DNA Match From 2004 Chandler Rape Nets Orange County Transient, Santos Basilio O'Dell

A California man forced to give up some DNA after violating a protective order last year revealed a dark secret, prosecutors say: He's responsible for a 2004 rape and robbery in Chandler.

Santos Basilio O'Dell, 32, was ordered to stop harassing his wife in 2009, and he violated that order in April of 2010. As part of his probation agreement for that faux pas, he had to "donate" a cell sample.

The DNA data was run through national law enforcement dababases and came up with the Chandler match.

ORANGE COUNTY MAN TO BE EXTRADITED TO ARIZONA FOR 2004 RAPE, KIDNAPPING AND ROBBERY COLD CASE AFTER DNA HIT * Defendant's DNA collected as part of OCDA Public Safety Crime Prevention and Deterrence DNA program

SANTA ANA - An Orange County man will appear in court tomorrow for an extradition hearing for a 2004 rape, kidnapping and robbery cold case in Arizona after being linked through DNA taken as part of the Orange County District Attorney's (OCDA) DNA program. Santos Basilio O'Dell, 32, was arrested Feb. 2, 2011, by the Newport Beach Police Department (NBPD) on an Arizona warrant for a 2004 crime that occurred in Chandler, AZ. O'Dell is being held without bail and is scheduled to appear in court for an extradition hearing tomorrow, Thursday, Feb. 10, 2011, at 8:30 a.m. in Department C-55, Central Justice Center, Santa Ana.

On Sept. 12, 2009, O'Dell violated a protective order by contacting his then-wife through text messages and harassing phone calls while going through divorce proceedings. He was charged by the OCDA March 5, 2010, and pleaded guilty April 7, 2010, to one misdemeanor count of violation of a protective order. O'Dell was sentenced to three years of informal probation, a 1-year Batterer's Treatment Program, and ten days of community service.

As part of the plea agreement and the OCDA Public Safety Crime Prevention and Deterrence DNA program, the defendant was required to provide a DNA sample. O'Dell's DNA was submitted to the national DNA database, Combined DNA Index System (CODIS).

After the submission, the Chandler Police Department (CPD) in Arizona received a CODIS DNA hit Sept. 1, 2009, linking O'Dell to an unsolved rape, kidnapping, and robbery case. A Chandler police detective contacted the OCDA and NBPD for assistance on locating O'Dell, who was living as a transient. Once an arrest warrant was signed in Arizona, the defendant was arrested by Newport Beach police officers with assistance from an OCDA Investigator and a CPD detective.
