Kid-Killing Rapist Donald Beaty's Execution Put on Hold

A clerical error has resulted in a stay in the execution of Donald Beaty, a kid-killing rapist on Death Row for more than two decades.
The Arizona Supreme Court has issued a stay in the execution of kid-killing rapist Donald Beaty because of a last-minute switcheroo in one of the drugs used to put him down and a clerical error made by state officials.

Beaty's attorneys reportedly objected to the last-minute substitution of the sedative pentobarbital in place of the commonly used sodium thiopental in the three-drug cocktail used to execute the convicted murderer.

The switch in sedatives was made yesterday after federal officials said the state did not fill out a form needed to bring the new drug into the country. But that's only after anti-death penalty groups whined that the sodium thiopental being used for executions in Arizona wasn't approved by the Food and Drug Administration.

The supply of sodium thiopental has dwindled recently because its domestic manufacturer stopped producing it. For other recent executions, the state told the court it acquired the drug from an unnamed British company that wished to remain anonymous because it feared a backlash from anti-death-penalty groups.

The problem, opponents of the death penalty argue, is that the drug's safety can't be guaranteed because it hasn't been approved by the FDA and the inmate may suffer some pain before dying -- a pretty weak argument, considering the drug's purpose is to act as one component of a cocktail of drugs designed to kill. It makes about as much sense as disinfecting the injection sight before an execution.

Beaty was convicted of the 1984 rape and murder of 13-year-old Christy Ann Fornoff.

On May 9, 1984, Fornoff, a newspaper carrier, was collecting money along her paper route at the Rockpoint Apartments in Tempe.

Beaty, a custodian at the apartment complex, abducted the young girl, raped her, and then suffocated her. He kept her dead body in his apartment for two days before leaving it behind a dumpster at the complex.

On July 20, 1985 -- more than 25 years ago -- Beaty was sentenced to death and placed on Death Row, which is where he's remained for more than two decades.

Luckily, death warrants are good for 24 hours and the court is conducting a hearing this morning to determine whether to go forward with Beaty's execution, despite the clerical error.

It amazes me how some people can witter on about 'cruel and unusual punishment' when this scum of the earth deserves the most painful and horrible lingering death that man can devise.

Why does it matter what chemicals are used in the execution of this beast or where they came from? The poor young girl that he violated and brutally murdered had no say in how or when she died. In my opinion the USA took a step backwards when it substituted the electric chair, gas chamber, hangmans noose or firing squad, in favour of the more humane lethal injection. The death penalty should serve as a deterent, retribution, and to ensure that the killer does not kill again. The lethal injection method of execution, which in reality is merely a form of euphanasia, only scores on the last point!Here in England, our soft liberally minded politicians voted to abolish the death penalty (against overwhelming public opinion), many years ago .. and society has suffered the consequences ever since, what used to be in my youth, a pleasant and peaceful land is now not safe to walk the streets in. I fear that liberalism is creaping into the political will of the USA, if it ever does God help America!

In his written submission he stated to the Court that they had no right to kill him because he fucked and killed an innocent child, reciting the Biblical Genesis story in which The Holy Dude does not take the life of Cain after he killed his bro., Abel. I can't believe that this person got to live another day because  of a drug mishap. Give me a shovel and I will do it myself. I was living here in Phoenix when this animal killed this little girl. He should have been dead 2 minutes after he was convicted, not 27 years later. What is wrong with our legel system?

YAY! Looks like Justice will be served after all.....latest news update says The Arizona Supreme Court and a federal judge will not block the execution, and lifted the stay. Let's hope this is the end of his pathetic malingering and that this whole 27 year nightmare is close to coming to an end. Get that needle ready guys, Beaty has a first class front row seat waiting for him in hell.

If the drugs being used are causing a problem the legislature should pass a different method of execution.  Burning at the stake would work for me but I'd settle for a firing squad. Just make sure the ammunition used is made in the USA.

There is so much of interest here.  It turns out that the company that used to produce it here domestically moved its operations to Milan, Italy.  As usual, all jobs get exported out of this country.  Anyhow, Italy does not allow Hospira to export their drug to America -- oops.  Then a small manufacturer Dream Pharma, which according to the New York Times (3-30-11), operates out of a the backroom of a driving school in London, began to supply the drug, but even that company has now been prohibited from selling to the U.S. for executions.  So, we are now down to using drugs that are of unknown quality in humans.  Frankly, when I look at the rapists/murder's face on this article, I almost want him to suffer for his crime -- but that is not what is mandated in our Constitution.  No CRUEL & unusual punishment -- and my passionate hatred of the crime this man committed is no substitute for impartial justice.

I see here that James King makes the comment that the fact that the inmate suffers pain is besides the point when the object is to go beyond pain and kill him.  I do not agree.  Botched executions have happened before even Sodium Thiopenthal is not infallible.  The Nation published an article, dated May 12, 2011, detailing some of these "problem" where executions have gone wrong.  There is a big difference between executing someone in a humane manner or torturing him with a caustic substance running through his veins and causing excruciating pain until death.  That is just unusually cruel and clearly violative of our Constitution.

 I know that?  How do I know that?  I am not a doctor?  I am not in the business of creating, using or administering these drugs?  Are you?  What we do know is that if these drugs are ineffective or have expired, we fail to live up to our Constitutional mandate.  The Supreme Court authorized the lethal injection process as humane -- but if the formula is changed and botched executions keep happening, we cannot say we are following the rule of the law?  Do you want us to disregard the rule of law?  Are you for the rule of law or are you not for the rule of law, which is it?

It makes me sick.....like people think someone could go around dismembering people or something and then we're gonna sit there and go "Oh, but wait....we have to make sure he gets put to death painlessly, because its humane". Humane??! Where was humane when they kill these people? If they show no regard for others, why do we give a crap about how they die? To be the better person, or turn the other cheek? They only deserve what regard they gave to human life- and if they take lives, they forfeit theirs. Simple as that. People want to call that "eye for an eye" - fine. But you know, seemed to work pretty well in the old days of civilization. I believe it was in Babylon- if you stole once, they cut your hand off. Twice, they cut your other hand off. If somehow, you managed to steal a third time, they cut your head off. The three strikes policy. I think we should go back to the days when the punishment fit the crime!

Of course I care about the law, but not enough to complicate a simple issue further with bureaucratic nonsense. The drug they want to substitute for has been proven to work and is being used as a substitute now in many death penalty states. There are provinces in the law that allow for these kind of substitutions in Arizona to be made by the warden/prision bureau, etc - so they have done nothing wrong. In addition to that, there is no specified list of drugs made on his death warrant, which also gives them the leeway to make substitutions. This sort of wrangling should only be seen if the warrant said he was to be injected with specific things.....it doesn't say that. These public defenders for him are now continuing to add insult to injury by actually arguing that this drug which is an effective proven substitute, which Beaty even ACKNOWLEDGES and says he does not doubt it works, they are only arguing about this because they weren't notified about it until Tuesday night so they could "investigate the effects of the drug against his medical history"? Horse shit. The effects of the drug for him will be the same as for anyone else- it will put him under so the other drugs can kill him. So lets quit all the wasted time arguing over something that AZ had a perfect right to do, and just kill him already. This isn't about "lowering ourselves to his level"- this is about justice. You can say anything you like- Christy wasn't YOUR friend. You didn't know her. She is a news story to pretty much everyone here that's commented. I was her friend. So to me, this is personal. This is about him getting what he deserves, and closure.

 You are all wrong on this.  It is not about caring for murderers and rapists like this guy.  I really do not like him -- but it is about keeping the integrity of the system.  We cannot appear to be a lynch mob -- or freaks who delight in the torturous suffering of another.  Just because that criminal is a monster is does not mean we need to lower ourselves to that level and salivate at his painful end.  His execution was determined in a reasoned well thought-out and deliberated manner -- this is not about an eye for an eye -- it is about justice in accordance with our law.  Do you care about our law?

Umm, I think you misinterpreted Chrystal's remarks. She doesn't want the government running roughshod over people's rights, you don't want the government messing with your right to spend your money as you see fit (re. healthcare). Basically, you're both on the same page here. In the end, this guy will be executed and the health care brawl will continue to be misunderstood and subjected to simplified, knee-jerk opinions..... especially, one would guess, in Arizona. 

I have no sympathy for a miscreant like Beaty. You can take him out tonight with a rubber mallet, for all I care. But health care is a very complicated issue that will have to be dealt with sooner or later. 

I happen to know Bruce Babbitt. He is what (in your state) might be thought of as a "typical liberal"and is a strong supporter of universal health care. Yet he also stood with your mother and passed the IAM law. Arizona prospered when he was governor, but there was some sanity prevailing in the state in those days. I mean, it was before you could legally carry a concealed weapon into a bar. Sounds to me that before too long you folks are gonna need healthcare in a big way out there. And, sadly, Babbitt probably couldn't be elected dog catcher today. Oh well, you still have J.D. Hayworth......

Christy Ann Fornoff was my friend. My mother actually became an advocate for/with the family and founded IAM (Individuals Against Molestation) which ended up launching a bill to lengthen the jail terms of child molesters as a direct result of the aftermath from Christy's murder and the BS they found out about Beaty. The law was signed into effect by then Governor Bruce Babbit, with my mom standing by the day it was signed (she even got to keep the pen it was signed with). I was only 5 years old when this sick piece of sh*t took her away from everyone she loved and who loved her. Now that I am 32 with kids of my own, to have protesters and bureaucrats and idiots all worried about whether or not HE's in pain during the execution?! I don't recall Beaty making sure Christy felt no pain or that her death was humane when he was suffocating and raping her. If I had things my way, true justice in the death penalty would mean that the killer suffers whatever fate they dished out.....if you're sick and mutilate someone or dissolve them in acid or something, that should be exactly what's done back to you. And we could have robotic machines carry it out, so that no one is getting a free pass at just killing someone, even for the death penalty. Now THAT would be a crime deterrent for sure!

However, based on what I read, this guy committed depraved indifference homicide and rape, no doubt. He needs to go. And quick.

This comment is a perfect example how liberals and their general views are ruining this country. If it was something where a person or a group who mattered were having their rights violated....then maybe I would agree. But this d-bag gave up any rights he had to claim himself a member of the human race when he mercilessly killed my friend. She was such an innocent kid. What about HER rights? The rights my mom fought for for all the other kids in this world. THAT is what matters right now. He's been tried, convicted, sentenced....and now a date set. I was reading that this guy had published that he was a good Samaritan at some time in his life, rescuing an old lady from harm or something similar.  This was held out as a redeeming quality that should life him instead of execute him. 

This reminded me of Arpaio.  Some would have us support Arpaio because he does pink underwear and goes after illegals.  These redeeming qualities should soften his corrupt operation of the MCSO. 

I say kill Beaty already.  Also throw Joe out of office at a minimum.  Redeeming qualities are great, but one should live their life like that.  Not to have something to point to when they show their negative qualities.

It was actually a 17 year old woman he claimed to have "helped" who had been hit by an out of control driver outside Graceland after Elvis Presley passed away and people were gathering for the funeral. He didn't even do anything to help her, he was just in the background of the photo near someone that was helping her. After the girl got surgery and treatment for her injuries....Beaty began calling her and followed her around, even when she moved to a different state! Telling her she ought to marry him after all he went through to "help" her. Turns out, the girl said all he did at the scene was pat her knee once?! So it finally took the girl's and some of Beaty's family members to give him a ticket to AZ and tell him to step off and quit stalking her.....if you ask me, that should have been the first clue something wasn't right with this guy. It was a foreshadowing of dark things to come.
