Paul Penzone (Video), Rich Carmona Still in Play, and the Problem with Provisionals (w/Update)

I've been geeking-out a bit lately on provisionals. According to a policy paper published in 2010 by the ACLU of Arizona entitled Uncounted Votes: How Arizona Law Impacts Provisional Ballots, one in 14 Maricopa County voters, 99,826 in all, cast provisional ballots in the 2008 presidential election.

The report indicates that voting provisionally is, "an option guaranteed in the Help America Vote Act of 2002...meant to help voters who arrive at the polls and are not on the list of registered voters."

Unfortunately, the ACLU found that more than 30 percent of those provisionals were tossed for one of four reasons:

"(1) the voter did not have proper identification; (2) the voter was ineligible to vote; (3) the voter provided incomplete information; or (4) the voter was in the wrong polling place."

In Maricopa County, the report indicates that of those 99,826 ballots, 29,531 were rejected, or nearly 30 percent. The number one reason? Ballots being cast in the wrong precinct.

The ACLU faults an Arizona law, ARS 16-584B, requiring that provisional ballots be cast in the precinct where the voter resides. Several other states have similar laws, according to the report.

The effect of the statute, according to the ACLU, is the disenfranchisement of citizens eligible to vote, but whose provisional ballot mistakenly was cast in the wrong precinct.

Someone could be affected if they've moved or if their precinct changes for another reason. Also, poorly trained poll workers may not direct them to their new precinct.

"Voters who show up at their old precinct may encounter difficulties in determining their correct precinct," reads the report, "and poll workers may find it easier to simply give the person a provisional ballot without realizing that the elector will be disfranchised as a result."

The ACLU also observes that, "poor people, and consequently, minority communities, are more likely to move than the non-Hispanic White population, and that the majority of moves among Blacks and Latinos are within their present county of residence."

The report quotes University of Iowa Professor Douglas W. Jones, a computer scientist whose expertise is electronic voting, as stating that provisional ballots, when misused, can "become a way to brush off troublesome voters by letting them think they have voted."

Similarly, Arizona's law requiring photo ID at the polls also has the effect of discouraging citizens from voting. For that requirement, one of the strictest in the nation, we can thank Prop 200, passed in 2004, which was placed on the ballot through the efforts of nativists such as recalled, former state Senate President Russell Pearce.

If the numbers from county elections and this report are accurate, there was a 15 percent increase in provisional votes cast in Maricopa County in this election.

Ann Wallack, chair of the Maricopa Democratic Party, has been monitoring the election along with other Democratic party officials.

I asked her if redistricting and district consolidation might have caused an increase in the provisionals, as the number of county voting precincts went from more than 1,000 to a little over 700 in 2011.

I don't see how we can say Pezone lost when all of the ballots have not been counted yet. I do not understand why Penzone would throw in the towel before the count was done.

This is freaking hilarious. Now all of the morons are going to start charging out of the woodwork and pointing fingers at each other. This damned election was lost 6 months ago, I and many others tried to tell you this but you wouldn't listen. You wanted to listen to Mr. Loudmouth, know it all arrogant 'Don't tell me nothing' 'Randy Parraz. You followed a self serving idiot down the tracks to loserville and now that you reached the destination, you want to become angry and place the blame everywhere except where it belongs. My anger and frustration was vented months ago when the race was originally lost.

 

At a time when Joe Arpaio was most vaulrnable, the MCDP failed the people of Maricopa County. The next 4 years of Arpaio are courtesy of Ann Wallack, the MCDP and "send me more money “Arpaio foe, Randy Parraz. How many damned times do you keep trying the same strategy and getting your ass kicked before you realize it doesn’t work? Any idiot knows that you could run a damned sock puppet against Joe Arpaio and garner 40%-45% of the vote. There is a large amount of Anti-Joe votes to be had by ANY candidate, THIS IS NEVER ENOUGH..DUH!!!

 

We need a qualified candidate that has a background, education and experience level that will attract the voters who are in the middle of the road on Arpaio. The candidate HAS TO be able to pull away some of the Arpaio votes, not the hardcore racist vote, which he will always have but people who are voting Arpaio for other reasons and may see a need for a change if there were a desirable candidate. This is NOT and NEVER will be Paul Penzone.

 

Hopefully Randy Parraz has made a big enough ass of himself that he will go find a job instead of trying to make a living off of people’s misery. Randy does an excellent job of convincing Republicans to vote for other qualified Republicans in a single LD, but when it comes to selecting which candidate to support in a countywide race his judgment and tactics leave a lot to be desired.

 

Hopefully Stephen Lemons will go back to being a Lackey/mouthpiece for Sal Reza, as annoying and as obvious as that was, he somehow had more credibility in those days and managed to do some decent work. During his stint as a Randy-Bot, I have never seen a more ignorant and misdirected series of articles than the nonsense hit pieces he wrote against Mike Stauffer. I will forever doubt the credibility of anything Stephen Lemons publishes. The sheer stupidity displayed by the amount of time that was wasted trying to demonize a candidate that was obviously never even going to be a factor. This alone should tell everyone the idiocy and stupidity that was in charge of this campaign.

 

The next time you see a workplace raid and witness parents being torn away from their children or families being torn apart due to arrests that were made as a result of racial profiling, don't blame Arpaio...BLAME YOURSELF AND YOUR STUPIDITY!

I understand why he would have conceded at that time, but that was on the basis of thinking there were a mere 200K+ ballots, not over 600K ballots, to be counted. I worked a poll in another county and we had fully a quarter of our voters having to vote provisional, absolutely ridiculous. A huge number of those had ID & voter registration card but were not on the voter roll.  No excuse for this. Another embarrassment for Arizona.

Even though the law seems to say that a provisional voter must vote in the right precinct, it does not necessarily mean that the ballot should be tossed.  If the voter is registered, the ballot should simply be sent to the right precinct.  Provisionals are in envelopes with information on them, such as addresses and signatures.  It should not be a problem to send the envelope to the right place and--voila!--the voter has voted in the right precinct!  This type of statute should be interpreted to favor counting, not to disfavor it.  This is not a big problem for election officials to resolve.

The provisional votes will be heavily weighted for Penzone because most we're new voters that did not make it onto poll rosters. it is irresponsible for the SOS not to require accurate voting rosters on Election Day. the registrations can also be verified online with the current system. There is absolutely no excuse for this and thare must be an investigation into the way the elections functioned. Poll workers also reported problems. if Bennett and Purcell can't get their acts together they need to resign.

the people working my poll were pretty on top of letting people know if they were at the right poll or not..making sure to ask everyone "do you live inside this area on the map?" before handing out ballots.

 @funcre8v When you dump off 600K on election day, that's what happens. They don't count eartlies or provs that day, they send them to the county, the county takes as long as needed to count them. Try educating yourself.

FACT: Despite anyone’s childish and asinine equations that Mike Stauffer would only pull votes from Paul Penzone, THE FACT remains, history dictates and common sense assures that Mike Stauffer also pulled many votes away from Arpaio. There are thousands of hard-line Republican voters who are disgruntled with Joe Arpaio yet could never bring themselves to vote for a Democrat candidate. These ‘Protest’ votes went to Mike Stauffer. Mike Stauffer quite probably pulled far more votes from Arpaio than from Penzone. If you have to be told this or have difficulty comprehending it , then you have the IQ and political savvy of a damned potato seed.

FACT: The same STUPID tactics were used against Arpaio during this election that were used against him in the previous elections and guess what…THE RESULTS WERE THE SAME, WHAT A SURPRISE!! The WRONG candidate was selected, backed and supported by the Democratic Party; the same exact mistakes were made. Self promoting activists who have been around long enough to have known better, apparently didn’t (or did they?) Hundreds of thousands of dollars were spent and countless volunteer hours were wasted trying to defeat Arpaio (once again) solely with the “Anybody but Arpaio” vote and attempting to shove a mediocre candidate down everyone’s throat.

FACT: Many Randy-Bots are not known for quick thinking and common sense, then again neither is their leader.

I think the early ballots should be counted as soon as they are received and added to the count on election day.

Another thing we could do is vote on line. I'm sure someone could come up with a program that would recognize your voters registration and as soon as you were done voting, it would lock you out so you could not vote more than once. That would cut back on taking two weeks to count the ballots.
