Helen Purcell Urged to End Confusion Over CBS 5 Early Ballot Report

Sadly, confusion still reigns after CBS 5's recent report on early ballots and the volunteers from different groups picking them up, in which this legal, and very common activity was labeled, wrongly, as illegal.

CBS 5 reporter Donna Rossi incorrectly paraphrased the remarks of Maricopa County Recorder Helen Purcell as stating that, ""it's a Class 5 felony to possess someone else's ballot."

Later, CBS 5 corrected a text version of the story to quote Purcell as stating, "Being in custody of somebody else's ballot without their permission is a Class 5 Felony."

But the correction is unlabeled and a video of the original broadcast still contains the incorrect information.

Moreover, the underlying premise of the segment is wrong: i.e., the suggestion that there is something improper or illegal about volunteers for groups like Promise Arizona in Action, the Campaign for Arizona's Future and Citizens for a Better Arizona's gathering early ballots for voters and either mailing or delivering them to Maricopa County Elections, which is part of the Recorder's office.

Rossi's report states that "no one is authorized" to pick up ballots, when, in fact, no one has to be "authorized" to do such independent, volunteer work.

The segment gave the impression that Purcell was unaware of the groups involved in such standard get-out-the-vote efforts, when, in fact, county elections is very aware that hundreds of early ballots are delivered to them at a time by various independent groups.

"Purcell says she has no idea who is out there trying to collect [ballots]," Rossi stated in the news item. "But she wants it to stop."

As I've already blogged, both the Arizona Secretary of State and elections law attorney Tom Ryan have told me that it is not illegal to pick up someone's ballot with their permission, as long as no one is misled and the ballot is turned over to the county in a timely manner.

But, weirdly, the recorder's office has been reluctant to issue a clarifying statement to the CBS 5 broadcast. And CBS 5 has not helped matters by avoiding a clear, obvious correction.

That's why I was encouraged to receive the press release below from Petra Falcon of Promise Arizona in Action, explaining how the group met on Monday with Purcell, elections director Karen Osborne and their lawyers, to present them with a petition, asking that Purcell issue a clarifying statement about the CBS 5 report.

"We're very concerned people have heard this on the news and will be hesitant to talk with our volunteers," Falcon explained.

The US Supreme Court ruled that Arizona's ID requirements to register to vote were unlawful. After this ruling, thousands of students at UofA, ASU, NAU and other schools in Arizona registered using the FEDERAL FORM since many do not have Arizona driver's licenses. Many others used the federal form to register. 

 

ALL County Recorders in Arizona are holding these registrations in "suspense" having been instructed to do so by the Secretary of State, KEN BENNETT. This means that about 10,000 TOTALLY QUALIFIED CITIZENS have:

 

> NOT received mail-in ballots 

> NOT received information about polling places, sample ballots, election guides, date of election (not even a wrong date), etc.

> And NOT been notified that there is any problem with their registrations or requests for mail-in ballots

 

All of this is VOTER SUPPRESSION, it's a very big deal, and it’s all but SECRET.

Purcell is not responsible for the erroneous information regarding the ballot stuffing issue, Channel Five News is.

 

How many early ballots with the November 8th date were dissiminated?  50?  80?  A bunch of hoopla over a very minor issue.  It's no different than Flake opining over Carmona's sexist remark.

I'm sure Recorder Purcell is worried that if she appears too accommodating to groups like Promise AZ that the Tea Party will file a candidate against her next time in the Republican primary.

I will guess that she was not intentionally 'misquoted' as she says. I will guess she intentionally misstated any knowledge she might have about election laws, including the handling of ballots by a third person.

 

NOW, it is her duty, as an elected official, to correct herself.

 

Not likely to happen, however. She IS, after all, a Maricopa County Republican. Most of those folks don't have the ability (think MCSO shurf here) to actually say they have EVER been wrong and when it's proven they NEVER admit error or apologize, "If there were any victims".

 

I have no reason to think this lady is any more honorable or ethical or has any more integrity than the local county sheriff, who apparently has none of any.

 @bill.scheel Good point. She still has a responsibility to the voters to give correct information and she has failed and has shown little interest in correcting it.

 @Tommy_Collins  I agree Tommy. It smelled really bad last week and enter Arpaio and here we are.  I don't see how we can trust her or Chanel 5 at this point.

 IMO,the Democratic Party is partially at blame. Their refusal to run candidates for County Recorder,County Attorney,County Assessor,County School Superintendent and County Treasurer leave voters with little choice at election time. This coupled with the fact that write-in candidates names are not available to PEVL voters,ensures re-election for all these right-wing politicians. I have suggested to all my family and friends who are on the PEVL and are not satisfied with the choices available for these offices,to leave that portion of the ballot blank just in case there is a write-in candidate running for these positions..........The fact that the names of write-in candidates names are not available to PEVL voters,in it self smacks of voter supression..........If anyone out there knows how a list of write-in candidates can be obtained please share the information.

 @dennis20  She gave the correct information.  It is the responsibility of the media to get their stories right and to take responsibility when they get it wrong.  

 

It's just another example of journalists with zero integrity or honor.  It's not surprising to see another "news" organization and a free lance photographer attempting to spin this story away from media responsibility.

 @dennis20 Curious why your boyfriend isn't targeting Rossi for her comments.  Oh, I know why; Republican Voter suppression is much more sexy than a lazy journalist misquoting an interviewee.  

 

Rossi, I'm sure, recorded the conversation.  Why doesn't her employer simply provide recorded conversation backing the huge Voter Suppression Story brewing?  Why isn't lemons banging down the door in an attempt to get the audio?  Roll over and ask him, I'm dying to know.

 @yourproductsucks How do you know she gave the correct information? That has yet to be determined and nether 5 or Purcell are talking there is no way for you to know what no one does for certain. The dilema at 5 may be that she did say it and thats why they aren't doing much of a back-spin or retraction. Either way, your hero Arpaio is certainly misleading the people with a dirty robo call. Is that OK with you also?
