Governor Jan Brewer Appeals SB 1070 Case to Supreme Court

Arizona Governor Jan Brewer wants to take SB1070 all the way to the U.S. Supreme Court.

Governor Jan Brewer wants to the U.S. Supreme Court to take a look at Arizona's contested immigration law, SB1070, following the law's shoot-downs in lower courts.

"I am hopeful that the U.S. Supreme Court will choose to take this case and issue much-needed clarity for states, such as Arizona, that are grappling with the significant human and financial costs of illegal immigration," Brewer said today in a written statement.

Just before the law that Brewer signed was to take effect last year, U.S. District Judge Susan Bolton halted key provisions that would have allowed local police to arrest illegal immigrants almost at will and made it a state crime for immigrants to leave home without their ID.

The Ninth Circuit Court upheld Bolton's injunction earlier this year.

Along with Brewer's statement, State Attorney General Tom Horne said it was "shocking" that the Circuit Court claimed Arizona shouldn't interfere with "foreign policy, a federal monopoly," and scoffed at the way foreign countries disagree with SB1070.

If the Ninth's ruling isn't overturned, "this country's sovereignty is in trouble," Horne stated.

When in doubt -- exaggerate.

The Supreme Court may need to take up the Arizona question, though, because of another state that passed an SB1070-like law, Georgia. In June, a federal judge also blocked similar provisions of Georgia's new law.

If Supreme Court justices don't take a stab at Arizona's law, they may find themselves dealing with a logjam of similar appeals.

This is about grandstanding, not immigration enforcement. This is about slamming the door completely to the wrong kind of people, not about rational immigration policy.  Brewer and Horne are both idiots, under the skirt of Russell Pearce, who is under the skirt of Kris Kobach. The feds have literally hundreds of border patrol agents, arresting hundreds, while Brewer is cutting money to schools and universities, but somehow, not to private prisons who would house aliens.  This is not policy but grandstanding.  We don't need 51 different border patrols with different standards. Please get emilycali some meds, fast.

alien invaders are not immagrints, there's a hell of a big difference, when you enter any country without the proper paper work, and you milk our federal and state system,by breeding a whole bunch of vermon, and state a claim, that your kin is american and therefore you have rights like your kin, makes you a common crimina! we donot not owe mexicans varmon, any thing, they need to payback for the entittlements they were not entittle to in the frist place! then get the fuck out of here and take thier anchor monkeys with them. And wake up America!, these are not latin people, they donot desend from spanish blood, they are aztec trialbal savages, who grunts when trying to communicate with americans!l

Brewer said it best -- Obama and his cronies aren't doing their job so she has to do it for them.

So these imbeciles we have as our state leaders want 50 different immigration enforcement agencies?  I guess 51, with the federal goverment.  AND THESE ARE THE PEOPLE PREACHING ABOUT SMALLER GOVERNMENT???

Another action at the expense of taxpayers to embody an aura of wonderfulness to the dunderhead known as Mrs. Brewer. She of limited education and intellect, being guided by a mindless missile known as the Pearce Scudder, destroyer of open-thinking and intelligent beings.

Why would SCOTUS give a Tinker's damn about a state law intended to usurp federal law?

It won't even be heard.

who would actually want a law on the books that allows the police to detain folks without a warrant or placing them under arrest?

what happens when the illegals are gone and they still have this law?  who will they come for next.

This is not about immigration so much as it is about the freedoms and liberties that are granted to american people.   Don't take my rights from me!

Must have been some last-minute changes.  I noticed they cited a 1941 case that Pennsylvania lost, and the "Table of Cases" put it on Page 30.  It ended up on Page 29.

It's been said that people generally have the governments they deserve. If that is true, Arizona is in big trouble.

The governor should work on the problems her party created that have failed the people of Arizona. The Feds are deporting more illegals immigrants then ever before. People do  not want to come to Arizona -- there is no work. Others are trying to sell their homes and leave the state.

I couldn't agree more, but the people on this blog are mostly hopeless about the danger Arizona is in. It doesn't seem to bother them at all. Neither does the sovereignty of their state against a powerfull central government that will not protect them from one of the most corrupt and violent nations in the world. Instead they are exclusively focused on personalities. It's strange. Thank God, there are more rational heads living in Arizona.

And . . . neither is Brewer.

I doubt they will hear it.  After all, it is just an appeal of an injunction.  We have appealed the injunction for nearly a year.  Would it not have been more efficient to just fight the case in Bolton's courtroom?  It might be close to over by now or scheduled at least.

I don't think Brewer, Pearce, or Horne want this case disposed of as long as they can say they have are and done did fighted for Arizona.  There is political value in keeping the case alive.

We shall see. If it is heard, racial profiling won't even be mentioned.

It you're white, profess religious beliefs, speak clear and fluent English, and have an expired Arizona identification you shouldn't have to worry.

J. You're pissing into the wind. You need to remember Mrs. Brewer has been living off the government teat most of her adult life, and she is being guided by a senate president who has never held a job in the private sector in his entire adult life. Not to mention he's been fired at the county, state, and senate levels in the jobs he has held.

pearce is not impressive. Mrs. Brewer is less impressive, if that's possible.

Privately financed.  If they weren't collecting donations for this losing lawsuit, they would be collecting donations to build a fence.

That's not about Obama, who is being used to cover-up their decades of failed policies that has sunk Arizona. So now you want to put the corn vendors and cleaning people in Arizona's prisons rather than cleaning up your messes no one else will do and spending $$'s in the state, contributing to social security they'll never get to see....all are so shortsighted and ignorant.

If you are in the country legally, you also won't have a problem. There is zero evidence to support your slanderous innuendo. ICE seem to have no problems enforcing the federal version of the same law. I hear no one screaming racist comments at them.

I don't care for sb1070. Those who commit crimes and are here illegally are already being identified and turned over to ICE anyhow. That being said, I hope it is heard and the nineth circuit is overturned just to listen to Gallindo and you other open borders idiots froth over.

Come off it Tommy, that is nothing but the typical leftist instigation and stirring of the racial pot. How long will European-Americans have to put up with it?

build a fence you say,no take all of these monkeys back, then bomb the whole country, and that will be the soulition. end of story

The private money is gone (or close to it).  Maybe she can steal the "build a fence" fund, as that will never be used.
