Jared Loughner Charges: Feds to Have First Crack at Tucson Shooting Suspect; State Charges to Follow

Federal prosecutors will get the first crack at Tucson shooting suspect Jared Loughner.
The U.S. Attorney's Office and the Pima County Attorney's Office issued a joint statement this morning outlining how prosecuting Tucson shooting suspect Jared Loughner will go forward.

Loughner, who authorities believe is the lone suspect in the January 8, shooting rampage at a Tucson grocery store, currently faces a three-count indictment in Arizona's federal district court for the attempted murders of Congresswoman Gabrielle Giffords and two of her aides.

With six people dead, and 13 others wounded in the attack, Loughner is facing a slew of other charges that have not yet been filed. Federal statute requires the suspension of all state or local prosecutions while the federal case is pending, so state charges will be put on hold until the feds finish their case.

Subsequently, Loughner will remain in the custody of the U.S. Marshals Service as his case moves through the federal court system.

After that, it's the state's turn.

From the joint statement:

Our offices have jointly agreed to a process that Loughner will first be prosecuted on federal charges by the U.S. Attorney's Office. As required by the statute, once those charges have been fully prosecuted through the federal court system, Arizona state charges will be prosecuted by the Pima County Attorney's Office.  These cases will be tried in sequence and will ensure that all rights of the victims and their families are vindicated.

Meanwhile, Giffords continues to make a miraculous recovery after the shooting.
In remarks at the National Prayer Breakfast in Washington on Thursday, her husband, Mark Kelly, said Giffords "gets a little bit better" every day, noting doctors tell him her progress is "a great sign."

Mr. Loughner, his aegis advocate may try to prove that he suffered arbor I brainy action arch him to anticipate rationally binge identity. If the balloon attorneys can prove that he is schizophrenic, and again the board could not acquisition him accusable above a reasonable doubt.

I do not believe in State sanctioned execution of anyone, not even Jared Loughner. There have been way too many historical examples of how easily an innocent person (particularly if they are Black or Hispanic) has been wrongly and maliciously incarcerated and/or executed based solely on the promulgation of someone's fraudulent testimony. There is no forensic evidence, DNA or otherwise, that is not subject to mistake, whether by accident or deliberation. I doubt, however, that anyone would question the guilt of this man. That the primary target of his assault was State Representative Giffords does not diminish the importance of the six humans that were his more successful targets, and all those others wounded.I do not know Mark Kelly, but will give him benefit of doubt that he is not a punitive or unnecessarily vengeful human being, given his profession, and that perhaps getting Loughner's face off the front pages would better serve his and his wife's recovery.Multiple prosecutions - in this case - are quite redundant and will run into months and the millions of dollars. I bet that none of the scores of people affected by Loughner's insanity would have any problem conglomerating all charges, federal and local, into a single proceeding, as we all know what the outcome of it will be.No, I can't vote to kill Loughner, as that is what his psyche allows for; and the Death Penalty does not deter murder, never has, never will.I don't make the rules. But I do grow tired of the 6th. Commandment getting shoved up my ass, while all the good Christians decide its Ok by God... to kill a killer... in the name of GodSteve Tracy, Phx.

Hey, don't they give astronauts a lot of extra "citizenship" priviledges? I'm gonna suggest that the "gendarms" allow Astronaut Kelly the opportunity to deprive Loughner of his cajones through a process of him being lashed spread-eagle to a large wheel and allowing spaceman Kelly to proceed to literally kick his nuts clean out of that killer's sack. I mean, Loughner won't need them anymore where he's going does he?
