Andrew Thomas' Apparent Defense for Upcoming Bar Hearing: A (Taxpayer Funded) Trial for Don Stapley

As disgraced former Maricopa County Attorney Andrew Thomas continues to piss away taxpayer money preparing for his upcoming state Bar ethics hearing, his apparent defense is becoming more clear: attack Maricopa County Supervisor Don Stapley.

County sources tell New Times Thomas' attorney, Don Wilson, has subpoenaed Gila County Attorney Daisy Flores, asking that she turn over boxes of documents used in her investigation into the county supervisor.

Wilson didn't immediately return our call this afternoon, but the theory, we presume, is to vindicate Thomas by trashing Stapley at the hearing.

The problem for Thomas, obviously, is that he's failed -- time and time again -- to prove that Stapley's broken any laws. Not to mention, his political witch hunts are the reason he's in such hot water in the first place.

After the second round of indictments against Stapley were turned over to her office, Flores wrote a letter to Maricopa County Attorney Bill Montgomery, in which, she called the behavior of Thomas and the former deputy county attorney he used in politically charged cases, Lisa Aubuchon, "egregious."

She noted that while some crimes may have been committed, they were unprosecutable because of the behavior of the prosecutors.

"The vast record is littered with behavior so egregious ... that a reasonable person's sense of fairness, honesty, and integrity would be offended," she wrote. "It seems unlikely that any other elected official in Maricopa County has had their personal life subjected to this level of scrutiny.

"Importantly, the prior prosecutors [Aubuchon and Thomas] in this matter abdicated their roles as ministers of justice and their conduct was so egregious that we are unwilling to even attempt to justify it."

County sources say the documents Thomas' attorneys seek isn't just a manila envelope full of papers -- it's more like boxes (and boxes) of documents that will take a lot of billable hours to sort through. But what does Thomas care? The county's picking up the tab for his legal bills.

Initially, the BOS granted Thomas $100,000 -- in taxpayer money -- to defend himself in his upcoming hearing. He's already ripped through at least $86,000 of that money, and a hearing date hasn't even been set.

With boxes of documents to sort through -- and county cash pay for it -- there's a new candidate for best job ever: Andrew Thomas' attorney.

Thomas' ethics problems revolve around whether he did or did not have evidence to support his actions.  Did Thomas have reasonable suspicion, probable cause, or evidence for to advance an investigation.  Just because Thomas can now claim that Stapley committed crimes does not let Thomas off the hook for his actions at the time. "I told you so." is not a valid reason for prosecutorial conduct outside the rather lumpy sphere of legal ethics.  What is key is what Thomas had when he was acting unethically.

I'm not a real supporter of two wrongs make a right.  However, I think it's time for a fire or a flood or something to render these files useless.  Thomas should face charges for waste/misuse of public funds if he continues his money wasting game.  If Thomas had a case, he would have made it a long time ago. 

He's just being pissy now, trying to get everyone riled up (at the BOS) because he's going to bury his attorneys in paperwork and bill the BOS (as in us, Maricopa taxpayers) for all his games.  This is about holding Thomas responsible for Thomas' actions; I'm not going to loose sight of that fact and I doubt the judge or hearing committee will either.

Joke's on him.  Playing games instead of lawyering is the exact behavior that caused him to face disbarrment in the first place.  Does he really think more of the same is going to save him?

And the two shots at prosecuting Stapley were only a part of Thomas' malfeasance.  What's Thomas going to use to defend himself for all the other crappy political BS cases that got tossed and all the inappropriate unethical and shameful press conferences/public statements?

Seriously think about it.  Thomas is down by 6 points, on 4th down and 12 to go at his own 8 yard line.  And there are just 13 seconds left in the game.  The only play you can call is a Hail Mary Pass.  The only Hail Mary pass for Thomas that might possibly be plausible is trying to prove that Stapley did actually do something wrong.

Andy must feel this is like playing Fear Factor for real.

I did not finish my statement.  Thomas knows he is going to lose the game.  That is why he is trying to defend his indefensible actions by prosecuting someone else.  I suspect that actual proof that Stapley did something wrong may not carry much water.  Thomas went after that following his order to stay out of these conflicted cases.  Further, much of that evidence was gathered without probable cause.

I can reveal that Aubuchon charged Judge Donahoe with the three felonies and is convinced he's guilty.

I know she's convinced everyone she and Thomas charged, sued, indicted and tried to indict are guilty (that includes the RICO conspiracy lawsuit).

I also know that she and Thomas charged Stapley with the 118 counts and both knew that the 44 charges were outside the statute of limitations.

I know that she worked with the MCSO shurf to order the arrest of Tom Lovejoy because she didn't get the verdict at his trial she wanted.

Brilliant comment. It's strange how truth rings out loud and clear. The reign of terror he and his cohorts brought upon the state will have the taxpayers of Arizona paying for decades in increased convictions (200,000 since 2005), alarming rate of growth of incarceration of women, juveniles and the mass industrial prison complex that is Arizona. He left a mess in the MCAO which was swept under the rug -- time for an outside independent investigation of these cases. This is a much bigger issue then Stapley. What about all the innocent "ordinary" people whose lives were shredded under the Thomas/Aubuchon/Alexander reign of terror? Terror is having one's life thrown into an unjust criminal justice system with deep systemic problems that put an individual in Arizona's mass industrial prison complex that devours lives and their assets.
