Phoenix Officer Who Shot Homeowner Didn't Violate Policy, Police Board Says
Phoenix police officer Brian Lilly did not break any department rules in the shooting of homeowner Tony Arambula, the Phoenix Use of Force board decided today.

Any other decision might have cost the city a lot of money, right away.
Arambula, who heroically saved his family from an armed intruder, is seeking at least $5.75 million for being shot six times last year by Lilly. It's amazing that he lived at all, but doctors say he'll face a lifetime of pain from his injuries.
According to the Arizona Republic, some officers on the board "said the shooting was difficult to avoid, considering the fluidity of the emergency scene."
Arambula had his handgun trained on the intruder when he was shot, so it's a given that Lilly shot the wrong person. Under certain circumstances, according to the review board, such an error is allowed by department policy.
Whether a jury agrees -- if the lawsuit gets that far -- is another question.

Department policy will be irrelevant in the lawsuit as it doesn't determine what does and does not constitute civil liability.
Besides, the same breakdown in communications that was used as an excuse by the cops will be the elements used by Mr Manning to win his case.

There is obvious intent to cover up the incident, which can be heard on the tape, things such as "According to the complaint, Lilly can be heard on the 911 tape telling Coutts, "We f'*&$d up." Then the reposrt goes on to sat that the other Officer a Sgt Coutts; "The complaint continues: "Still not knowing that he is being recorded n the 911 tape, Sgt. Coutts interrupted Officer Lilly's admission and apology with his assurance that the cover-up would commence: 'That's all right. Don't worry about it. I got your back. ... We clear?'"
This conversation can be heard on the 911 call as the cops didn't know that it was still recording.
How, I mean really How could the Police dept knowing all of this info say that this guy acted within Board policy? If that is how police are supoosed to act I will never be calling one again, this is basically stormtrooper behavior!
Also the officer says on the 911 tape that he didn't know which way the guy was pointing the gun or if he could see a gun? So let's say he could see the guy holding the gun and let's go so far to say that maybe the homeowner accidently pointed the gun at the cop, how did the homeowner get shot 6 times in the back? (According to the resports two of those shots happened while the guy was on the floor already!)
All of this is scary and I cannot believe that the Police says the guy acted within board policy, however I expect them to protect themself.
I am a Gun owning Republican and I cannot believe that this behavior is tolerated anywhere in the US. I hope that when they go to the civil trial these two cops get 25 years in jail and the homeowner gets any amount of money that he asks for! ($5.2 million isn't enough in my eyes!)

The homeowner would have been better off, if he hadn't had a conscience, to have shot the intruder and had the gun out of his hand by the time the police got there. A lifetime of pain??? Makes me want to think twice before I'll call the police! At least I don't live in Phoenix??!!

Calling the gansters in blue is rolling the dice. Few of them are educated beyond technical school and most of them are adrenaline jockies looking for a chance to use their gun.
