Joel Fox Files Federal Lawsuit Vs. Goddard and Cox Communications Over Release of "Zorro" E-Mails

Joel Fox filed two federal lawsuits this week in apparent response to New Times' publication of love letters between him and his boss at the Maricopa County Sheriff's Office, Larry Black.

The first lawsuit targets former state Attorney General Terry Goddard and three employees of the AG's office; the second, Cox Communications. Fox argues that a search warrant served on Cox Communications as part of the SCA investigation was only good for one e-mail account. Instead, Cox released the contents of four e-mail accounts, including one created as jdzorro@cox.net.

It was under the "Zorro" account that investigators found letters in which the two middle-aged men professed deep love for each other. Fox, who clearly enjoys a warm keyboard, wrote hundreds of words to his boss about his feelings. There's mention of happy hours alone in a Los Angeles hotel room on a stormy night; the pair also bonded (emotionally, anyway) during their roadtrip to New Orleans after Hurricane Katrina.

Black denied the relationship was homosexual when asked about the e-mails by curious SCA investigators.

Besides Goddard, the lawsuit names the lead investigator of the SCA case, Mike Edwards, Donald Conrad, chief counsel for the AG's criminal division and Todd Lawson, and assistant attorney general.


Portions of the Zorro e-mails have been published online, in print, and on TV, Fox writes. "Had it not been for the callous and careless actions" of the state investigators, the e-mails would never have been available for public display, Fox states.

The defendants' "shocking behavior has caused serious damage to Plaintiff Joel Fox and his family," the lawsuit says.

He also seeks the return of two of his personal computers, which the state apparently still possesses.

In the Cox case, Fox argues that the communications company exceeded the authority of the search warrant when it handed over all of his e-mails to the state.

In Fox's mind, the whole SCA case was a politically motivated witch-hunt, cooked up by the Democratic Party and its sympathizers. He's seeking punitive and other damages.

Actually, Edwards' case is compelling on a number of fronts and presents strong evidence of a conspiracy between sheriff's deputies and state Republican Party leaders.

Fox and Black, whom he calls the most important person in his life in the letters, remain on paid administrative leave as a wide-ranging internal investigation goes on. Fox also filed a $5 million claim against the county last month.

Wow! This what our money goes to? This also reminds me why I can't stand Cox. I actually know Joel Fox personally.. can't say he's the most charming person in the world but he has some likeable qualities.. I do not know him outside of work. My opinion of him has dropped a bit since he has filed this ridiculous lawsuit. We have all been through mental anguish and suffered at the hands of beaurocracy and most of us just move on and don't want windfalls because of it. I think enough is enough here. He should take his generous retirement and go. He and Dave Hendershott should go into business together.

For 2+ years, we have head Fox give a story on the little SCA thing about how he opened an account and people just heard about it and tossed in more than 100 grand. I always felt that he was protecting Hendershott and Arpaio with his stonewalling and to a lesser extent Larry Black. I never understood how or why Fox would go to ruin to maintain his story.

But now, I believe that he was not protecting any of them out of honor. He was protecting Larry Black because of a deep and lasting love they share.

By the way, I opened an account and told a couple people about it. But nobody put any money in.

Although Fox ends each lawsuit with "Pro Se" (indicating he's representing himself), closer examination of the two lawsuit documents indicates he has someone (lawyer?) helping him.

Check out SCA report PDF 1, pgs. 51-88 for examples of Fox's typical writing. Note pgs. 59 & 60 definitely appear to have been written by someone else with some legal expertise, ie NOT Fox. Why is any lawyer helping him write letters and lawsuits without legal representation?

Can someone with some legal knowledge explain why Fox would have been advised to file these lawsuits in Federal court instead of State court? I would have thought State court to be more appropriate.

The documentation in the SCA report surely casts Fox as a foolish person; by choosing to represent himself, Fox has removed any doubt as to that fact.

Seems to me he's just pissing into the wind...

He is alleging a plethora of constitutional violations, thus he is citing United States Code and must file those violations in Federal county. State court has no jurisdiction regarding Federal code.

The Sheriff IS a criminal. Of that there is no doubt whatsoever.

Of course Arpaio "COULD" have put an end to this. And as I recall, he pleaded ignorance about the SCA funds. An ethical honorable elected sheriff, not knowledgeable about that secretive SCA campaign funding mechanism on his behalf, WOULD have at least publicly expressed disapproval of his underlings' unlawful activities, if not demoting or firing them.

Why would Joel file 2 federal lawsuits in this case? The Attorney General's Office is a government entity, and therefore not subject to federal jurisdiction. Cox Communications is the ISP that provided Joel with his e-mail account, and also not subject to federal jurisdiction. Cox can view anything Joel sends at any time......

Goddard enjoys personal immunity. As do the individual lawyers Fox mentions.

If Joel did nothing wrong and has nothing to hide, why sue? It only makes him look guilty and stupid.

The designation of account at cox is the master account. That us the personal account. Accounts are not assigned to the master account. Rather, authorized users are assigned access under the master account by the master account holder. The account includes all authorized users.

The cox terms and conditions spell it out pretty clearly. In fact I think that that you agree to pay cox for attorney fees if you fail to initially arbitrate over such an issue.

FR, when reading the wit that Joel has writ, it occurs to me his rationale (if one can give it that designation) is VERY MUCH like that of folks named Thomas, Aubuchon, Hendershott, etc.

There simply is no rational logic involved and written law really doesn't pertain to them. They all simply make up their version and interpretation of law. Who does that sound like? Pearce? The Flaccid Fool? John Orr?

The nuts don't fall from the tree. In this case it's hard to determine if the tree is pearce or the county shurf....

Also, I read in a post someone commented on the irony of Fox not liking what he calls a lack of probable cause for search warrants on his property. Since when is probable cause needed in Maricopa County, Mr. Fox? The business practice of MCSO seems to be one of conducting a search and then building probable cause based on what might have been found. Hence, the 'fruit of the poisonous tree' doctrine.

The MCSO delivered, if I remember correctly, a very high profile search warrant on the BOS (Stapley's Office and Stapley's staff) and it was the EXACT same search warrant (adding a staff member) as was served on Wolfswinkel out in Tempe. Somebody "forgot" that there was ABSOLUTELY NO PROBABLE CAUSE to serve a search warrant at the BOS offices - except that Arpaio and Hendershott couldn't wait for the whole media circus to begin. Remember that Hendershott Jr. was the "forensics guy" front and center and smiling for the cameras. How many deputies searched the offices that day?
