Lisa Aubuchon Wanted "Hundreds" of Teens Interviewed During Dale Fushek Case, Probe Transcript Reveals

​Of the all the cockamamie things we've heard Lisa Aubuchon did while at the Maricopa County Attorney's Office, this has to be the weirdest.

And yet, it seems so -- Lisa.

Five years ago, the story goes, while building the case against the disgraced, defrocked priest, Dale Fushek, Aubuchon wanted to use grand jury subpoena powers to bring in "thousands" of teenagers as a way to collect more evidence.

Mark Stribling, the investigations commander at the office who has 30 years' experience as a Phoenix cop and special investigator, revealed Aubuchon's strange suggestion in April during the office's internal probe that led to the deputy county attorney's firing last month.

Aubuchon is under investigation by the State Bar and U.S. Justice Department for possible abuse of power: She was the would-be dragon-slayer for former County Attorney Andrew Thomas, taking on his politically charged cases -- and getting scorched in failure.

The transcripts from the internal investigation about Aubuchon provide a fascinating and comprehensive look at the behind-the-scenes dealings by key players in the county saga. More to come later on what's in that treasure chest. 

But for the moment, back to the Fushek case:

Stribling, during his interview with lawyer Kate Baker, who was hired by Interim County Attorney Rick Romley to help with the internal investigation, said that Aubuchon outlined her wishes for the case in a 2005 memo.

"And the first section is the part about -- where she states that if these teenagers weren't cooperative, that we should consider subpoenaing them to the grand jury," Stribling said, describing how the office was trying to find out how many minors Fushek had potentially abused. "She was suggesting that, if we couldn't get people to just come and tell us, that we could possibly subpoena them to the grand jury. And, as I pointed out, that would have been hundreds of people."

Earlier in the conversation, as mentioned, Stribling had said it was "thousands." We hear it was about 1,500, but don't have a copy of Aubuchon's memo to verify the number.

The very notion of trying to interview that many people, just to ask them if they knew anything, seems to have sprung from an unhinged mind. That simply isn't the way it's done in this country -- or possibly any country.

Stribling said he made it clear to Aubuchon that such a move would be an "abuse of the grand jury and it would be a fishing expedition."

In retrospect, it looks like there was a motive to suggest such a ridiculous, time-consuming project: The case against Fushek was sensational, but not so easy to prove in court.

After five years of prosecution, Fushek pleaded guilty only to one misdemeanor count of assault. He got probation.

Stribling notes the Fushek case as one of major example of disagreements he had with Aubuchon.

Another was in 2008, during work on the first criminal case against County Supervisor Don Stapley.

The case against Dale Fushek began the day Andrew Thomas took office and ended the day Andrew Thomas resigned. During that time, not one minor ever came forward to claim that Fr. Dale had sexual relations with them. It is no wonder that the County Attorney's office wanted to haul "thousands" before the grand jury. They couldn't make their case but were willing to intimidate and destroy many innocent people to further their political ambitions.

Believe the Children!

There have been a number of common threads in the various false charges of child molestation, but if I can find one phrase that has tied all these cases together, it is, "Believe the children!" Mothers marched in Manhattan Beach, California, after the McMartin School case fell apart under prosecutorial lies; mothers and supporters of the prosecution in the Edenten 7 case made similar declarations, and who can forget "Believe the children!" in the utterly-discredited Wenatchee, Washington, fiasco.

Now, there exist other common threads, including prosecutorial bullying, destruction or hiding of exculpatory evidence, hostile judges, score-settling, unsubstantiated rumors, charges that are grounded in fantasy ("magic rooms," and worse), and all of these are present in the trial of Tonya Craft. In fact, these common threads are why I am utterly skeptical about these charges, and the fact that the judge and prosecutor have resorted to outright bullying and lying tell me that they know they don't have a legitimate case.

In this post, however, I want to concentrate upon the "Believe the children!" mantra. When all else fails, and when the defense has poked holes in the prosecution's case, we hear people demanding that we "believe the children," but we forget that if we REALLY were to believe the children, we would have believed the children WHEN THEY SAID THAT NOTHING HAPPENED.

With every case, what we have found is that the children at first said that NOTHING happened, and only after they were browbeaten by therapists and their parents, only then did they come up with the fanciful stories upon which the criminal charges were based. We have to understand that even the parents DID NOT BELIEVE THE CHILDREN, at least at first. Only when the children gave answers that the therapists and the children wanted to hear did we start hearing "believe the children."

Samuel Johnson once wrote that "Patriotism is the last refuge of a scoundrel." I would like to add that "Believe the children" is the last refuge of false accusers. As Dr. Demosthenes Lorandos told the jury today in the Tonya Craft case, if we are to believe the children, then we have to believe ALL of the children, including the ones who say that nothing happened.

It appears to be common practice within the county attorney's office. These self-proclaimed "child-savers" are in fact child abusers. Aubuchon could do whatever she wanted under Thomas. She had no checks on her unethical and illegal behaviors under Thomas. I don't know, but would not doubt that many of these acts were encouraged by Andrew Thomas, Arpaio, Hendershott, and others. Certainly at the end, Hendershott was trying to protect Lisa from her fate when Thomas left.

I look forward to more installments. Lisa is quite possibly cooked. She bet her career on making Thomas and Arpaio look good. I think she may well have lost the bet.

I know Lisa's SOP, I have been in Lisa's crosshairs. As one of my attorneys put it "she plays dirty pool".

Lisa's propensity towards unethical behavior goes beyond Thomas. Thomas recognized this and took advantage of it. Lisa just got bold under Thomas' reign of terror.

You are completely right that there may be thousands of innocent people convicted and imprisoned by these corrupt indivduals.

When the MCAO prosecutors accuse a person of sex abuse/child abuse, they call minors "children" not the "teenagers" others knew they were. They paint a picture in the media, legal documents and court of a "child". So using their SOP, Aubuchon wanted to interview "thousands of children.." in a sex case scandal. Besides being hard on the eyes, she's hard on the rationale. NOBODY with any sense would attempt to obtain that many subpoenas. And it ended up, for whatever it's worth, as a misdemeanor.

EVERYTHING this sweat hog touches turns to crap. Can't WAIT to see her brought to justice. I'm pretty sure she could get tons of people to testify against her WITHOUT a subpoena. There's no love lost for her ANYWHERE in the professional arena.

Who are the real child predators, when once you "go after" children and question them, you've exposed them to even more abuse? These numbers are outrageous. Andrew Thomas bragged about his 200,000 convictions during the Primary in his run for state Attorney General. Sounds like Fr. Fushek's case is the tip of the iceberg of malicious prosecution and prosecutorial misconduct under his/Aubuchon's reign of terror on the state of Arizona. An outside independent investigation of these should be demanded so the innocent are released from prison immediately! It's time for "Conviction"'s Barry Scheck to come to Arizona like he did in Texas when DA Craig Watkins came in as a new DA. Wonder if Montgomery has the same integrity as Watkins did at the time. Watkins refused to sign legal paperwork to destroy all the old files on cases that preceded him. That's truly commendable and courageous. All eyes will be on Montgomery who he says West Point taught him integrity.

To Single Childless Womanizer, You hit the nail on the head! But even more tragic is what has been done to Arizona's successful single moms raising her child/children. Rather then helping mother and child/children, they are being destroyed by malicious prosecution in favor of fathers. Women in Arizona are seen and treated as "less than" -- which goes along with the single-minded culture of intolerance that is well established in Arizona, a backwater state. Children are taken from their moms and given to their fathers living with girlfriends/2nd wives. It is well-known that Aubuchon sides with fathers (who have the money for the "vote") against the mothers who work to keep the family together. This article confirms how Aubuchon operates -- with little regard for children and the abusive impact of "interviewing" with an established pattern of coercion. Other then getting an "easy" conviction using innocent, vulnerable and naive children, this tactic should not be allowed-- this is child abuse.

As we've watched the ongoing witch hunts taking place for years in the Maricopa County Attorney's office and Sheriff's department -- destroying lives everyday at will, I'd take Father Dale as a leader any day over Thomas/Aubuchon/Arpaio and their enablers who have played God with peoples' lives in Maricopa County and the state of Arizona for far too long! These are the officials who belong in prison -- and for decades for the lives they have destroyed, along with Arizona's future. I agree, they are very sick minds.

This outstanding article shows the public a sick mentality that permeated the Maricopa County Attorney's office under the direction of former County Attorney Andrew Thomas. There is a bias in these cases that makes one wonder how anyone could get a fair trial in a highly charged child sex case. Thomas needs to be disbarred, indicted and imprisoned. His 200,000 convictions that he bragged about during the Primary is enough to bankrupt the already broke state of Arizona. Conservatively 10% are innocent, that = 20,000 people, plus their families, children's lives, careers and future destroyed! And Aubuchon wanted to "interview" 1,500 children??? That is what we call "child abuse" by the government.

Michal, We find it strange, that those, like Thomas/Aubuchon who profess to "save the children" are the same ones who destroy them. If "interviewing" thousands of children is not child abuse by the government, we don't know what else you would call it. To put them through the horrors these encounters is an unspeakable crime.
