Bill Montgomery's Lawyer Stephen Tully Chokes, Trying to Defend Monty's Move to Silence Mary Rose Wilcox

I confess, it's damn entertaining watching a highly-paid lawyer completely flummoxed in court, sputtering like a percolator, particularly when you disagree with him.

Which is what happened Friday afternoon in Maricopa County Superior Court before Judge Dean Fink, as Fink gently grilled legal beagle Stephen Tully, the gent representing County Attorney Bill Montgomery in Wilcox v. Montgomery.

That's the lawsuit by county Supervisor Mary Rose Wilcox, asking for a declaratory judgment, stating that Wilcox does not have a conflict of interest in discussing or voting on an appeal of the ACLU's big civil rights lawsuit, Melendres v. Arpaio.

During the hour-long hearing in downtown's Old Courthouse, Fink wanted to know, specifically, how Wilcox's voting or discussing Melendres on the board would be a conflict for the supervisor.

Tully struggled for an answer.

"I'm a little bit uncomfortable arguing anything that's outside the county attorney's opinion," Tully admitted. "Does [Wilcox] have an indirect pecuniary interest in the Melendres suit? Certainly she could have."

See, Montgomery issued an opinion in June, stating that this supposed conflict of interest has to do with a nearly $1 million settlement Wilcox and the county agreed to in a federal suit, regarding bogus charges brought against her during the regime of Monty's predecessor, disbarred political pariah Andy Thomas, onetime stooge of Sheriff Joe Arpaio.

The judge in Wilcox's federal complaint ordered the county to pay the settlement, but Monty, for his own political reasons, has appealed that order to the Ninth U.S. Circuit Court of Appeals, where it now sits.

Melendres deals with racial profiling by the MCSO. Wilcox's lawsuit dealt with retaliation by Arpaio against his enemies, Wilcox being one.

The two are not related, and Fink observed as much, more than once during Friday's oral argument.

"I'm not sure how there's relevance and how the Melendres case can get into Supervisor Wilcox's case," Fink stated.

Tully hemmed and hawed, trying to come up with something, anything.

Well, they are both civil rights cases, he offered, maintaining that because of this, somehow Wilcox could use the ruling in Melendres in her lawsuit, should Monty's asinine appeal to the Ninth triumph.

"The county gets sued and the sheriff gets sued all the time," Fink observed. "Those can be involving civil rights as well."

Since her lawsuit against the County isn't adjudicated, she has no business representing the County in other lawsuits.  She is the definition of Conflict of Interest.

What I want to know is how much taxpayer money was needlessly wasted on this latest round of MCAO/MontyPug bullshit.

If anyone has a conflict of interest, it's MontyPug. He needs to get his ass in gear and get those 432 sex crimes against children that MontyPug's butt-buddy Arpaio fucked up.

Even though the position that Mongtomery has taken is fairly indefensible, the questions that you've described seem to be rather predictable and Tully should have had a prepared answer for them.  Even if the answer was a pile of shit, he should have had a prepared answer and not stumble through trying to respond to the judge's questions.  The fact that he still stumbled further demonstrates just how indefensible Monty's conflict opinion is.

This whole thing looks like something right off The Daily Show. Latina banned from testifying in racial profiling because she is latina. 

Just imagine the interviews of Arpaio or Liddy or Monty explaining this. Priceless.

Let's not forget that Wilcox would get ZERO dollars in a settlement had Candy Andy and Sheriff Joke not SCREWED THE POOCH with their bogus attack on Wilcox!


And when will Sheriff Joke face the music for what he and his clowns did in the whole Wilcox/Donahoe/Stapley debacle?  At least Candy Andy got his law licence shredded and shoved up his ass!

Wilcox vs Arpaio - one crook who belongs behind bars vs a bigger more effective crook who deserves and even worse fate. I'd probably avoid taking sides on this one.

@yourproductsucks actually, the definition of conflict of interest more lies with monty..lol he is after all, declaring he will arrest HIS OWN CLIENT! We already went through this with Thomas before. Monty played nice so he could be the BOS attorney again, then threatens his own client? Also, to assume she will vote one way or the other is just as asinine. Seems they just want to stack the decks to approve the appeal, and will do whatever to help arpaio out...again.

Racism and coruption are not the same thing under the law. Just because MCSO and MCAO regularly practice both doesn't change the definitions. 

Bitching about how you don't like MRW doesn't change the law. Defending the actions of someone who shot and could've killed someone says volumes about you as a person though..

YPS, her case would have been adjudicated had MontyPug opted to comply with Judge Wake's original order making the county pay her settlement. He instead opted to play politics with the case during election season.

@yourproductsucks Nope. Read the piece and the statute. She gains nothing from Melendres. So there is no conflict of interest, as defined by statute. 

What is it about obeying the law you don't understand? Oh, I forgot. Ur an MCSO deputy, and work for a an agency found guilty of racial profiling.

@dennis20 by proxy, then Monty should recuse himself from offering an opinion..since after all, joe helped him get elected. lol seems republicans in this state only want to talk about conflict of interest when it suits them, and ignore it the rest of the time.

Wilcox's law suit against the County is not complete. If appeals overturn the settlement, Wilcox will be in a position to continue with her lawsuit. Melendrez can absolutely be used to bolster her claim should the suit go to a jury.

For this simple reason, she shouldn't be involved.

Feigning absolute honesty by divulging your ignorance in the past doesn't add credibility to your statement that you've never hit any woman.  Those who skip out on paying child are more inclined to be woman beaters as well...you've got all kinds of indicators pointing that you do hit women...

@yourproductsucks @dennis20  You know I've never hit any women.  I did work from the time I was age 22 to 27 using a wrong SS#. It was my error as I lost mine but ignorance of the law is no excuse so now that you have a crime reported why not come and arrest me coward?

The person who shot MRW was over charged.  Aggravated Assault was the proper charge rather than attempted murder.  Making a statement of fact is not defending a person who commited a crime.
