Gilbert Police Chief Tim Dorn Won't Explain Harsh Stance on Medical Pot Law

Gilbert Police Chief Tim Dorn takes a harsher stance on medical marijuana than other Valley police authorities. He won't say why.
​Gilbert police are taking a harsher stance on the state's new medical-marijuana law than other Valley police agencies, but Police Chief Tim Dorn can't be troubled to explain his policy.

 

Dorn's hiding behind his spokesman, Sergeant Bill Balafas, who tells New Times that we won't get an interview -- or any justification for Gilbert PD's policies -- from the chief.

Weak.

Dorn's apparently the driving force behind his officers' recent decisions to raid the home of a qualifying patient, arrest another patient and bust a pot patient co-op in Tempe.

Meanwhile, other Valley police agencies approach the voter-approved law differently.

The law states clearly that authorities should presume weed is being used medicinally if a valid cardholder possesses less than the statutory maximum of 2.5 ounces.

Phoenix police, for instance, figure that if someone they encounter has a little weed and a valid, state-issued card, the possession is legal. That's how voters intended the law to be interpreted. 

We got into it on the phone today with Balafas, who grew frustrated with our questions about the varying policies among local police.

"We're enforcing the law," he says stiffly.

Another way to look at Gilbert's actions, though, is that Dorn doesn't care about the law.

The new medical-marijuana law, that is.

He certainly seem to care about marijuana prohibition laws. But why does he care so much?

That's another question the taxpayer-funded bureaucrat won't answer

Remember these guys when at the voting polls... I hope these guys that got busted unlawfully sue the "Town of Gilbert" into bankruptcy and file civil suits against each and every officer envolved in the busts... Police can be personally held liable for there actions in court... What a great time for a lawyer to take a stand pro Bono for the chance to get his name out there as the MM patients protector... He/she would clean up....!

The law is very poorly written and allows for differences in interpretation. it is obviously also being used to shield criminal activity. This law is a joke. Please either decriminalize the shit altogether and scrap this bullshit half assed attempt at circumventing federal law.

He's declared himself the Chief Justice of the Gilbert Supreme Court.    I guess he forgot that cops are supposed to enforce the law, not interpret or make up their own which seems to be the prevalent attitude of our beloved boys in black, with a dozen shiny stars to match their shiny bald heads.   Since when did cops start wearing service ribbons?    If they want to act like they're in the military then make them go back in or join.    Sickening, egotistic and immature.     Let's all join the neighborhood watch and spy on our neighbors.    We too might get to wear a storm trooper outfit.    I want the silver death skulls and lightening bolts on mine.

This really isn’t good for people visiting Gilbert or those people who live there. What part of the law do they not understand?? Maybe they need to contact the attorney general… oh wait that’s not a good idea either. I’m no expert… but what happens when someone breaks the law?? They get in trouble and sometimes go to jail depending on the crime. Now what should happen with the people who are given the job to enforce the law… and break it? Now should an example be made with this group? I thought any police officer that is charged and maybe convicted with domestic violence or other felony related crimes could no longer be a police officer?? What happens when police officers violate someone’s Arizona Constitutional rights under our constitution? And violate the oath they swore to protect and uphold????

I did see that.. and saw someone who gave an answer on how they could go into another city. I still thought they couldn't go into another city without approval. Obviously MSCO, and DPS can go a bit further than the city police... just because the jurisdictional borders.  The poster used a doctor as an example.. that they could practice any where in the state.(medical licence) And that a police officer is state licensed. Good argument... but the doctor doesn't work for a city, and have jurisdiction in his job description.

He's a former MCSO staff member, so maybe that explains some of it.   The reason he's avoiding, is because he doesn't have an answer.  He probably had no clue, and I'm not sure I'd expect a Chief to know everything his cops are doing, even in a small department like Gilbert.

Probably because the Gilbert PD is knee deep in the drug trade and their cartel masters don't want to lessen the profits they make because lax enforcement would make their "product" less profitable - thereby making the kickbacks to the GILBERT PD get reduced.

He is currently enrolled in a master of arts program in criminal justice studies.  Ray, go interview his professors and fellow students - might have some interesting comments about his "participation" in classes (e.g., he may have stated flat out that he was not going to comply with the law created by Prop 203 - this would provide evidence of willful violation of the law).
