Rick Romley to Replace Andrew Thomas as New Maricopa County Attorney

• <p>After 6 1/2 years, NOW is the time to "right the wrongs" in the wrongful conviction of Courtney Bisbee,an innocent woman and Mother! The prosecutors have a moral and ethical obligation to act when "new evidence" is brought forward -- proof of innocence and a scam. Filed years ago in the Maricopa County Superior Court -- a Recantation by State witness, older brother -- a scam to sue the Paradise Valley School district to "get rich" in formal Deposition filed in 2006, passed Polygraph, passed Risk Assessment testing, along with other Affidavits and reports.</p> <p>Andrew Thomas chose to sweep it under the rug, raising questions of a "cover-up". It's time for a full investigation of the prosecutorial misconduct, well documented in her case. Also who profited by this "high-profile" case for political and career gain, along with an ex-spouses who got rid of or gained child support and custody of the children. Election year (2004) labeling to gain a vote, a conviction, a child, a career move, etc. is truly sick. These are the true "predators" that should be investigated, including the Victim's Rights advocates who were taking notes during the Bench trial and going back and forth to the witness room. Recently a Sentencing hearing was on video that showed how the Court operates under the control of the prosecutors. This pattern of injustice must be stopped.</p> <p>After the conviction the accuser and his mother left the state and have continued their crimes in another state while the Arizona taxpayers are drained of millions in a case that never should have been. If the Scottsdale police detective had followed then MCAO Romley's Multidisciplinary Protocol for the Investigation of Child Abuse and done his job we would not have this tragic case which should be an embarrassment to the Justice System and all the state agencies involved.</p> <p>Think "Duke / Nifong" to understand abuse of power by a DA (County Attorney) with motive for career gain. Thomas chose to ignore the new evidence and allow an innocent woman/mother to be convicted and given essentially a life sentence for an alleged crime that never happened -- a "he said, she said" case. Her young child lost her Mother in one fell swoop, while the teenager and his mother "moved on" in the court system.</p> <p>Former MCAO Andrew Thomas swept New Evidence in the Courtney Bisbee case under the rug for years. Hope MCAO Romley will "right the wrongs" that were done by the MCAO prosecutors that committed prosecutorial misconduct and the Scottsdale Police detective who gave false and misleading information to the media, the IA Court, the First Grand Jury and those who turned a blind eye to save their own careers at the expense of an innocent woman while those who had motive for financial and career gain wanted her silenced for years. Ask Ray Krone about what it's like. He spent years in prison and the court system. He was eventually exonerated by private attorneys. Mr. Romley and the State Legislature said they had to do better next time. Well, it's next time!</p>

What does he leave out?</p> <p>97-0492 Disposition Summary<br /> **********************SUMMARY***********************<br /> GARY PETER KLAHR (Bar No. 002102) File Nos: 97-0492, 98-1425, 98-1733, 98-2540, 99-0187, 99-0629, 99-2400, 00-0246 and 00-0318</p> <p>By Supreme Court Judgment and Order dated May 1, 2002, Gary Peter Klahr, 317 East Berridge Lane, Phoenix, Arizona 85012 was disbarred effective from the date of the Judgment and Order for conduct in violation of his duties and obligations as a lawyer. Mr. Klahr was ordered to pay restitution to four clients totaling $3,635.00 and was also ordered to reimburse the Client Protection Fund for any claims paid out by the Fund up to the maximum amount of $100,000. Mr. Klahr was ordered to pay costs and expenses incurred by the State Bar in the amount of $8,362.10, together with interest at the legal rate, in this matter.</p> <p>Mr. Klahr engaged in various acts of misconduct. The misconduct included his agreement to represent clients in various legal matters and then assign those cases to other attorneys who would perform services on contract for his clients. The client was billed at the rate of $150.00 per hour on behalf of Mr. Klahr, and then Mr. Klahr would pay the contract attorney $50.00 an hour for services performed on behalf of the client. Mr. Klahr allowed the client’s legal interests to be adversely affected by his failure and/or the failure of a contract attorney to perform legal services as retained. On various occasions, Mr. Klahr, instructed the contract attorneys to stop performing services for clients when their retainer funds were close to being entirely expended. Mr. Klahr would have his staff contact the clients and inform them that if further payment was not made, no further services would be performed. Mr. Klahr would also direct his staff to threaten clients with legal action to force payment of additional retainer funds. Mr. Klahr’s usual course of business also included entering into “non-refundable” fee contracts with clients. In cases where Mr. Klahr did not fully earn the retainer funds, Mr. Klahr refused to return the unearned portion of the retainer funds to the client.</p> <p>Over a prolonged period of time, Mr. Klahr allowed unqualified and dangerous persons to manage and actively participate in his law practice. Mr. Klahr abdicated his duties to oversee and supervise both his non-lawyer staff and his contract attorneys. Moreover, the Hearing Officer found that Mr. Klahr knowingly allowed unlawful drugs and other criminal activity to occur in his office on numerous occasions.</p> <p>The Judgment and Order sets forth, by count, the specific facts and violations of the nine files involved with the formal complaint in this matter.</p> <p>There were six aggravating factors found pursuant to the ABA Standards for Imposing Lawyer Sanctions, section 9.22: (a) prior disciplinary offenses, (b) dishonest or selfish motive, (c) pattern of misconduct, (d) multiple offenses, (h) vulnerability of the victim, (i) substantial experience in the practice of law and (j) indifference to making restitution. There was one mitigating factor found pursuant to Section 9.32 of the ABA Standards: (g) character or reputation for engaging in pro bono and extensive community work. Mr. Klahr’s conduct violated Rule 42, Ariz.R.S.Ct., particularly, ER 1.3, ER 1.4(a), ER 1.4(b), ER 1.5, ER 1.5(d), ER 1.16, ER 5.1, ER 5.3(e) and ER 8.4(a), (b), (c) and (d) and Rule 44(b)(4), Ariz.R.S.Ct.</p>
