CBS 5 Report Regarding Early Ballots Incorrect, Sets Off Firestorm (w/Update)

A recent Arizona Republic item on the same subject makes more sense. It quotes County Elections Director Karen Osborne as stating the following:

"Do not give your ballot to anybody that you don't have personal confidence in."

Now, that is sound advice. Still, the question remains: What if you give your early ballot to your spouse or to a cheerful campaign worker from some organization like Adios Arpaio to turn in or mail for you, have you committed a Class 5 felony?

I asked the Arizona Secretary of State's Office.

"No," replied SOS spokesman Matt Roberts. "But there are requirements. Plus, [the ballot] has to be signed and sealed in the tamper evident envelope by the voter."

Roberts referred me to Arizona Revised Statute 16-1005.

This statute does make it clear that anyone "misrepresenting" themselves "as an election official or as an official ballot repository" or "is found to be serving as a ballot drop off site" is guilty of a class 5 felony.

Yet, another part of the law makes it clear that what groups such as Adios Arpaio and Citizens for a Better Arizona are doing is legal, as long as no one is misrepresenting themselves or delaying the delivery of the ballots.

"A person who knowingly collects voted or unvoted ballots and does not turn those ballots in to an election official, the United States postal service or any other entity permitted by law to transmit post is guilty of a class 5 felony."

If you knowingly collect them and do not turn the ballots in, that's a problem. Which implies that if you collect them and turn them in properly, you're within the law.

Arizona elections law expert Tom Ryan, the attorney best known for exposing the sham candidacy of Olivia Cortes during last year's recall election of Russell Pearce, confirmed that picking up ballots for voters is standard practice for candidates and campaigns, as common as offering someone a ride to the polls on election day.

"Anything that misleads the voter into giving you [an early] ballot, or making them vote for someone other than they intend to vote for is a Class 5 felony," he observed.

But if you're honest, and you turn the ballot over to elections officials in a timely manner, it should all be good.

"If I walk up to you and I say, `I'm from Adios Arpaio, and I'd like your early ballot so I can turn it in and make sure it's counted,'" he said, "there's nothing illegal, immoral, unethical, [or] improper...about that."

As a result of the confusion, Citizens for a Better Arizona has announced that it will be turning in over 600 early ballots that the organization has collected to county elections this afternoon.

In a press release, CBA president Randy Parraz denounced Purcell, a Republican, accusing her of voter suppression tactics.

"We have been talking to voters for the past six weeks about the November 6th election, we have signed up over 12,000 voters to receive their ballot in the mail and we have registered over 1,400 citizens to vote," Parraz is quoted as saying. "Now we are going back to these voters and with THEIR PERMISSION we are collecting ballots and turning them into the County Recorder."

"For Helen Purcell, the County Recorder, to go on television and say that such behavior is equivalent to a class 5 felony is reckless and unacceptable. This appears to be just another Republican tactic to suppress the Latino vote. We will not tolerate this type of behavior from our County Recorder. She needs to resign or learn the rules before she opens her mouth."

I'm not willing to go that far, but county elections officials can diffuse the situation by issuing a clarifying statement to the press. Hopefully, they will do so.

UPDATE 10/19/12: Channel 5 has corrected the online text of its report on early ballots, but it does not note a correction, and the mistake is still in the video of the story itself.

The story now directly quotes Purcell as saying, "Being in custody of somebody else's ballot without their permission is a Class 5 Felony."

In the original report, Rossi paraphrases Purcell as saying, "it's a Class 5 felony to possess someone else's ballot."

Which, as I've demonstrated, is incorrect.

Still, about 33 seconds into the segment, Rossi is still stating the incorrect info.

I'm glad Channel 5 made a correction, but the station should note on the site that a correction's been made. And it needs to make the correction on tonight's newscast.

Seems Purcell was the victim of an inaccurate report. Still, I wish county elections had sent out a notice afterward with the correct info.

I should note that I have had good experiences in my contacts with county elections heretofore. It does not seem that they were trying to deceive, based on the CBS 5 correction.

There are three legs to voter suppression in Arizona - SO FAR. All initiated by Republican election officials. 

First, giving the wrong date for the election in Spanish, but the right one in English. Even if you think all voters should speak English, assuredly you cannot countenance telling people who prefer Spanish the wrong date for the election. 

 

Second, publicly announcing that people commit a felony when they receive ballots from other people in order to turn the ballots in to the County Recorder. There will be tens of thousands of such ballots received by thousands of people including relatives, friends, neighbors and various organizations. Besides which, it just is not true that receiving someone else's ballot and turning it in for them is illegal. 

 

The third leg of voter suppression in Arizona is not aimed specifically at Hispanics, but at students.

The Supreme Court ruled that Arizona's requirement to provide proof of citizenship in order to register to vote was unlawful.

Accordingly thousands of students at ASU registered using the federal form since many do not possess Arizona driver's licenses. 

The Maricopa County Recorder, Helen Purcell, is holding these registrations in "suspense." I can't imagine what higher court she is looking to,

but in the meantime, she is:   NOT sending mail-in ballots to these students  >

NOT sending them information about where their polling place is, sample ballots, elections guides or anything else.

And NOT notifying them that there is any problem with their registration or request for a mail-in ballot. All of this is called voter suppression,

and it's a very big deal, and all but secret.

Real Election Fraud Alert!  While this is new and details are still surfacing-

31 yr old republican campaign worker Colin Small arrested and charged with 8 felony counts. He was employed by  Strategic Allied Consulting.  (does that name ring a bell to anyone?) 

He was caught in the act of dumping voter registration forms in the trash.

 

 I'll post more as the story develops. This happened in Va. which is one of the States that the republican party hired Strategic Allied Consulting.

This practice of having people pick up voter ballots has been going on for years.  Why would Percell even make notice of it?  Where has she been all these years?  Can you smell voter intimidation?  I sure can.

If somebody receives an early ballot and decides, for whatever reason they choose, not to vote, or they are too lazy, or they forget, there should be nobody making contact with them and directly assisting or prompting them to do anything. My early ballot polling place is my home and somebody approaching my polling place and attempting to influence in any way the voters within is akin to standing next to the booths at the official polls and communicating with voters behind the curtains.

 

If I wish to go to my polling place in person and take my ballot into the booth and just stand there for five minutes without marking the ballot at all, there can't be anybody looking over my shoulder to ask if I voted and encourage me to reconsider my non-participation. If they can't do it at the official booths, they can't do it at my polling place. Some good republicans need to sue over this.

I've never heard of this practice. I think that if somebody knocked on my door and asked me to hand over any of my mail, I'd at the very least call the police, and at the slightest provocation, be ready to hold the trespasser face down on the pavement until the police arrived. Even if they politely explained who they were and immediately left, I'd still call the cops and write down license plate numbers and other identifying information. I only know a few of my redneck neighbors, but I can imagine that their reaction to the cold-caller would make mine look positively civilized. This sounds like a dangerous sport and should not be allowed.

I am so glad to have read this.  Several recent elections I have picked up ballots beginning the Friday before the Tuesday election, and deposited them on election day in ballot boxes specifically set up for that purpose in official polling places.  I have gone so far as to gather ballots from residents of a nursing home and walked them across the street to a polling place.  For a while I thought I was a felon.  Delighted to know that I am not.

 I wonder how active the CBA has been in the registration and future ballot stuffing efforts in Kunasek's district.  I'm cure randy is doing everything necessary to assist his wife lillie alvarez's efforts to obtain a county BoS seat.  I'll bet there was also a lopsided effort by adios arpaio in that same district.

Facts remain facts.

 

Helen Purcell has yet to make a corrective statement or correction. So far she has NOT responded to media requests for clarification and that is very suspiciuos.

 

CBS 5 sometimes does a great job covering and investigating. This is not one of them. They did an aweful job on this and it created unneeded fear and controversy.

 

They made corrections to text without even admitting error.

They should do a follow up admitting error and present the actual law and facts.

Purcell is a registered Republican, so it can be assumed that Unferth's erronious comments are suggesting that Purcell stated (according to fat ass, lazy Rossi)  Rossi paraphrases Purcell as saying, "it's a Class 5 felony to possess someone else's ballot." What Purcell stated was, "Being in custody of somebody else's ballot without their permission is a Class 5 Felony."

 

Now lets get back to you-  You made comments that "THEY" were fighting to keeps Mexicans from voting.  You went on to identify CBS 5 and state "THEY" got the story wrong.  You also mentioned only one other group that could be the indication of who "THEY" were that you were referencing.  That was "republicans." 

 Now you post unferth's comments when he states that republicans are responsible for the public announcement that people are committing a felony when they receive (possess) ballots from other people.  Yet it was CBS 5's Donna Rossi (not a Republican) who made the statement and who misquoted Purcell. 

Are you again suggesting that CBS 5 is somehow doing the bidding of the Republican party by releasing the false statement regarding the ballot stuffing Adios Arpaio and the CBA pride themselves in? 

 

Either Unferth (and by proxy) you are wrong AGAIN or you are both attempting to argue that CBS 5 doesn't want Mexicans to vote.

 Perhaps since Purcell didn't make the false statements the creator of this petition and those who support it could hold themselves to the same level of accountability and correct their position towards her and support her for doing the job she is tasked with.  Maybe you could turn that petition towards Donna Rossi and Co at Channel 5 where the responsibility truly lies reference this disinformation.

 @dennis20 It's not Helen Purcell's responsibility to police the media.  It's certainly the responsibility of the media to get the story right the first time, and when they mess it up, to fix it on their own.  Purcell did not create this problem.  Rossi started it, lemon's continued it and your type run with it. 

 

Dissinformation is still dissinformation.  You can't justify continuing to support debunked information as fat simply because you feel the County Recorder's Office hasn't gotten back with your type.  There is nothing suspicious about this except that you feel empowered to lie because it fits your agenda.

Republican Sproul's days as a free person should be numbered.  People forget that even Arpaio  tried to go after ACORN for the media attention.  His team of highly trained dicks couldn't even figure out where to serve them.  With Karl Rove by his side,  Bush fired US attorneys because their conscience wouldn't allow them to gin up charges after being forced to investigate them.  Even as the fake ACORN rage was being pushed 24/7  nothing of any substance was uncovered because it didn't exist.

Voters who rarely, if ever voted are being educated and voting and that means republicans are pissed. Thats why they passed ALEC voter supresion laws in 20 States this year. As the republican founder of ALEC said "we lose elections when everyone votes. We don't want everyone to vote." You can read anything you want into the article and call the writer names while screaming foul when I call you and your ho names but it's still a straw-man spin from a coward.  You want to discredit CBA and the Pearce recall?  @dennis20I included a link to the entire story.  It was sufficient to debunk your claims I had no evidence supporting my claim.  It must irk you that I use your boyfriend's words to shut you down.  I like how you immediately change the goal posts after your initial argument was that I don't have reson to use the term ballot stuffing to describe what the CBA and Adios Arpaio are doing.  Your cut and paste had nothing to do with the initial argument.
