State Case Against SCA & Joel Fox Appears Dead; No Indictments Coming on Goddard's Watch

​State Attorney General Terry Goddard will leave office without resolving the case against Maricopa County Sheriff's Office Captain Joel Fox and the shady SCA fundraising group.

And that, it's safe to say, means almost no likelihood of criminal charges - on a state level, anyway.

Which would be a shame, because this scandal looked so cut-and-dry: Larry Black, one of Sheriff Arpaio's top aides goes on a fishing trip in Alaska with a few rich folks, including local developer Steve Ellman. The rich folks cut huge checks to help Arpaio. Captain Fox and Black meet with a Republican Party operator, and soon the money (plus more money donated by other top sheriff's officials) is used to create a vicious smear ad targeting Arpaio's political opponent, Dan Saban.

State investigators have been on the case for about a year and a half, interviewing witnesses and seizing Fox's computers. We routinely heard rumors that they were on the verge of announcing an indictment, but it never happened.


Now, with Goddard preparing to turn over the keys to AG-elect Tom Horne on January 3, we thought it was a good time to ask him whether the SCA mess would be resolved on his watch.


"We don't expect to have anything this month," says his spokeswoman, Janey Pearl.


And Goddard won't be AG next month.


Don't tell us that Horne, a Republican, will do anything, either. It doesn't take a political genius to understand that Horne won't begin his new career as AG by attacking Arpaio's office.


Perhaps U.S. Attorney Dennis Burke has something planned. But if not, it looks like Fox and company are off the hook.

Maybe there's hope if Dennis Burke has been provided all the investigative information. I always assumed that the SCA fund matter, corruption of the highest order and just one of many examples of flagrant wrongdoing by MCSO, was presented to the federal grand jury.

Tuesday night Tom Horne was interviewed by Ted Simon on Horizon. When he was asked about Russell Pearce's plans to violate the 14th Amendment, Horne said he'd have no problem supporting the proposal. But more than that, my jaw dropped in disbelief listening to him spout misinformation about the history and intent of the citizenship clause, contrary to the facts, that even were provided by New Times with copies of the pages of the May 30, 1866 Congressional Globe. Horne also wanted to justify the Pearce proposal by claiming "subject to jurisdiction" means something it does not mean, and was long ago shot down when the Pearce camp began spouting the same nonsense.

Either Horne was knowingly lying or he was winging it from the Pearce propaganda. It will be interesting to watch if attorney Horne will find his own road to ruin by being a follower of Russell Pearce, same as attorney Thomas has done by being a follower of Joe Arpaio.

That's an interesting comment, Ray...Horne won't want to begin his AG term attacking Arpaio's Office. You obviously recognize that Democrat Terry Goddard didn't mind attacking Arpaio's Office at all, even though it produced nothing.

But wait a minute...

Why wouldn't Horne want go after Arpaio, before the feds go after him? Arpaio is going to be 81, next time Horne runs for office. It hasn't seemed to hurt John McCain, in statewide elections, that he and Arpaio don't get invited to the same parties. There is probably more harm to Horne, from supporting Arpaio, than from catching the indictment train before it leaves the station.

have to recall ,that Joe , had Goddard under an headhold from M.A.C.E. , even when Andy said there was No investigation on Goddard , Joe countered Andy's statement .

keep a hold over Goddard , kept the S.C.A. in hold .

now , Horn can either move it forward . or Drop it .

he drops it , the feds can pick it up and run with it , and if Horn takes it up , then he comes arround to be a M.A.C.E. target himself .

any which way this turns , Joe would be then , trying to trump justice ......

just let the S.C.A. play itself out . maybe . it . by itself will be a whole new entire chapter in the show

Perhaps I could have said Horne wouldn't want to be perceived as attacking Arpaio's office, but no matter. The concept of "attacking" doesn't imply the attack is unwarranted -- and it's certainly warranted in the SCA case, in my humble opinion. C'mon: Fishing trip, Baker meeting, denial of Hendershott involvement -- heck, did you read the Munnell memo?

As usual, you miss the point. I have never been surprised by questions and expected them as soon as I saw the ad run. A prosecution, however, is an entirely different matter, particularly when it is based more on a political attack against Arpaio than it is based on the facts.Aren't you and your employer opposed to baseless, factless, politically motivated prosecutions? Or is that only when your flexible morality leans that way?
