​A bombshell memo from a top Maricopa County Sheriff's Office official alleges that Chief Deputy David Hendershott betrayed Sheriff Arpaio and ran a corrupt office through fear and intimidation.

Basically, Deputy Chief Frank Munnell, the memo's author, confirms what New Times and other critics have said all along about Hendershott and the command staff at the MCSO. But there's plenty of fresh meat here, too.

Joe Dana of Channel 12 (KPNX-TV) obtained the memo, according to a report aired last night. This morning, the Arizona Republic (the station's partner), ran a piece with further details.

Munnell wants Arpaio to conduct an internal investigation into the actions of Hendershott, Deputy Chief Larry Black, and Captain Joel Fox, (the latter two of SCA-scandal infamy).

Arpaio's response to Munnell tells us all we need to know about his culpability in the alleged corruption: He sent the case to his political ally, Pinal County Sheriff Paul Babeu.
   

Munnell claims he was forced by Hendershott to contribute to the Sheriff's Command Association account which, of course, was set up by Hendershott.

The memo apparently explains everything from Honduras to the SCA to the well-documented political investigations by the office. We're not sure what Munnell's part in all this might be, other than his role as an SCA contributor -- but his allegations make perfect sense.

Except for the implication that Arpaio wasn't aware of what Hendershott was doing.

The only thing Frank Munnell's memo doesn't cover, unfortunately, is how developer Steve Ellman, James Liautaud (CEO of Jimmy John's fast-food chain), and other large-scale SCA contributors fit into Hendershott's plan. Not to mention former County Attorney Andrew Thomas.

My impression, someone notifies Munnel he's on the indictment list along with the entire MCSO command staff, he runs to Joe and they cook up the memo throwing everyone to the wolves at the door except themselves. The whole organization is corrupt and has been for years and both Arpaio and Munnel have been in the thick of it. The only way Maricopa County will get a clean sheriffs office is a complete replacement of the entire command staff as well as all deputies being vetted and polygraphed for involvement. Way too many deputies act like they are part of this criminal conspiracy!

Wonder how long Babeu has had this, or when Arpaio asked him to review ("investigate") it. It's dated a month ago, August 17, and presumably Munnell gave it to Arpaio at that time.

The Republic article says, "Munnell's memo has been turned over to the FBI and U.S. Attorney's Office for their probe. Both agencies declined to comment." So I don't think it makes any difference what Babeu recommends, if anythting, because this Munnell narrative from his first-hand experiences is surely also being examined by the FBI, the U.S. Attorney and the federal grand jury.For those who want to believe that the abuse is all Hendershott and that Arpaio is blameless (they've been two peas in a pot for about 15 years), let's not forget Arpaio's actions in the last two years: adamantly defending the unlawful act of the uniformed sheriff's aide who rifled through and took the attorney's papers in open court behind her back; smugly and unlawfully refusing (for 17 months) to provide the requested documents to the DOJ's Civil Rights Division in their duty bound investigation of alleged civil rights violations by MCSO; recent flagrant violations of campaign finance law to smear county attorney candidate Romley. Arpaio himself is a boastful, deliberate lawbreaker besides being right in there condoning his buddy's Hendershott's actions and thumbing his nose at anyone who challenges the legality of his actions. With this Munnell memorandum, I think we're now seeing the light at the end of the tunnel. I'm also convinced that the feds have got Arpaio's number and fully understand the animal that they're dealing with.

While Arpaio has had the memo for nearly a month it wasn't until it was released/leaked to the public that he bothered putting Fox/Black/Blimpo on leave.

What took Old Joe so long to actually do something about the memo? Did it take that long for Lisa Allen to explain the big words to Joe?

There is a real possibility that there are some in MCSO that will fall as a result of this. Once the armor is chinked and Hendershott's temper is not in play, lots will come forward in the coming weeks. I don't think that AARPaio can escape culpability. He is the elected Sheriff and it is his office to run. Hendershott does his bidding, but it is still AARPaio's MCSO for now.

I wonder what Lisa Allen would have to say about things. She has been involved in spinning things for years. I wonder how much of the real story she has heard on some of these issues as they create a public story.

Like so many others, I've been following this for years. I can recall quite a few instances where we all thought for sure that what had just been revealed would swiftly lead to Arpaio and his thugs being ousted and/or prosecuted.

But each and every time they slither out of any retribution and ramp up their thuggery. I hope this time is different but based upon history - some of it even captured on tape in jails, the jails being de-certified for lack of medical care, illegal searches and seizures, substituting dirty urine to try to extend the sentence of an "enemy" - the list just goes on and on.

Those were all instances where it was absolutely clearly wrong and prosecutable. This letter is just that, a letter. How can it be stronger and more actionable than all the horrors that have gone on before? I am not holding my breath.

Maryis, you make a good point. But, this is the first time that I know of where someone inside the organization, and part of executive command staff, is making the allegations. Not to mention that he sent the memo to the shurf himself, thus giving the shurf time and opportunity to prepare for the worst. Munnell has done a good job of covering his ass, knowing there are many others in line to share their information, now that someone has come out.

Like you, I've been skeptical in days past. This time, however, I'm fairly optimistic.

I hope that "fat bastard" doesn't catch a heart attack. Because every American here in Maricopa County, wants to see some real justice served to Hendy on a big platter. And then watch him go down and do a perp walk straight into Joe's bloody gulag in pink. If he decides to croak or commit suicide before justice is served. Too bad, but either way, MC can be restored without Hendy/Arpaio.

Munnell wrote it that way so the Flaccid Fool couldn't trash the memo. Just think about it for a minute. If he had alleged that the shurf was also involved then the shurf could have said it was just bad blood between them. Munnell knows that by indirectly implicating the Flaccid Fool the shurf will also go down on this one. I am just curious how and why the memorandum was released to media... I think that was also part of the plan.

I'm not sure that this whole thing isn't a tactic conceived by the Sheriff. Perhaps Hendershott has volunteered to take the bullet and this is part of the set-up.

I was just thinking, maybe Arpio is behind this complaint... Doesn't it seem possible that he could have cooked this whole thing up to toss Hende's ass under the bus? It just doesn't seem right that someone would go so far out on a limb with his own career and not go on ahead and Include Arpio in the complaint. Something just doesn't add up with this whole thing right now

Rather telling that the first line of Munnells' memo, in big, bold letters..."RECOMMEND THE ARIZONA DEPARTMENT OF PUBLIC SAFETY CONDUCT A FORMAL INVESTIGATION....."

What would Arpaios reasons for not going this route be? Besides having Babeu in his back pocket?

Does this memo contradict anything that Joel Fox has said under oath? Not saying that Joel lied under oath, but it is worth looking into if there are substantial differences.

That's what I don't get. How is it that a Sheriff gets to choose where he wants an investigation to come from? Doesn't that open a door to more corruption when your buddy in a different county's sheriff department is looking into your department?

Maybe I'm just ignorant (I'm originally from NY and politics are much different there) but this just seems like a shady yet legal way for Arpaio to come out looking clean again. He'll just tell Babeu to make it go away and Babeu will find a bunch of scapegoats (the first being Hendershott) to target. More political BS. I wish I could be more optimistic, but it seems like this guy is made of Teflon.

Babeu may be a political ally of Arpaio's, but he is also a sworn officer of the State of Arizona, who took an oath to enforce the law. I am confident that he will do just that, regardless of who is involved in the investigation.

I am thrilled to see that Hendershott and the rest of his goon squad will finally be investigated. And don't think that Babeu's investigation is the end of this; there is also AZPOST, the governing organization for all AZ law enforcement. If Hendershott and others have committed any type of nonfeasance, malfeasance, misfeasance in office, or other conduct that tends to disrupt, diminish or otherwise jeopardize public trust in the law enforcement profession, they will be punished!!

Problem is; Arpaio and Hendershott are sworn officers of the State of Arizona who took an oath to enforce the law. I hope that Babeu has some integrity, but so far he has come across as Little Joe... Maybe we'll get lucky on this one though.

I get the feeling I have been stuck forever in a jigsaw puzzle trying to piece the sky together. Now I had a productive night and I have a lot of sky done, seeing how lots of pieces fit together. But, there is still a lot of puzzle to put together.

A couple of comments:

- Babeu gets the case to investigate. I think this is a tremendously bad choice on the part of AARPaio. Even if Babeu does a competent and thorough investigation, I would not trust it. I am not sure I would trust Mesa either because they are perceptually gunning for AARPaio.

- Were these issues coming down so fast that AARPaio felt he had to BREAK THE LAW during the primary election cycle to increase the odds that that Romley would not be County Attorney and that Andy Thomas would be Atty General?

- The alleged conduct on Search Warrant Affadavits parallels and supports what Polk was saying about her interactions with MCSO. It was not just Polk; it was MCSO's own people that were showing some integrity and some paid for it.

- If it is true that AARPaio gave control of MCSO to Hendershott, then it is still AARPaio's responsibility.

- It makes sense that Hendershott is running the store becasue Joe claims he does 2 speeches every day. What are we paying the Sheriff to do? Run all over the county and give campaign speeches?

- Is this really an internal investigation related to MCSO policy and officer discipline or a criminal investigation related to violation of Federal and State law? Or both? It looks like a valid complaint or request could bring another agency into the investigation on a parallel basis. For internal affairs, I would guess that AARPaio can farm it out as he wishes.

- Where we have corruption, intimidation, retaliation, obstruction of justice and other suspicions here, we may also have human resource issues such as employee retaliation, intimidation, coercion, and others that are addressible in the Civil Courts. This means financial risk for the taxpayers of Maricopa County. I believe that the County BoS should be looking into these issues to determine what the county exposure could be and to try and mitigate the damage. It is certain that there will be claims filed by MSCO personnel now that this is out. A credible investigation is needed for this purpose as well. I doubt the County would trust Babeu's results. I am certain that the scope of Babeu's work is limited by definition.

For those of you who have been reading these blogs the past couple of years, I will remind you I have anticipated this very day. It was just a matter of time until a certain 'insider' came out with the reality of what MCSO is all about (at the top, anyway). Now, the crumbling of the Ivory Tower has begun, and many underlings will be damaged by the fallout. I am expecting many other MCSO EMPLOYEES to roll over and try to protect themselves from public humiliation and/or criminal and/or civil charges.

This is indeed an EXCELLENT day in Maricopa County!

Lest we not forget, although the memorandum was calling for an internal on Hendy, the Flaccid Fool is NOT WITHOUT GUILT. He is NOT A VICTIM in any way. He has been behind all of the political maneuvering and postulations.

All those who work for the MCSO shurf are expendable. They know it, for they are reminded daily....
