Tempe Police Release Video of Biker Hit by Car -- It's Bad

• Sorry James, but you are missing an important part of the law. Another section [28-812] stipulates that bicycles have the same responsibilities and privileges as motor vehicles. The death-rate when pedaling on the sidewalk and in crosswalks is about 5 times that of driving a bicycle in traffic. We can't tell if proper lights were used by the cyclist. • <p>I understand from reading traffic laws that a bicycle is not considered a "vehicle" until the power it is propelled by exceeds a certain horsepower level. I'm guessing by looking at the video that the bike is of an electric variety that's sold at Phoenix Produce Company downtown Phoenix for about $500.00.</p> <p>Assuming the bike is not a "vehicle" any bike must follow the laws of the road for pedestrians and that means the bicyclist must cross the intersection within the crosswalk and if I'm right, walk the bike across. </p> <p>In any case, the car's driver should definately be incarcerated post haste for fleeing the scene of an accident and not providing care for his or her victim. </p>
