Arizona Dems A-OK With Jan Brewer's Push to Get SB 1070 Injunction in Front of Supreme Court

Governor Jan Brewer announced this morning that she and Arizona Attorney General Tom Horne plan to ask the Supreme Court to lift an injunction that has prevented several parts of Senate Bill 1070, Arizona's controversial immigration law, from taking effect -- and that's just fine with Arizona's Democratic Party.

"We agree that the fate of SB 1070 should lie with the U.S. Supreme Court," Arizona Democratic Party Chairman Andrei Cherny says. "Arizona has a serious problem with criminal cartels that smuggle drugs, guns, and humans across our border. Whatever the ultimate decision as to its constitutionality, SB1070 won't solve this problem. Let's settle this legal debate once and for all, so our state can move on from political games to real solutions on border security and comprehensive immigration reform."

Last month, the 9th Circuit Court of Appeals refused to reverse a federal judge's order that prevented certain aspects of the law from taking effect, namely a provision that allowed police investigating other crimes to ask a person about their immigration status if they have reasonable suspicion that the person is in the country illegally.

Brewer says appealing directly to the Supreme Court -- and bypassing the traditionally liberal 9th Circuit -- saves time

"The decision of the 9th Circuit Court of Appeals to uphold the suspension of key provisions of Senate Bill 1070 does harm to the safety and well being of all Arizonans, who suffer the negative effects of illegal immigration," Brewer said this morning. "So instead of appealing to the...9th Circuit Court, my legal team will soon file an immediate petition with the (United States) Supreme Court to lift the injunction of Senate Bill 1070."

The state has until July 11, to file its petition.

I feel compelled to point out that Krentz would have likely been murdered 1070 or no 1070. People are murdered all the time, immigration laws be damned. I doubt anybody takes immigration law into consideration if they are going to kill someone. Pearce advocating for law and order is like listening to Charlie Sheen tell you not to do drugs.

In this case, the state now needs to show that its hardships from not being able to enforce the law outweigh the hardships placed on the federal government.In its ruling last month, the majority of the 9th Circuit accepted the arguments of the Obama administration that allowing Arizona to pursue its own immigration policies undermines the ability of the federal government to set and conduct foreign relations. But state Senate President Russell Pearce said that ignored the other side of the equation.“Rob Krentz was murdered during the debate of 1070,’’ he said, referring to the Douglas rancher killed last year, a case that has never been solved. “That’s not a real hardship I guess.’’

Did anybody find out that an illegal immigrant killed Mr. Krentz?

It's not likely the court will agree to even hear arguments.

Don't forget Tommy, Pearce was once MCSO's chief deputy, similar to the Pillsbury Doughboy (Hendy). Pearce has an undying loyalty to the Flaccid Fool because Pearce's laws benefit the Senile Spinster. Also, I think 3 of Pearce's sons work in law enforcement.

What Brewer & Co. don't seem to get is that the U.S. Supreme Court doesn't even have to hear their petition for the constitutionality of 1070.

Even if the U.S. Supreme Court agrees to hear the issue, the odds are not in Brewer's favor for a ruling.

Any changes to immigration will have to come from Congress and President Obama.
