Cops got a call about 4:30 p.m. Saturday to a home on Fairmount Street in Phoenix. A 19-year-old witness living next door to the home said he was looking for dirt to use for gardening when he looked over the fence and saw 34-year-old Sixto Jimenez-Cruz and his 17-year-old neighbor, who has Down Syndrome.
According to court documents obtained by New Times, Jimenez-Cruz "had the victim bending over and was pulling down her pants and at the same time taking his penis out of his pants."
Because she suffers from Down Syndrome, the victim, experts claim, has the mentally of -- at the very oldest -- a 10-year-old.
The witness told his mother, who went to the backyard, saw what was going on, and yelled for the girl to go back inside before calling police.
The witnesses and the victim were taken to the Childhelp Center where the victim told a forensic interviewer she was coaxed out of her house by Jimenez-Cruz, who invited her to "come on."
Once outside, the victim told police, Cruz-Jimenez pulled down her pants and touched her "front private." Just to be a total son-of-a-bitch, Cruz-Jimenez allegedly "poked" her anus with his finger, too.
Cruz-Jimenez denied the allegations and lawyered up before police could question him further.
He's been booked on two counts of sexual abuse, and one count of public sexual indecency. Because he's not a legal U.S. resident, police recommended Cruz-Jimenez not be granted bail.
