Obama Administration Now Plans to Target Advertisements for Medical Marijuana Dispensaries in California

What's Obama smoking? After declaring years ago he wouldn't expend federal resources on medical-marijuana users, his administration's now waging a full-scale assault on weed.
President Obama doesn't just want to seize the property of California medical-marijuana dispensaries and hit them with huge tax bills.

Now the Obama Administration plans to prosecute people who place ads for dispensaries -- and possibly the newspapers that print them.

One of the four U.S. Attorneys in California, Laura Duffy, told online news site California Watch and California radio station KQED that she intends to move against the dispensary industry's advertisements, California Watch reported today.

Duffy told reporters:

"I'm not just seeing print advertising ... I'm actually hearing radio and seeing TV advertising. It's gone mainstream. Not only is it inappropriate -- one has to wonder what kind of message we're sending to our children - it's against the law."


The article further states:

Duffy said her effort against TV, radio or print outlets would first include "going after these folks with ... notification that they are in violation of federal law." She noted that she also has the power to seize property or prosecute in civil and criminal court.

Duffy said she believes the law gives her the right to prosecute newspaper publishers or TV station owners.

"If I own a newspaper ... or I own a TV station, and I'm going to take in your money to place these ads, I'm the person who is placing these ads," Duffy said. "I am willing to read [the law] expansively, and if a court wants to more narrowly define it, that would be up to the court."

Duffy also hinted that the state's other three U.S. Attorneys soon would look at pot-dispensary ads, too -- she noted that last week's demand that all dispensaries close down is a coordinated effort by all four of the state's top federal prosecutors.

California Watch talked to an attorney who said media outlets could face trouble because of federal law that prohibits the advertising of illegal drugs.

Newspapers, which have seen declining ad revenue in recent years, have benefited from the ads related to the medical marijuana industry. Many ads don't deal directly with dispensaries, instead advertising doctors, grow-lights, or other ancillary businesses. Dispensaries themselves do place prominent ads in California and Colorado -- even on TV.

It seems like Obama's doing his best to shore up the moralistic teetotaler vote.

I just thought of something else... Isn't advertising the same thing as Free Speech???? And didn't the Supreme Court just rule that business actions, and donations are covered as  "Free Speech"??????  Just a thought.

It will be interesting to see what the fall out from all thedraconian behavior is. With 70% of the population being pro legalization of medicinal marijuana,what can the government possibly be thinking? The only possible explanation isthat Obama must bend before his contributors to gear up for the election, andbig pharma and the prison unions have made their agendas pretty clear.

Are they going after the adverts of /ALL/ dispensaries, collectives, and/or co-ops in California?  Or only those entities operating outside the bounds of California law (must be organized as a co-op or collective, non-profit, et cetera; and the feds would like them at least 1000' from schools, parks, and other child-magnets)?  If they are going after the bad actors, fine (this was what the Ogden memo instructed, IIRC), but if they're shooting everything that moves, we have a problem.

When's the last time they, (the U.S. Government) came over to your house and had a heart to heart with you and yours. There is so much crap in our country, it's really a sad story to know. I know... what happens in the next year, and you have at least half the country or more with some medical marijuana law on the books??? And last time I checked... making or passing a medical marijuana law or laws wasn't one of the PROHIBITED powers/rights that STATES  don't have in the Constitution.  It's just the opposite..

You sure about that 70%? Not sure how that squares up with the teeny-tiny victory in Arizona and the blow-out against in South Dakota. Maybe Obama's more realistic.

Its not okay to break the law... But it also has to be a law that is Constitutional. Remember, just this summer after 2 centuries the Supreme Court finally said individual people could now file a complaint for far over-overreaching Federal Statues.  Prior to that, only states could really challenge most Federal Laws. Creating the Controlled Substance Act and a ton of other laws isn't one of Congress's Enumerated Powers.

 Hey, remember this.....  We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness........  Though the part of pursuit of Happiness didn't make it in the Constitution, it still matters. 

 Liberty means to do what ever one choose's to do as long as that action does not infringe on someone else's Constitutional Rights. And besides the Federal Government is supposed to be one of Enumerated Powers----Limited. Thats what the United States Constitution says. We the people are supposed to have Unenumerated Powers and Rights under the Constitution. The Ninth and Tenth Amendments confirm that.

Especially considering the victory in Arizona: even during a Tea Party surge in a hard core Republican state, in a non-presidential election year we passed it. Hardly any people in SD, so they hardly count in a national sense.
