police that were protecting Walmart from theft, apparently the only thing they care about instead of people's safety.

A CNN reporter was there and he states that the man was not resisting arrest.  From the reaction of the crowd in the video, it seems pretty clear that the police were the bad guys.  I can only hope the store video will provide enough information for justice to prevail.

sheesh, that kinda shit was happening in the 90s. I remember reading about a lady that was driving on I-10 through Louisiana and she got picked up by the cops cause she was "hot". The arrested her and put her in a cell and kept her in jail from around a year with no charges just so they could rape her.

Once you conceal an item you can be stopped for shoplifting.You do not have to leave the store.That is Arizona law.It's called "willful concealment".

Stores tend to prefer to have people  pass through the checkout line and attempt to exit before stopping to secure the case.  Walmart's policy is to do this.
