Tempe Cop Accused of Stealing Evidence Pleads Not Guilty -- Despite Already Telling Cops He Stole Evidence

Court officials tell New Times that a Tempe cop accused of stealing evidence from one of the department's evidence rooms has pleaded not guilty to charges of theft and evidence tampering.

In total, Officer Elliot Campbell's charged with two counts of theft of a credit card, 10 counts of tampering with evidence, and one count each of forgery, burglary, and theft for allegedly stealing loads of valuable evidence.

Campbell, an 11-year veteran, was arrested in May after an investigation revealed he looted the department's evidence room and used the items he stole -- including several gift cards to various retail stores -- for a little home improvement.

The Arizona Registrar of Contractors Office began investigating Campbell in April regarding his performing contract work without a contractor's license.

The investigation revealed that Campbell was driving on a suspended license. He was placed on administrative leave pending the outcome of the investigation, which ultimately found he'd been stealing evidence.

During the course of their investigation, authorities searched Campbell's squad car and found envelopes checked out of the department's evidence room in March 2008. Additionally, detectives found that Campbell also had checked out a refrigerator, a clothes washer, a watch, and some tools from the evidence room. He told employees in the evidence room he was planning to return the items to their owners, which is why he was allowed to take them.

It was later determined that the gift cards Campbell had checked out were used at Costco and Target stores near the officer's home. A search of his house turned up the watch and the refrigerator. The washing machine, Campbell later told police, was given to a friend.

Campbell's next court appearance is scheduled for August 10.

A few years back I allowed someone to stay in my home who was down on her luck and apparently was into identity theft. I ended up kicking her out over some property of mine that came up missing. Anyways, a few months after she left Tempe pd served a search warrant on my home. I told them I hadnt spoke to her in months and my computer was password protected, she had never used it. Even though the warrant said they were to seize HER computer to search for evidence of credit card fraud they ended just taking mine instead..and guess what?? There was no evidence anything illegal was ever done on my computer. Nor was there anything to suggest she ever touched it. I waited about 3 months and school was starting back up so I asked for them to please return my laptop...Tempe pd's response: "the only thing you get by kicking up shit is the smell of shit"!! What was the officers actual response when I asked for my property back..

Now I know why they never returned it...it had already been returned to one of their homes.

Wow..its like deja vu. That is the same officer who did that to me. Your story us identical to mine. What are the odds? They took all the computers in our home in hopes of findind evidence of a crime that did not happen, which of course resulted in me never being charged with any crime. The kicker in my case was that I live in mesa so they were actually serving a warrant outside of their jurisdiction for something that I was no part of. They never returned any of the 4 computers they took either. Can anyone tell me, are the police allowed to keep someones property if it is determined you never commited any crime?? Also, to the other person who posted, who was the judge who signed off on your warrant???

It varies from state to state and city by city but basically you have to motion the court to have any evidence returned.  It usually has a 30 period in which you have to do this.  Most people do not know that they have to request it.  They are generally told by the police when they don't need the evidence it will be returned.  What they forget to mention is that you have to initiate legal proceedings to do this. 

I think a legislative bill changing this needs to be looked into.  Perhaps it's a good time for someone to do this.

You will have to check your state laws, but yet in some states they can take your property and then they can keep or sell like they do to the items that belong to criminals. They don't even have to charge you with a crime or take it to court. Ah, justice.

It's the quality leadership in Tempe that lets cops like this think they can get away with anything.  When they all see the jackass of a police chief, Tom Ryff......lie, cheat, terrorize citizens they get the impression they are allowed to do those things to and not have any negative consequences.  I know me saying this and putting my name puts me in that line of fire again from the police chief and his pitiful followers.
