Pinal County Sheriff Paul Babeu Takes Reins of MCSO Investigation, Says David Hendershott Should be Put on Leave; What About Arpaio?

Sheriff Paul Babeu

Pinal County Sheriff Paul Babeu recommends paid leave for Sheriff Joe Arpaio's chief deputy, David Hendershott, while he investigates allegations of corruption in Arpaio's office.

In a news release e-mailed this evening, Babeu brushes off the claim today by supervisors Mary Rose Wilcox and Don Stapley that he's not the right person to conduct the investigation. Babeu says Frank Munnell, the deputy chief who penned the damning memo with the allegations, agrees that the Pinal agency can handle the case fairly.

Meantime, Babeu says he told Arpaio that Hendershott, Deputy Chief Larry Black, and Captain Joel Fox -- the key players in the SCA election scandal -- should be put on paid leave during the investigation. (Arpaio's already put Fox and Black on leave.)

According to the news release:

This leave includes no use of MCSO equipment including email and cell phones and no access to MCSO facilities. Sheriff Babeu further has asked today, that all individuals involved in the investigation be admonished. This means none of the parties involved are permitted to speak with anybody concerning this investigation with the exception of investigators or attorney's.

The Pinal County Sheriff's Office will be conducting the administrative portion of this investigation and all parties involved will be afforded complete due process. The investigation will be unbiased, professional and in the end will be based solely on facts.

To assist with this investigation, Sheriff Babeu will be hiring outside special counsel and other expert staff to assist him with this high level investigation.

Here's the problem with all this: Babeu must suspect strongly, as anyone with half a brain would, that Arpaio knew all along what Hendershott was doing. That, in turn, means Babeu must know that Arpaio's decision to send Pinal the case is suspicious.

By giving Arpaio's decisions in this matter a shred of credibility, Babeu links himself to the corrupt regime described in Munnell's memo. So what if Munnell isn't accusing Arpaio directly? Obviously, Arpaio is implicated.

Yet Babeu doesn't seem to care.

The whitewash feared by Wilcox and Stapley seems to be taking shape.

Good article, but ABSOLUTELY NO SUPPORT for this assumption:

Babeu should have a long talk with Sheila Polk before agreeing to take over an "investigation" from MCSO. Ask her how "independent" she was allowed to be.

BTW, can't we do better than the sheriff of some podunk third world county to conduct this investigation? Seriously, this guy is used to busting meth labs in Coolidge - not high profile corruption investigations.

The greatest thing about all this is that MCSO is finally imploding. Granted Sheriff Joe is orchestrating the whole implosion, but, he won't be able to contain it. Sheriff Babeu is an idiot for getting involved in this mess. He is neither objective not honest. That deputiy shot in the desert was a hoax that he covered up, no doubt with pointers from Sheriff Joe. Honesty is not a Babeu trait. That has certainly been demonstraded. I wonder if he thinks that he is also above the law, as Sheriff Joe sees himself? Two peas from the same pod?

Frankpratt,

After so many years of corruption on the part of Arpaio, Hendershott and the rest of them, we've seen too much buddy covering for buddy.

Montgomery is seen as a puppet even though he hasn't even taken office. Why? Because Arpaio picked him and spent $1 million to make sure he won. Arpaio picked Babeu instead of the DPS or some other truly independent and objective agency.

Forgive us if we sense history repeating itself, but Arpaio does not "pick" someone without giving a great deal of thought to the potential risks and rewards of said pick. I'll believe Babeu is serious when he recommends that Arpaio be placed on Administrative Leave as well, and that the Feds place a competent interim sheriff at the helm of MCSO while the investigation goes on.

Give the Sheriff a break and time to perform the investigation. This guy has fired his own long time friends when they made mistakes in Pinal SO. Babeu will not white wash anything, if nothing more than to protect his own political future and credibility. I have never met Sheriff Babeu, but I do trust him.

Emil - You said "What sort of legal framework allows the head of an agency accused of improper or illegal activity, to farm out what should be an objective, independent third-party investigation, to someone of his choice?"

Indeed! And isn't this exactly the same thing that Arpaio has been pissing and moaning about with the BOS?

Another shining example of how Shurf Joke does not believe that the rules he applies to others also apply to him. More of the Wonderful World of Joe fairy tale. I found it interesting in Munnell's memo where he said that Arpaio said (of the discontent with Hendershott being expressed to him) - "He gets me on television. That's what I want. I don't care about anything else."

We know that, Joe. It's been clear for years of you mugging for the camera, you sorry ass piece of shit old coot.

Liz, but how do you really feel about the Flaccid Fool?

Hilarious that Sheriff Babeu is this stupid. News flash Babeu - do a shoddy job "investigating" and you become a "co-conspirator" in the coverup. ANd consider this as well Babeu - no matte what you "conclude" and how you protect your idol, the FBI and DOJ WILL get involved deeper and you'll either come out of this looking like a rose or smelling like shit. The Munnell "memo" is nothing more than a last ditch effort to save Arpaio himself. The memo basically only reiterates what has most likelly already been told to the FBI and DOJ boys, and thus Arpaio would CLEARLY already know this stuff. This "memo" was surfaced to try and make Arpaio look like an dupe, an otherwise innocent Sheriff, who apparently, if his defense is to be believed, basically abandoned his duly elected job - but cashed the paychecks anyways (theft?) - so that he could pursue private book deals, nation-wide campaign trips and speeches for which he is paid, etc.,to benefit himself personally, just as Hendershott did/does with the Face Recognition business and pink underwear sales. And where is the money from the jail vending machines . . . That Babeu can't see he's been made a puppet in this is incredulous. Babeu, if you had half thebrains you try to portray, you'd realize you already have enough issues coming your way (what with your deputy being "shot"and all . . . that story is coming, pal) and you'd publicly punt this case. Take a lesson from Yavapai County Attorney Polk and others that saw right through the MCSO and former (now deadbear loser) Maricopa County Attorney Thomas' ploys. It's sad, because you do seem like a rising star Sheriff, but to watch you commit politica suicide here is just sad.

Sheriff Babeu, ask yourself, "exactly what is it that I, as elcted County Sheriff of Pinal County, Arizona, have to gain here versus howthis could adversely affect me here . . ." And if you can't figure that out, well, can't say I didn't warn ya.

Man, we need a quality Sheriff in Maricopa County. Elect Dan Saban folks, and let's end this mess.

Babeu...from one good old boy to another, don't worry about it Joe, we'll just pretend none of this really happened. Everything will be fine.Just crank up you're hate for the Mexicans and everybody will forget about all this like usual.

What sort of legal framework allows the head of an agency accused of improper or illegal activity, to farm out what should be an objective, independent third-party investigation, to someone of his choice?

Why don't responsible legislators -- or county officials if that's possible -- take this opportunity to emend the law to specify a default investigative body, or at least an unrelated, responsible individual or panel authorized to decide who should investigate?

In Arizona? "Responsible legislators" is definitely an oxymoron.

Isn't this the same Sheriff Babeu who went on The Political Cesspool (a White Supremacist radio show) and told the host he's a "great American"?

I think he's also seeing sandpeople with sniper rifles in caves in the deserts of Pinal County. Must have watched the original Star Wars recently and it freaked him out.

From Babeus' 1998 pre-election mini bio on the Republic....http://www.azcentral.com/commu...

Q: What character trait best serves a public official? A: Accountability. A leader must be accountable for his actions and performance.

Q: What character flaw most harms a public official? A: Dishonesty. This is why most who serve in elected office are not trusted. They have broken a sacred trust the hold with the public.

Let's see if he remembers, applies and sticks to his own statements...

This concerns me:

"Sheriff Babeu further has asked today, that all individuals involved in the investigation be admonished. This means none of the parties involved are permitted to speak with anybody concerning this investigation with the exception of investigators or attorney's."

Does the "with the exception of investigators" part include the DOJ or AZ Bar investigators? In other words, is he saying they can only talk to investigators he assigns? That would, to me, sound like he's trying to keep tight control on it for Arpaio.

Arpaio is taking a gamble turning this over to Babeu. Babeu has his own political base that is independent of Arpaio's. Babeu also has the strong support of people like John McCain who are political enemies of Arpaio.

I like Paul's unconstitutional attempt to gag the accused.

I wonder what orifice he pulled that demand out of.

What, I wonder, qualifies Babeu to conduct this very difficult and sensitive investigation? Nothing, I fear. I have to wonder why Babeu isn't delegating this investigation to a real investigator, instead of trying to handle it himself.

Just another elected official trying to cover the Flaccid Fool.

Soon, the Flaccid Fool is going to run out of concubines.

Like I've been wondering all along? Why don't the Feds take over despite, what Mini-me says?Do they still need approval fro the BOS? Someone please clarify?

Oh well this will mean that the legal whore Kate Baker of (Baker and Green) will make millions on this investigation. the same as when Candy was in office. She is not there to protect the investigation, she is there to get rid of it and unsubstantiate it. By the way shouldn't that D.A. have reported Foxx? Sounds like they concurred with it. Isn't that unethical for an attorney prosecutor? Foxx has been Black's bitch for a long time. Ask Jimmy Miller. All lake patrollers.

Unfortunately, Sheriff Babeu is as much a publicity hound as Arpaio. He not only supports Arpaio in going after immigrants, he also likes the bright lights of TV.
