Andy Thomas Longtime Shill Barnett Lotstein Gets To Spin One More Time

To hear Barnett Lotstein tell it, ex-Maricopa County Attorney Andrew Peyton Thomas was willing to sacrifice his political career in order to do the right thing by going after alleged "corruption" in county government

Lotstein spun, um, testified this morning at the ongoing disciplinary hearings regarding his former boss, Thomas, and onetime deputy county attorneys Lisa Aubuchon and Rachel Alexander.

Thomas and Aubuchon face potential disbarment for a slew of alleged ethical violations. Alexander is looking at a possible suspension of her license to practice law.

Lotstein was a special assistant to Thomas whose main job for years was media spin control, something that became more ubiquitous during Thomas' second term in office and the fierce battles against the county Board of Supervisors and judiciary heated up.

 
Lotstein told the panel hearing the case that, in 2008, he learned that County Attorney Thomas was "looking into" possible criminal wrongdoing concerning real-estate transactions involving Board of Supervisors chairman Don Stapley, East Valley developer Conley Wolfswinkel, and Phoenix attorney Tom Irvine.

Lotstein said he advised Thomas about the "unique difficulties of prosecuting elected public officials, and that Thomas himself likely would become the focus of a defense effort to divert jurors from the facts of any such case.

The evidence would have to be "almost incontrovertible," Lotstein said he told Thomas, such as in the early 1990s prosecutions of several Arizona legislators (AzScam). Some of those elected officials were caught on videotape accepting bribes from a man who turned out to be working for law enforcement.

Lotstein told Thomas that his targets would seek retribution, no matter the outcome of the investigation and/or prosecution.

This is where violins should start playing in the background.

"His response was he didn't care," Lotstein said of Thomas. "He wasn't concerned about the politics, he was concerned about whether [Don Stapley and the other men] had broken the law."

Same went for the later-aborted racketeering civil lawsuit that Thomas and Arpaio filed in late 2009 against the county's legislative and judicial branches (naming several individuals), and others.

Lotstein claimed that the so-called RICO lawsuit was Joe Arpaio's idea, not Thomas or Aubuchon's, and that he (Lotstein) advised his boss not to be a plaintiff in the case, just a lawyer.

Lotstein said he was surprised to learn that Thomas had ignored his advice, because the racketeering suit was "doomed to defeat" unless it was unassailable.

(Note to Barnett and company: The whole political-with-a-capital-P deal was eminently assailable on just about every front, which in part is why Andy and the gang are in such hot water with the State Bar of Arizona.)

Almost as an aside, Lotstein said he had no idea if the allegations that were being tossed around about dirty county politicians, judges, lawyers and what-have-you had merit. He was just there to provide advice on the inevitable fallout of going down that road.

It felt a bit like a deja vu, Lotstein saying whatever came to him in a transparent effort to help out his guy Andy. 

Maybe a part of him still hopes that Thomas will weather this silly little ethical wrongdoing storm and make a political comeback a la Richard Nixon. Then, just maybe, Thomas will repay Lotstein with yet another gig.

So, was Lotstein outright lying on the stand?

Some around the County Attorney's Office have told us in the past that the old boy lies every time he opens his mouth.

We won't go that far, but his spin sounded so flippin' vacuous.

Yes, Andy Thomas is a true believer, a zealot who lives in a world of black and white (we don't mean racially).

But Thomas also is a professional politician, and we are sure as shootin' that he and his top associates in and out of his former office discussed all aspects of what it could mean to his future by going after other elected officials and sitting judges.

Screw, by the way, the lack of evidence! (Remember Andy Thomas announcing the bust of Judge Donahoe, but being utterly unable to describe whom Donahoe had bribed or for what specific gain? Remember Rachel Alexander's recent bleatings to the disciplinary panel about getting those "smoking guns" sometime down the road?) 

Hell, Thomas' scheme almost worked out for him: 

He missed by a whisker (900 votes) of  becoming the Republican nominee for Arizona Attorney General, an office later won by his rival Tom Horne.

And that close electoral call occurred after the Thomas/Joe Arpaio debacles involving Judge Donahoe, the bungled and bogus RICO suit, and other highly publicized, highly charged, and highly expensive (financially, personally and otherwise) issues. 

Testimony is scheduled to resume tomorrow morning in the Thomas/Aubuchon/Alexander hearings.

If memory serves me, Lotstein was one of the lawyers (Spaw being the other) that told Candy Andy that the RICO suit was "doomed to defeat" unless the evidence was "incontrovertible."

I agree with Gerry 100%. I don't give a shit if Candy Andy and the Miscreants sacrificed their careers for "the right thing." They abused the trust and confidence of the very people they were sworn to protect.

And didn't the MCSO shurf say he didn't recall if he came up with the idea for the RICO suit? Keep in mind that this is the same Flaccid Fool that came up with the brilliant idea to charge Judge Donahoe with the three felonies for issuing rulings against him and Candy Andy.

Here's an idea: Just disbar all three moronic boobs and save the taxpayers the money of a trial and a defense. Candy Andy and the Miscreants have no chance of getting out of the ethics charges.

I have watched Barnett Lotstein's testimony over and over again and what I can truly see, is Barnett is lying, and lying through his teeth.  Everyone reading this should review his testimony and watch how much he's squirming (he realizes the F.B.I. is reviewing his testimony) when he gets on the stand, watch his all-around-body language (review a good web-site on how to detect a lie).  Although It's my own opinion and people can agree with me or not, I really believe that Barnett knows much more than he's testifying to (He had a personal interest in all these cases, I.E. - if all these worked out, Andrew Thomas was going to be higher up on the political chain, and Barnett was his right-hand-man, getting the perfect job, from there on out!)  However, it didn't work out that way and now there is a current F.B.I. abuse of power investigation in process, and if any indictments come out, he will be implicated.  If you review his testimony, Barnett said one thing that really sticks out.  Just in case somebody says I took Barnett's quote out of text, I didn't.  I would suggest reviewing his whole testimony, but if you don't want to, go to 50:00 to 51:00 (his quote is somewhere between 50:20 to 50:28) and listen to it - "he wasn't concerned about politics, he was concerned about whether or not, these guys have broken the law....or whether Mr. Stapley has broken the law".  Now, it may not sound like much, but if you review Barnett's statement and how he says it exactly, it shows you the true sinister nature of the Maricopa County Attorney's Office (Andrew Thomas had a plan the whole time)!!!  {"he [Andrew Thomas] wasn't concerned about politics [the Board of Supervisors control their budget], he was concerned about whether or not, these guys [think of the R.I.C.O. case] have broken the law....or whether Mr. Stapley [This is where Barnett realizes he has spoken a little too much and quickly changes his statement from - these guys to Mr. Stapley.] has broken the law"  The only sad thing is, for the most part, most of everyone reading this right now, doesn't like Thomas and Arpaio, but I hope a few people that read, that haven't formed an opinion about the two yet, can come up with something.

I did like when Barbra Mundel was called back today and she DIRECTLY contradicted what Henderblimp claimed on the stand.

Henderblimp thought he could stop the new Court towers by putting 2 courtrooms in the CONDEMNED Madison St Jail?  And Blimpy has a watch collection, with belts to replace the wrist straps so they would fit around his chubby arms!

Only 90 minutes of hearings today.  I but Tues will be a biggy

The only people who have sacrificed anything since Thomas got in office are the residents of Maricopa County. How many innocent people lost their freedom because of that sick man?? How many are rotting in prison that dont belong there? Nobody cares about any of them..personally, it makes me sick that the only reason Thomas got in trouble was because he went after the ones who had the money/power to defend themselves. We all know there are countless others who weren't as fortunate. Andrew Thomas-take responsibility for all of the innocent lives you have forever ruined and then go kill yourself.

I don't give a damn about Andrew's career or that he sacrificed his integrity and soul.  What pisses me of is that he sacrificed our Maricopa County Attorney's Office and our confidence in persons we elect into positions of high power.  That damage may never be undone.

so really their plan to make these people lose their jobs is actually working.  they've lost any public trust they have.

All this over budget cuts!  Jho probably assumes who every comes in to replace them will scrap the tower and give Jho unlimited funds to wipe his but with.

All of the so called "fiscal conservatives" should be outraged that Jho had a hissy fit when his budget was cut during a major recession.

Tell me one thing.  If he didn't do this, we wouldn't be having this conversation right now, and he would most likely be the Arizona Attorney General, doing the exact same thing you talk about, but with more power!  Now, truly think about that and be thankful that it took him abusing his power against his political enemies to be found out, because, if he and Arpaio didn't do this, he would have never been exposed otherwise!!!
