Of course I'm no martyr! But I do believe that I am in full compliance with Campaign Finance Law, and that the allegations against me are false, so I will present my position to a judge, as is my right. Sheriff Arpaio had no knowledge of this whatsoever. I'm not "taking one" for him. I simply do not agree with Mr. Messing's investigation, and do not agree that I violated any election laws, so I am asking a judge to decide. That's it. So many people seem to want to make so much more of it, but really, that's it.

While I'm sure you all know much more about the facts of this case than I do, I wouldn't mind addressing some of your points. I am not at all worried about the media's portrayal of Joe Arpaio. The Sheriff can, and does deal with the media in whatever way he sees fit. What I do care about is the media's tendency to throw deputies and detention officers under the bus in their attempts to discredit the Sheriff. Talk about Sheriff Joe all you like, but leave the hard working deputies and detention officers out of it, unless you have some reasonable proof of the allegations. When I was asked if the donors would suffer only if they did something wrong, I replied "absolutely not", meaning that they would indeed suffer, even if they did everything right. People put money into the account with no intention of it being used for a campaign. Their contributions were not campaign contributions. Giving money to the Republican Party is also not a campaign contribution, because it is not for a particular candidate. These definitions are listed in ARS Title 16. For these donors to be associated with campaign commercials that they had nothing to do with, and took no part in the decision for, would be a travesty. You guys can certainly smoke 'em if you got 'em, but you might not write me off, just yet. I do know the law, and I do understand the law, but I also know that we have judges for a reason. In every single legal case, one side is wrong, and usually represented by an attorney. Laws are interpreted in their application, and not everyone agrees on every interpretation, although some are more obvious than others. Arizona Campaign finance laws are the least obvious of any laws I have ever read. Nancy Simpson, you've asked the best question of them all...Why is he making a big deal out of it. Ma'am, I am not, and would be perfectly happy if this was no deal at all. I'm actually surprised that anyone cares about this. It's nothing more than a simple disagreement on the application of the law that will be decided by a Judge. If the Judge agrees with the county, then obviously, the campaign finance reports will have to be filed. If the Judge does not agree with the county, and instead finds that the donation to the party, ultimately returned, was not made for the purpose of influencing any election, then there was no violation of the law, no political committee, and no disclosure is required. Why everyone cannot wait until the Judge makes this decision, prior to speculating, and making allegations of corruption and other heinous crimes, turning this into a "big deal" I do not know. Might it have something to do with wearing "I hate Joe" glasses, and only seeing their own desires for a different sheriff, rather than a rational, honest approach? Isn't a person still entitled to have their case heard in court before everyone just naturally assumes that illegal acts were committed? Or is that only for people other than cops? Maybe only for people other than sheriff's deputies? And aren't we still secure in our personal effects, so that government cannot intrude without cause, as determined by a Judge? If you really want to know why it is a big deal, you might check with TommyC1, Dennis Gilman or Glyph. They certainly seem to have strong opinions about it. Tommy, I took the morning off to attend the hearing, even though I am a salaried employee. Feel free to file an FOI for my timesheet anytime you like...and no one else from MCSO was at the hearing. Inquiring Mind, the financial records of a political committee are, indeed, open to public scrutiny. That is the point of this case. My position is that SCA is not a political committee because my intent was never to influence any particular election. The county believes that it was my intent, as do most of the reporters covering this story, and most of the commenters online, thereby making SCA a political committee, and requiring the financial records to be made public. I would suggest that you read Title 16 and decide what you think it is yourself, and then you can compare your interpretation to that issued by the judge at the end of this case. If you could put $315,000 at stake, you'd know precisely how I feel. Of course, you could also throw several people into the fire who had no part in your decisions, just to save your own skin, if you like. Good luck looking in the mirror, afterwards.

While the infraction may be civil in nature, there certainly seems to be an obstruction of justice / coverup going on here. There are people that conspired with Mr. Fox to break the law and are further conspiring to coverup their involvement. If they had know knowledge of the use of the money, then they surely would have howled like a pack of wolves over this. Would you not think that they would be trying to issue statements distancing themselves from Mr. Fox? The money was returned to the SCA by the republican party. What happened to the money after it was returned? Seems like someone could follow the money. Who cashed the check? What account was it deposited in? What happened to the money? Surely it was returned to the donors? Or does it still exist in an official SCA account? Are the records of a PAC subject to public scrutiny? Just some thoughts.
I am so sick of the excuse that the "media is out to get me" It sounds like Sarah Palin too. This is something that liars or people in denial of their lies use as an excuse. Far too many people use this when it is plain BS. If it is not such a big deal, why is he making such a big deal about it?
Glyph: I will have a cigar with you one day when this is done and Fox has ripped off arpaio and gang to save his own ass. I think after today he really does see the handwriting on the wall. I wonder, Mr. McNamara, if anyone else known to be from MCSO was there today? Or was it just Mr. Fox? And was he there on duty? If so, it sure appears we, the taxpayers, should NOT be paying his salary while he appeals a political fine of his own doing. Of course I'm fairly sure no one in MCSO keeps payroll records, right?

Fox has always been obsessed with this thought that all media is out to get the Sheriff. It's been all he spoke of last summer at the BOS meeting. But this is a strange man indeed. He won't really say what SCA was for, he wont say if the individual donors even knew about him giving the money and he won't say who the donors are? Lets hope the judge see's this for what it is: Bullshit. And for the record Mr. Fox: The deputies see a car and driver and decide to follow him. They are usually doing it in heavily latino communities (sweeps). They also run plates and then pull over people with Hispanic names as I have listened to on the scanner often. Fox has more issues then the media. One of them is honesty.
This video clearly shows why Fox is a Captain. If he survives this and doesn't have to name arpaio as a complicitor he will likely be promoted to Deputy Chief of Untruths and will be good until arpaio dies, or the next election, whichever comes first. The guy is brainwashed and is nothing more than a pansy ass whore for arpaio.
