World Cup Theme by Shakira Plagiarized?

While Americans don't take to football ("soccer" in our land) the way the rest of the world does, there's something special about the World Cup. Something so special, that even musicians can't help put take part in all the excitement. While R. Kelly wrote an official theme for the global quadrennial sporting event, and Weezer penned an unofficial one (which can be downloaded for free on iTunes) Shakira has also taken part in the action.

LA Weekly notes that she's written a song titled "Waka Waka" in collaboration with a group called Freshlyground from South Africa.

The problem is that Dominican musician Wilfrido Vargas claims that the tune, which people are describing as "infectious" was actually a rip off of his tune "El Negro No Puede." He also plans to sue the Colombian songstress. Wonder how many other unofficial themes are on their way...
